NOTIFICATION No.H.12018/28/92-LJD, the 26thNovember, 1996. The following Act of the Mizoram Legislative Assembly, which received the assent of the Governor of Mizoram is hereby published for general information.
The Mizoram Act No.10 of 1996 The Mizoram (Village Council) (Amendment) Act, 1996 Received the assent of the Governor of Mizoram on the 5th November, 1996.
AN ACT to further amend the Lushai Hills Dictrict (Village Councils) Act, 1953 Whereas it is expedient in public interest to further amend the Lushai Hills District (Village Councils) Act, 1953. (Act No V of 1953 ) (hereinafter referred to as the Principal Act).
Be it nacted by the Legislative Assembly of Mizoram in the Forty- Seventh year of Republic of India as under.
1. (1) This Act may be called the Mizoram ( Village Councils (Amendment) Act,
1996.
(2) It shall have the like extent as the Principal Act.

2. (1) In the principal Act, for sub-section (2) of section 3 the following sub-section shall be substituted, namely:- Vol XXV Aizawl, Tuesday 26.11.1996 Agrahayana 5. S.E. 1918 Issue No. 411 Regd. No. NE 907 Amendment of section 3 Short title extent, and commencement
(2) Number of members of Village Council: A Village Council shall be composed of members according to the number of houses it contains as specified below :-
(a) For village not exceeding 100 houses there shall be 3 members;
(b) For village with more than 100 houses, but not exceeding 200 houses, there shall be 4 members;
(c) For village with more than 200 houses, but not exceeding 400 houses, there shall be 5 members;
(d) For village with more than 400 houses, but not exceeding 700 houses, there shall be 6 members;
(e) For village with more than 700 houses, but not exceeding 1000 houses, there shall be 7 members;
(f) For village with more than 1000 houses, but not exceeding 1500 houses, there shall be 8 members;
(g) For village with more than 1500 houses, there shall be 9 members.
3. In of section 7 of the principal Act, the new sub-section inserted by clause (b) of section 5 of the Lushai Hills District (Village Councils) (Amendment) Act, 1986, as sub-section (9) of section 7 shall be renumbered as sub-section (10) as under:
“(10) The Government may remove the President or the Vice President of a Village Council if in his opinion the President or as the case may be, the Vice President has lost support of the majority of members but refuses to tender resignation or it too inefficient or too corrupt to carry on the Village administration or is acting in a manner prejudicial to the interest of the State.
4. In sub-section (3) of section 8 of the brincipal Act for the figures and word, namely, “Rs. 25” in between the readings “not exeeding” and “per Hnatlang day” the word and figure namely “Rs. 50” shall be substituted.
5. In sub-section (3) of section 9 of the principal Act, for the word and figure, namely, “Rs. 10” in between the readings “not exeeding” and “per Hnatlang day” the word and figure namely,“Rs. 25” shall be substituted.
6. In the principal Act, in section 15, for the punctuation mark, “full-stop (.)” after the last word namely, “collection” the punctuation mark colon (:) shall be substituted and after it the following new proviso shall be added, namely:
Amendment of section 15 Amendment of section 9 Amendment of section 8 Amendment of section 7 Ex-411/96 - 2 - “Provided that a Village Council may appoint a Treasurer from amongst the members who shall keep developmental grants and other fund exclusive of a collection authorised by law, and maintain the accounts thereof which will be liable to inspection by the Village Council in sitting and by an official authorised to do so by a Government.
7. Notwithstanding anything contained in section 2 of this Act, a member of Village Council in office immediately before the commencement of this Act, whether elected or nominated, shall continue in office during the life of the Village Council concerned unless he is otherwise disqualified or terminated or the Village Council is dissolved sooner under relevant provisions of the principal Act.
