m-rrr I" I No. 1436-F-3-4/2012/XIII : In exercise of the powers conferred by sub-section . (1), (2), (5), (6) and (7) of section 131 and 133 of the Electricity Act, 2003 (36 of 2003) read with sub-section (1), (2) and (3) of section 23, 24 and sub-section (2) of section 56 of the Madhya Pradesh Vidyut Sudhar Adhiniyam, 2000 (No.4 of 2001), the State Government, hereby, makes the following amendments in the Madhya Pradesh Electricity Reform First Transfer Scheme Rules, 2003, namely :- AMENDMENT In the said rules, in rule 7,-
(1) In sub-rule (10), after clause (c) the following clause shall be inserted, namely :- "(d) Personnel who are transferred to M.P. Tradeco or who are retained in MPSEB 158 (2) shall be treated, for the intent and purpose of pension and terminal benefits, as personnel of Transco and all contribution towards the pension and other terminal benefits in respect of such personnel shall be made by Transco and shall be a charge on the revenue of the Transco,'l
(2) after sub-rule (10), the following new sub-rule shall be inserted, namely :- "(10A) (i) The contribution towards pension and other terminal benefits up to the date of transfer shall be in respect of two periods namely:-
(a) up till 31 st May, 2005 when the Government order No. 3679 dated 31/5/2005 for conducting the activities independently by the successor companies was notified;
and .(b) from 1st June, 2005 when the activities are being undertaken by the Successor Companies in terms of the Government order dated 31 May, 2005 until the date of transfer, wherefore the past services rendered by the personnel shall be the services rendered in the respective Successor Company notwithstanding that the personnel had not been transferred and permanently absorbed in the services of the .successor companies till the date of transfer.
(ii)ln regard to the services up to 31 st May, 2005 including the period prior to 1-10-2003, the contribution towards pension and other terminal benefits for services rendered by the personnel in Madhya Pradesh State Electricity Board / Madhya Pradesh Electricity Board shall be made by Transco.
(iii) The contribution towards the pension and other terminal benefits for the past services rendered from 1.6.2005 till the date of transfer shall be made by the respeCtive transferees including, in addition by Transco for personnel of M, P.
Tradeco and for personnel of Madhya Pradesh. State Electricity Board not transferred to the successor entities.
.(iv) The subscription to the fund to be built up for payment of pension and other terminal benefits in regard to the services of the personnel of the Board,including as referred to in (i) to (iii) above, in addition to the amount of pension and other terminal benefits payable each year and also the contribution to be made for the respective current year of service shall be a charge on the revenue of the respective 1=[~ ~, fu:;:ricn 24~ 2012 ====== 158 (3) transferees, including Transco, as the case may be, in respect of the contribution referred to in sub-clause (c) of sub-rule (10) of rule 7 of the First Transfer Scheme Rules.
(3) The appointed date referred to in the notification No. 6061-F-R,S-6~2007-XIII dated 19th September, 2007, shall be construed with reference to apportionment of .contribution to be made to pension and other terminal benefit liabilities and shall not in any manner have any implication to the date of transfer of personnel.".
