1. Short title and oommenoement. - (1) These rules may be called the Joint Electricity Regulatory Commission for the States of Manipur and l4izoram (Salaries, Allowances and other Conditions of Service of Chairperson and Members) Rules, 2006,
2. Definitions. - In requires, - these rules, unless the context otherwise
(a) "Act" nBans the Electricity Act 2003;
(b) "Commission" means the Joint Electricity Regulatory Commission for tie States of lYanipur and Mizoram constituted under section 83 of the AcU
(c) Words and expressions used herein and not defined but defined in the Act, shall have the rneanings respectively assigned to them in $e Act.
3. Oath of Otrice and secrecy. - A Member of the Commission shall, before entering upon his bffice, subscribe to an oath of office and secrecy before the Minister in-charge of the Ministry of Power (Union Govemment) and the oath of office and secrecy shall be administered ln the following form:- Oath of secrecv I, do swear in the name of God and solemnly affirm that I shall not directly or indirectly communicate or reveal to any person or persons any matter which shall be brought under my consideratjon or shall become known to me as the Chalrperson or Member of the Joint Electricity Regulatory Commission for the States of Manipur and lvlizoram except as may be required for the due discharge of my duties as such Chairperson or Memhr.

(2) They shall come into force on the date of their publication in the Official Gazette.
I [ lrrl ll-€Es3(i)] iTfdSI{I! l'l I q{flqRq 5 L Oath and affirmation of allegiance to Constituuon having been appointed Member of the Joint Electricity Regulatory Commission for the States of Manipur and Mizoram, do srrear in the name of God and do solemnly afflrm that I shall bear true faith and alleglance to the Constitutlon of India as by law eshblished, that I shall uphold fie sor/ereignty and integrlty of India, that I shall duly and faithfully and to the best of my ability, knowledge and judgement perform the duties of my office yvlthout fear or fuvour, affection or ill-will and tfiat I will uphold the Onsfitution and the laws of the land.
4, Pay. - A Member shall be entitled to re@lve pay in the scale of pay of Rs,22400-525-24500 per month.
Provided that ln case a person appointed as ttre Member is ln receipt of pension from;
(a) Union Govemment including Railways, Defence, Posb and Telecommunicat'on; or
(b) State Govemment or Unlon Territory Administrat'xln; or
(c) Public Sector . Undeftaking, Local Body, Autonomous Body llke University or Semi-Govemnrent Organization like Port Trust;
the pay of such person shall be reduced by the gross amount of pension las illustrated in Bre C.entral Civil Serulces (fixation of pay of re-employed pensioners) Orden, 1986J drawn by him:
Provided futher that a Member shall be entlfled to receive admlsslble allowances on the original basic pay before such flxaUon of pay,
5. Deamss allowance and clty compensatory alloltanoe. - A Member shall be entlUed b receive dearness allowances and city compensatory allowance, and other allowances at the rate admissible to a Group 'A' Officer of the Centrdl Government drawing an equivalent pay.
6. Leave. - A Member shall be entiUed to 30 days of earned leave for every year of seMce and the payment of lea\le salary, during leave, shall be governed under tlE provislons of rule 40 of the Central Civil SeMces (Lea\€) Rules, 1972.
7. Leaye sanctioning authority. - In the case of the Chairperson' the Mlnister-in-charge of the State Govemment which he represents in the Commission, and in the case ofa Member, the Chairperson, shall be the leave sanctioning authority.

9. Travcdling allowances. -(1) A Member while on tour wlthin India or on tmnsfer (including the joumey undertaken by self and family to joln the Commission or on the expiry of term with the Commission to proceed to hls home town wlth Family) shall be entitled to the joumey allowance, daily allowance and t"nsportatioo of personal effects at the same scales and at the same rates as are applicable to a Group 'A' Officer of the Central Crovernment drawing an equivalent pay.
(2) Forelgn tours to be undertaken by a Member shall require prior approval of the State Govemment which he represenb in the Commiss'on and necessary clearances of the Central Governrnent.

10. Leave trav€l conoession. - A Member shall be entitled to leave travel concession at the same scale and at the same rate as admissible to group'r( officerc of the Central Gorcrnment drawing an equivalent pay.
11. Accommodation. - (1) A Member shall be entided for residential accsnmodation as per norms of Government of Mizoram.
Provided that for such accomnpdation which is according to and within the entitlement of the Member the standard licence fee shall be the same as in the case of a Group "ff officer of similar status of the Central Government posted at Aizwal.
(2) In case Govemnent of Mizoram do not'provide residental accommodation to a Member, he shall have the opt'on of claiming house rent allowance as admissible to Group A officers of similar stafus of the Central Government posted at Aizwal.

8. Providert tund. - A Member shall be gwemed by the Conbibutory Provident Fund Rules (Indla). 1952 and no option to subscrtbe under the provisions of the Geneml Provident Fund Rules (Central SeMces), 1950 shall be available. No pension or gratuity shall be adinissible for service rcndered in the Commission.

Transport. - A l.lember shall be allowed the option to make use of an official vehide or reimbursement of such amount as may be fixed by tie Central Government from time to time in respect of a Group "A" officer of the central Government drawing an equi\ralent pay for the use and mainterEnce of his personal car.
13. Medical treatment. - A Member shall be entiffed to medical reimbursement and fadlity as admlssible to a Group 'A' officer of the Central Government drawing an equivalent pay.
14. Telephone facitity, ofricial meeting and enteilainment expenses.
- A Member shall be eligible for telephone facilities, official meetings and entertainment expenses as admissible to a Group "A" officer of the C-entral Govemment drawing an equivalent pay.
15, Odrer oondltlons of seryiceg. - Other conditions of service of a Member, with respect to whidl no express provislon has been made in these rules, shall be such as are admissible to a Group 'A" officer of the Central Goremment drawing an equi\ralent pay.
