AB RE A | GOVERNMENT OF PUNJ _ DEPARTMENT OF NRI AFFAI RS : 271 17੭ Notification The February, 2017 ~ No.7/47/2012-NRI(3)/148 :- In exercise of the powers conferred by sub- Section (1) of section 24 read with section 9 of the Punjab State Commission for Non- Resident Indians Act, 2011 (Punjab Act No. 33 of 2011), the Government of Punjab is pleased to make the following rut

es, namely:- Short title and commencement: - (1) These rules may be called The Punjab State Commission for Non-Resident Indians, Members (Salaries, Allowances and other Terms and Conditions o Service ) Rules, 2016.
(2) They shall come into force at once.
Definition:- In these rules, unless rhe cantext otherwise reguires:-
(8) “Act” means the Punjab State Commission for Non-Resident Indians Act, 2011 ( Punjab Act No. 33 of 2011);
(b) Commission means Punjab State Commission for Non-Resident Indian established under the Act.
(੮) Member means a member appointed under section 3(2)(b) and 3(2)
(c) under the Act. d
(d) “Goverament “means the Government of Punjab in the Department of NRI Affairs.
Salary:- ces In case of serving Indian Auministrative Services or Indian Police Services Officer is appointed in accordance with the act, the salary and allowances shall be the same as he would have got if he would have been posted cn any cadre post of his services with the State Government. - 10 case a Member is appointed In a:cordance with the Act, who is retired Indian Administrative Service or Indian Police Service Officer, he shall be entitled to the salary and allowances, which are equal to the salary and allowance of last pay drawn minus pension, which has been allowed to him by the Government.
Provided that if the Membe- at the time of his appointment was in receipt of or being eligible so to do, and elected .to draw, a pension (other than disability or wound pension) in respect of any previous Service under the Government of the Union or Government of a State, his salary in respect of Service as Member, as the tase may be, shall be reduced:-
(1) by the amount of that pension;
(ii) If he had, :efore assuming office received, in lieu a portio n of pension due to him in a respect of such previous Service, the commuted vaiue thereof by the amount of that portion of the pension; . and
(iii) By any other form of retirement benefits being drawn or availed of or to be drawn or av ailed of by him.
22 Leave and Leave Travel Concession : (1) In case of a serving officer appointed as member, he shall be entitled to leave and leave travel concession as admissible to the Officers of the Indian Administrative Services/Indian Police Service in accordance with the provisions of the All India Services (Leave) Rules, 1955, and All India Services (Leave Travel Concession) Rules, 1975 and the crders of the Central Government issued there under from time to time. The whole expenditure with regard to leave travel concession will be borne by the borrowing organization. As laid down in rule 10.9 of the Punjab Civil Services Rules, Volume-1, Part-I, the whole expenditure in respect of all allowances including dearness pay etc. forming part of the leave salary for the period of leave in or at the end of the foreign service shail be borne by the commission.
(2) In case if retired Indian Administrative Services or Indian Police Services Officer is appointed as Member in accordance with the Act, he shall be entitled to Leave and Leave Travel Concession as applicable to the : Chairman of the Commission.
MEDICAL FACILITIES: A serving IAS/IPS officer when appointed as member under the Act shall be entitled to same medical facilities and reimbursement as_ admissible under the Ali ‘India Service (Medical Attendance) Rules, 1954 as applicable *o a Serving IAS or IPS officer. The expenditure in this regard shall be borne by the Commission. A retired IAS/IPS officer when appointed as mernber, he would be entitled to this facility as was admissible to the rank on which such officer(s) had retired.
TRAVELLING ALLOW/ANCE/DAILY ALLOWANCE: A member appointed under the At shall be entitled to same travelling allowance or daily allowance as admissible to any Principal Secretary or Additional Director General of Pualice, as the case may be of State Government of Punjab at the rates applicable in the State Government and will be paid from the funds of Commission.
TRANSFER TRAVELLING ALLOWANCE: A serving IAS/IPS officer when appointed as member under tals Act shall be entitled to Transfer Travelling Allowance for joining the’new pest and en transfer there from it and it will be payable in accordance with the rules of the State Government as applicable to an Indian. Administrative Se“vices or Indian Police Services Officer, as the case nay be, from the funds of the.Commission. In case of a retired 1AS/IPS officer when appointed as member, there will be no such benefit.
HOUSE RENT ALLOWANCE: If serving Indian Administrative Service or Indian Police Service Officer is appointed as Member, his entitlement for Government Residential Accommodation or House Rent Allowance shall be the same which he would have been entitled to if he would have been rnment on any cadre post of Indian Administrative serving in the Gove i Service or Indian Police Services, as the case ma y be. In case of retired i Indian Administrative Service! or Indian Police Service Officers being appointed as member in accordance with the Act, his entitlement to House Rent Allowance shall be the same as of the Cha irman of the Commission. If he is already in occupation of Government residential 866971047ਪ55%1. he will be permitted to retain the same on payme nt of five percent of his pay or the standard rent, whichever is applic able, as-a house rent from his own en the market rent and rent paid by him ocket and the difference b etwe ana fo his own pocket ॥ any is to be paid by the Commission.

Director General of Police, as the case may be, of the Government of Punjab.

10. P.O. : Members will be entitled to staff car along with driver. The limits of POL, repair and maintenance and private use of vehicle shall be as such as applicable to the Principal Secretary of the Government of Punjab.
11. General: Other unclassified matters will be governed by the orders of the Government/the Government of India, as applicable to the Officers of the Indian Administrative Service or Indian Police Service, as the case may be.
Provided that neither the salary and allowances nor the other terms anc conditions of service of the Members shall be varied to their disadvantage after his appointment.
12. In case of any doubt, a clarification shall be given by the Government, which shall be final"and binding.
