Section 368: Permission in case of markets, shops etc

The Nagaland Municipal Act,2001State Act of Nagaland · Act 10 of 2001

1. The Chief Officer of a Municipality may, from time to time and with prior approval of the Municipality, notify that in the municipal area of the Municipality, no new market or shop or trading shall be established or kept open to, abut on a public street or portion thereof, without his prior permission, whish shall be subject to the provisions of the section 369.

2. The Chief Officer may refuse to give such permission with due regard to the traffic constraints in the vicinity.

3. Notwithstanding the existence of any markets or shops on any such street, such refusal of the Chief Officer shall be final.
