Section 406: Power to stop use of premises used in contravention of license

The Nagaland Municipal Act,2001State Act of Nagaland · Act 10 of 2001

If the Chief Officer of a Municipality is of the opinion that any premises within the municipal area of the Municipality is being used for a nonresidential purpose without a municipal licence or otherwise than in conformity with the terms of municipal licence or granted in respect thereof, he may stop the use of any such premises for any such purpose for a specified period by such means, as he may consider necessary

2. If a person continues to use any premises in contravention of the provisions of sub-section (1), the Chief Officer may, notwithstanding any other action that may be taken against such person under this Act, levy a continuing fine in accordance with the provisions of sub-section

(4) of section 365.
