S.O. 3454(E).-Whereas, the Nalanda University Act, 2010 (39 of 20 10) (hereinafter referred to as the 'Nalanda Act') was enacted on 21st September, 2010 and the provisions of the said Act were brought into force on the 25th day of Novemper,201O;
And whereas, Section 7 of the Nalanda Act makes provision for constitution of the Governing Board of the University;
And whereas, the proviso to Sub-section (2) of Section 8 of the Nalanda Act provides that the Nalanda Mentor Group shall exerc ise the powers and discharge the functions of the Governing Board for a period of one year or till such time the members referred to in clauses (c) to (g) of Sub-section (1) of Section 7 are nominated, whichever is earlier;
And whereas, the Nalanda Mentor Group has been functioning as the Governing Board since 25th November, 2010 and its tenure in terms of the proviso to Sub-section (2) of Section 8 of the Nalanda Act was upto the 24th day of November, 2011;
And whereas, under the provisions of Sub-section (I) of Section 41 of the Nalanda Act, for the purpose of removal of difficulties, the period of 'one year' in the proviso to Sub-section (2) of Section 8 was first extended to 'two years' vide order number S.O, 2626(£), dated the 24th November, 2011, and thereafter to 'three years' vide order number s.o. 2774(E), dated the 23rd November, 2012;

And whereas, the Government had already initiated the process to select and nominate members .of the Governing Board in terms of Section 7 of the Nalanda Act, and the same is likely to take some more time;
And whereas, Section 7 of the Nalanda Act provides for the composition of the Governing Board which, inter alia, consists of five members from amongst the Member States of the East Asia Summit and three members from amongst tile persons being renowned academicians or educationists, to be nominated by the Central Government;
And whereas, the process for selection of the members of the Governing Board in terms of Section 7 of the Nalanda Act would not only. require amendments to the said Act, but also consultations with the Member States of the East Asia Summit and consideration ofselectio~.ofthe renowned academicians and educationists;
4 THE GAZETTE OF INDIA: EXTRAORDINARY [PART "·-SEC. 3(ii)] And whereas, the Government had already initiated the process of making changes in Section 7 of the Nalanda Act which provides for the composition of the Governing Board, by introducing the Nalanda University (Amendment) Bill, 2013 in the Rajya Sabha on the 26th August, 2013, and the passing of the Bill by Parliament is likely to take some more time;
And whereas, the dissolution of the Nalanda Mentor Group which is working as the Governing Board of the University as on date will cause discontinuity in the implementation ofthe ongoing programmes of the University and its governance;
And whereas, though the Government is taking all steps to promptly constitute the Governing Board, but there is genuine difficulty in giving effect to the provisions of the Nalanda Act and, therefore, it is proposed to issue an Order further to remove this difficulty.
Now, therefore, in exercise of the powers conferred by Sub-section (1) of Section 41 of the Nalanda Act, the Central Government hereby makes the following order. to remove such difficulty, namely:- I. (I) This order may be called the Nalanda University (Removal of Difficulties) Order, 2013.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the Nalanda Act, in Section 8, in sub-section (2), for the proviso, the following proviso shall be substituted, namely:- "Provided that the Nalanda Mentor Group shall exercise the powers and discharge the functions of the Governing Board until the members referred to in clauses (c) to (g) of Sub-section (I) of Section 7 arc nominated" [F.
