770(E), dated the 10th September, 1980;
And whereas the question of regulated and orderly development of the Nannada Valley and the Narmada sagar, Sardar Sarovar and other Projects planned in tfie Nannada Basin has been further discussed with the State Governments • concerned and t,he agreement has been reached inter alia to enlarge the role and strengthen the composition of the Narmada Control Authority and the Review Committee so as to take such measures as are necessary or expedient 3 for the protection of the environment and prepare schemes for the welfare and rehabilitation of oustees and other affected persons;
Now, therefore, in exercise of the powers conferred by section 6A of the Inter-State Water Disputes Act, 1956 (33 of 1956), the Central Government hereby further amends the Narmada Watejr Scheme, as follows, namely: —
1.(1) This scheme may be called the Narmada Water (Amendment) Scheme, 1987;
(2) It shall come into force on the date of its publication in the Official Gazette.
•2. In the Narmada Water Scheme,—
(1) in paragraph 1, for the words "Narmada Water Scheme", the words and figures, "Narmada Water Scheme 1980". shall be substituted; "
(2) in paragraph 2,— 0) for sub-paragraph (2), the following subparagraph shall be substituted, namely:— "(2) (a) The Authority shall consist of the following Members, namely:— (\) Secretary to the Government of India, Ministry of Water Resources —Chairman
(ii) Secretary to the Government of India, Ministry of Energy, Department of Power Memlvi
(iii) Secretary to the Government of India, Ministry of Environment and Forests Member
(iv) Secretary to the Government of Indi:i, Ministry of Welfare Member
(v) Chief Secretary to the Government of Gujarat Member
(vi) Chief Secretary to the Government of Madhya Pradesh Member Cvii) Chief Secretary to the Government of Maharashtra , —Meinbei fviii) Chief Secretary to the Government of Rajasthan Member
(ix) to (xi) three persons not below the rank of Chief Engineer, to be appointed by the Central Government as Independent Members, one of whom shall be the E T ^ * ^ " Member of the Authority —Member
(xii) to (xv) four persons of the rank of Engineer-in-Chief,. Chief Engineer or Additional Chief Engineer in-charge of the Irrigation Department, the power Department or the State Electricity Board, one each to be appointed by the State Governments of Gujarat, Madhya Pradesh, Maharashtra and Rajasthan.

(b) The Executive Member will be in-chargc of the administrative work of the Authority under the general .supervision and control of the Chairman. The Cenlral Government, or as the case may be, the State Government shall have the potv'T in remove or suspend any of I'IC Member -sppointrd under clauses (ix) to (xv), if in its opinion he is not suitable to continue ;is a Member.
(c) .rTb^e-Qhairman and the Expcuiive Member shall be entitled to.a deliberative vote ,a,t meetings -where decisions are niken on. any matter affecting the interest of more trmn one State.
(d) The Secretaries to the Government of India and the Chief Secretaries to the Governments when unable to attend the meeting of the Authority may send their representatives not below the rank of the Additional Secretary, or as the case may be the Additional Chief Secretary.";
(ii) in the proviso to sub-paragraph (4), the portion be^innir^ with the words "soviand except" and ending with the words "aTicifttc" i-vf 'he Chairman of the Authority.** shall be omitted.
(Hi) after mb-paragraph (4), the following sub-paraeraph shall be inserted, namely :
"(5) The Executive Member shall presidi over the business meeting of the Autho rity. In the absence of the Executive Member1 in the event of illness or other-, wise, the next senior Independent Member appointed by thf Central Govern' ment as tjje Executive Member, shali preside over the business meeting.";
3. in paragraph 4, for the words "Five" and "three", the words "Ten" and "six" shall, respectively, be substituted.
4. in paragraph 5, after sub-paragraph (4), the following sub-Daragraph shall be substituted, namely :
"(5) Where the Secretary to the Government of India Ministry of Environment and Forests, is of the opinion that any decision of the Authority is inconsistent with the needs of environmental protection^, the matter shaTI be reserved for the decision of the Review Committee.";

5. in paragraph 9, —
(i) for sub-paiagr.aph (1), the following subparagraph shall be substituted, namely:— "(1) The role of the Authority will mainly comprise of overall coordination and direction of the implementation of all the projects including the enginnering works, the environmental protection measures and the rehabilitation programmes and to ensure the faithful compliance of the terms and conditions stipulated by the Central Government at the time of clearance of the aforesaid projects.";
(ii) after sub-paragraph (2), the following subparagraph shall be inserted, namely:— "(2A) The Authority may constitute one or more sub-committees and assign to them such of its functions and delegate such of its powers as it thinks fit.";
6. in paragraph 13, in the sub-paragraphs (3),
(4) and <6) for the words "Chief Engkders", the words "Chief Secretaries" shall be substituted;
7. in paragraph 16,—
(i) in sub paragraph (1), atter the words "any party Slate", at both the places where they occur, the words "or Secretary to the Government of India, Ministry of Environment and Forests", shall be inserted;
(ii) in sub-paragraph (2), —
(a) for the word "five", the word 'six" shall be substituted;
(b) after item (i), the following item shall be inserted, namely:— "(ITO) Union Minister of Environment and Forests Member";
(c) for the words "Ministry of Irrigation", the words "Ministry ot Water Resources" shall be substituted.
