PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY राष्ट रीय रािधानी क्षते्र योिना बोडड (आवासन एव ंिहरी कायड मतं्रालय) अजधसचूना नई दिल् ली, 13 माचड, 2020 स.ं बी-20018/5/2012-प्रिा.—राष्ट रीय रािधानी क्षेत्र योिना बोडड अजधजनयम, 1985 की धारा 37 द्वारा प्रित् त िजतियय का प्रयोग करत ेुए, कें द्र सरकार की पूवाडनुमजत के साथ, बोडड जवजध अजधकारी (लॉ ऑदिसर) के पि हतेु जनम्नजलजखत जवजनयम प्रस्ट्ततु करता ह:ै
1. लघ ुिीर्ड और प्रारंभ - i. इन जनयम को राष्ट रीय रािधानी क्षते्र योिना बोडड, जवजध अजधकारी भती जवजनयम, 2018 कहा िा सकता ह ै। ii. िासकीय रािपत्र में प्रकाजित होने की जतजथ से ये जवजनयम प्रवृत् त माने िाएंगे।
2. पि की सखं्या, वगीकरण, वतेन बैंड व ग्रडे प ेअथवा वतेनमान - इस पि के जलए पि की संख्या, वगीकरण व वेतनमान इन जवजनयम के साथ संलग्न अनुसूची के कॉलम (2) से (4) मे दिए गए है ।
3. भती की जवजध, आय ुसीमा, िजैक्षक योग्यता, आदि - इस पि के जलए भती की जवजध, आयु सीमा, िैजक्षक योग्यता, आदि उतिय अनुसूची के कॉलम (5) से (13) में दिए गए हैं ।
4. अपात्रता – कोई भी व्यजतिय उतिय पि पर जनयुजतिय के जलए पात्र नहीं होगा जिसने:
क) दकसी ऐसे व्यजतिय के साथ जववाह दकया हो या समरूपी अनुबंध दकया हो, जिसका िीवनसाथी ह;ै या ख) एक िीजवत िीवनसाथी के होत ेुए दकसी व्यजतिय के साथ जववाह या समरूपी अनुबंध दकया हो;
बिते दक कें द्र सरकार संतषु्ट ह ैदक इस तरह के व्यजतिय और िसूरे पक्ष पर लागू होन ेवाले व्यजतियगत कानून के तहत ऐसी िािी की अनुमजत ह ैऔर ऐसा करने के जलए अन्य आधार हैं, ऐसे दकसी भी व्यजतिय को इस जनयम के संचालन से छूट िे। स.ं 119] नई दिल्ली, िुक्रवार, माचड 13, 2020/िाल् गनु 23, 1941 No. 119] NEW DELHI, FRIDAY, MARCH 13, 2020/PHALGUNA 23, 1941 सी.जी.-डी.एल.-अ.-14032020-218683 CG-DL-E-14032020-218683 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]
5. ररयायत/छूट िेन ेका अजधकार- िहां कें द्र सरकार की राय हो दक ऐसा करना आवश्यक या समीचीन है, एक आिेि द्वारा और जलजखत रूप में ििड दकए िान ेवाल ेकारण से, इन जनयम के प्रावधान के संबंध में दकसी भी वगड या श्रेणी के व्यजतियय को छूट ि ेसकता ह।ै
6. बचत - इन जवजनयम में कुछ भी आरक्षण, आयु सीमा में छूट और अनुसूजचत िाजत, अनुसूजचत िनिाजत, अन्य जपछडा वगड, पूवड सैजनक और इस संबंध में समय-समय पर कें द्रीय सरकार द्वारा िारी दकए गए आििेानुसार व्यजतियय की अन्य जविेर् श्रेजणय के जलए प्रिान की िाने वाली अन्य ररयायत को प्रभाजवत नहीं करेगा। अनसुचूी पि का नाम पि की सखं्या वगड प ेमरैरक्स में स्ट्तर चयजनत पि या गैर- चयजनत पि सीधी भती के जलए आयु सीमा सीधी भती के जलए आवश्यक जिक्षा और अन्य योग्यताएं 1 2 3 4 5 6 7 जवजध अजधकारी एक समूह 'क' लेवल-12 (₹78,800- 2,09,200) सातवें सीपीसी के अनुसार लागू नहीं लागू नहीं लागू नहीं क्या सीधी भती के जलए जनधाडररत आय ु और िजैक्षक योग्यता प्रोमोटी के मामल ेमें लाग ूहोगी पररवीक्षा की अवजध, यदि हो तो भती का तरीका: सीधी भती या पिोन्नजत या प्रजतजनयजुतिय/ स्ट्थानतंरण और अन्य तरीक स ेभरी िान ेवाली ररजतियय का प्रजतित पिोन्नजत/ प्रजतजनयजुतिय/ स्ट्थानातंरण द्वारा भती में, ग्रेड जिनस े पिोन्नजत / प्रजतजनयजुतिय / समामलेन दकया िाए 8 9 10 11 लाग ूनहीं लाग ूनहीं प्रजतजनयुजतिय (अल्पावजध अनुबंध सजहत) प्रजतजनयजुतिय:
कें द्र सरकार या राज्य सरकार या कें द्र िाजसत प्रििे या मान्यता प्राप्त अनुसंधान संस्ट्थान या सावडिजनक क्षेत्र के उपक्रम या अधड सरकार या वैधाजनक या स्ट्वायत्त संगठन और अन्य सरकारी जनकाय के अजधकारी:
(क) (i) मूल सम्वगड/जवभाग मे जनयजमत आधार पर सिशृ्य पि धारण करते ह , या
(ii) मूल संवगड या जवभाग मे 7वीं सीपीसी के अनुसार लेवल 11 (67,700-2,08,700) के वेतनमान पर 5 वर्ड की जनयजमत सेवा एव ं (ख) जनम्नजलजखत िैजक्षक योग्यताएँ व अनुभव :
(i) मान्यता प्राप्त जवश्वजवद्यालय/संस्ट्थान से जवजध स्नातक की उपाजध
(ii) अनुबंध संबंधी मामल /पंचाट/ जवधायी मामल /भूजम अजधग्रहण से संबंजधत कानून के क्षेत्र में 9वर्ड का अनुभव नोट 1: प्रजतजनयुजतिय की अवजध 4 वर्ड होगी नोट 2: आवेिन प्राजप्त की अजंतम जतजथ पर, प्रजतजनयजुतिय द्वारा जनयुजतिय हतेु आवेिक की आयु 56 वर्ड से अजधक न हो नोट 3: का.ज्ञा. 1. Short title and commencementi. These regulations may be called the National Capital Region Planning Board (Law Officer) Recruitment Regulations, 2018.
ii. They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts, classification, pay band and grade pay or pay scale-The number of posts, classification, and pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.
3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating thereto, shall be as specified in column(5) to (13) of the said Schedule.
4. Disqualifications-No person-
(a) who has entered into or contracted a marriage with a person having a spouse living:
or
(b) who having a spouse living, had entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for doing so exempt any person from the operation of this rule.
5. Power to relax- Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by an order and for reasons to be recorded in writing, relax any of the provisions of these regulations with respect to any class or category or persons.
6. Savings-Nothing in these regulations shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(i) Bachelor Degree in Law from a recognized University/Institute;
and
(ii) 9 years experience in handling the legal matters pertaining to contractual matters/arbitration/legislative matters/land acquisition cases.
Note 1- Period of deputation shall be four years.
Note 2-The maximum age-limit for appointment by deputation shall be not exceeding fifty six years, as on the closing date of the receipt of applications.
Note 3-The exemption from rule of immediate absorption is not required for appointment on deputation as per instructions of DoP&PW O.M.
