THE DELHI MEMBERS OF LEGISLATIVE ASSEMBLY (REMOVAL GF DISQUALIFICATION) ACT, 1997 (ACT NO.6 OF 1997) [9" Septernber, 1997] AN ACT to provide for the removal of certain disqualifications for being chosen as, and for being a member of the Legislative Assembly of the National Capital Territory of Delhi.
Be it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Forty Eight Year of the Republic of India as follows:-
1. Short title, and commmencement.—(1) This 'Act may be called’ the National Capital Territory of Delhi. Members of Legislative Assembly | (Removal of Disqualification) Act, 1997,
(2) it shall come into force at once.
2. Definitions. In this Act, unless the context otherwise requires :-
(i) “Compensatory allowance” means any sum of money payable to the holder of an office by way of daily allowance [(such allowance not excéedingss the amount of daily allowance to which a Member of the Legislative Assembly is entitled under the Members of Legislative Assembly of the National Capital Territory of Delhi (Salaries, Allowances, Pension etc.) Act , 1994 (Dethi Act No. 6 of 1995)], any conveyance allowznce, house rent . allowance or travelling allowance for the purpose of enabling him to recoup any expenditure incurred by him in performing the functions of that office;
(ii) “Statutory body” means any Corporation, Commitiee, Commission, Council, Board or other body of persons, whether incorporated or not, established by or under any law for the time being in force;
(iii) “Non-statutory body” means anybody of persons other than a statutory body, ;

Removal of certain disqualifications.—- A person shall not be disqualified and shall be deemed never to have been disqualified for being chosen as, or for being a member of the Legislative Assembly of National ‘Capital Territory of Delhi merely by reason of the fact that he holds any of mo the offices prescribed in the Schedule appended to this Act.”] 2["4. Consequential provision— All proceedings relating to disqualification of membership referred to in section 15 of the Government of National Capital Territory of Delhi Act, 1991 (1 of 1992), pending at the commencement of the Delhi Members of Legislative Assembly (Removal of ;
Disqualification)(Amendment) Act. 2006, shall be dealt with as if the | provisions of that Act were in force at the time of holding of the office specified in the Schedule to this Act.”]

Explanation----- The expression “Chief Whip” shall have thé meaning assigned to it in the Salary and Allowances of ‘the Chief Whip in the Legislative Assembly of the National Capital Territory of Delhi Act, 2003.”] 3(“5. The office of the Chairman and Vice-Chairman of the Trans Yamuna Area Development Board, Delhi.
6, The office of the Chairman and Vice-Chairman of the Delhi Rural nensionmen Board, Delhi.
7. The office of the Parliamentary Secretary to the Chief Minister of Government of National Capital Territory of Delhi.
8. The offices of the Chairman of 9 District Development Committees constituted by the Government of National Capital Territory of Delhi.
9, The office of the Chairperson of Scheduled Castes/Scheduled Tribes Welfare Board, Delhi.
1O. The office of the Chairperson, Vice-Chairperson and mernber of the Fire Prevention Advisory Cornamittee, Delhi.
11. The office of the Chairman, Vice- “Chairperson and member of the Hospital Advisory Committee, Delhi.
12. The office of the Chairperson, Vice- -Chairperson and member of the Governing Body of a Delhi Government sponsored. college.
13. The office of the Chairman and member of a co-operative institution or Organization registered under the Delhi Cooperative Societies Act, 2003.
14, The office of the Chairman, Director or inember of a statutory or non-statutory body or committee or corporation or society constituted by the Government of National Caplial Territory of Delhi:”]
Provided that the Chairman, Director or Member of any of the aforesaid Board or Body shali not be entitled to any remuneration other than compensatory allowance.
