(d) "examining body" means a University, agenCy or authority to which an institution. 'is affiliated. for conducting "examinations' in teacher ed'ucation qualific~tiops; .

(e) ,"institution" means an institution which offers courses or trai~ing in teacher education;, \

(f) "Member" means a Member _of theC(}uncil' and:;'includes the Chairperson ap.d, V~ce-ChaiDperson;

. (g) "Member-Sedretary" means the Member-Secretary of the Council appointed 'Und'er, clause (c.) of sub-section (4) of section 3;

(h) "prescribed" means prescribed by rules made under section 31;

(i) "recognised institution" means an institutiop recognised by the Council wider section 14;

(j) "Regional Comniittee" means a committee established 'under section 20;

(k), "regulations" means regulations made u?der section 32;

(l) "teacher .educatio'n" means programmes of education, research or traini9-g of persons for equipping them to teacIl at pre-primary, primary, 'secondary and senior secondar.y stages in schools, and d1ncludes non-formal education, part-time education, ,adult educat"ionand correspondence education;

;'" (m) "teacher education, qualification" means a degree, Qiploma or cer,tificate in teacher education awarded by a University or examining body in accordance with the provisio,ns of this Act;

(n) "University" means a University defined 'under- dausc (f) of section 2 of the University Gral,lts Commission Act, 19'5'6, and includes an institution deemed to be a University under section 3 O'f that Act;

(0) "Vice-Chairperson" means the Vice-Chairperson of the Council appointed under, clause (b) of sub-section (4) of section 3.

CHAPTER II ESTADLlSHlVIENT OF' TIm COUNCIL

(2), The Chairperson, and in the absence of the Charirperson, the Vice-ChaiI'p'erson shall preside at the meetings of the Coup.cil.

(3) If for, any reason the Chairperson and the Vice-Chairperson, both are unable to attend any meeting of the Council, any other Member chosen by the Members present' at the meeting shall preside at that meeting.

(4) All questions which came up before any meeting of the Council shall be: decided by a majority of votes of the Members present and voting and in the eve1nt of any equality of votes, th0 Chairperson, or in the absence of the Chairperson the person presiding, shall ha ve and exerdse a S'Ccondor casting vote.

8. No act or proceeding of the Coup.cil shall be invalid merely by reason of-,- \. »\

(a) any- vacancy .in, or(:any defect in the constitution of, the Council; or

(b) any defect in theappointmQ11t Memb~r of the Council; or.

(c) any irregularity in the procedure of the Council not affecting the merits of the case.

9. (1) The Council may cO-opt, in such manner ap.d for such p4fposes as may be determined by regulations, not more than three persons, whose assistance or advice it may desire in carrying out any of the provisions of this Act. i

(2) The person co-opted by the Council under sub-section (I) for .

any purpose shall have aright to take part in the, discussions relevant to ,that purpose; 'but shall'not' haV'~'a right to vote' at "a' meeting of the Council, land snall not be a Membev for any other purpose.

10. (l) For the pu~se of enabling the Council to dischifie its func- 'tions efficiently under this ,Act, the Council shall, subject to such regulations as may be made in this behalf, appoint (whether on deputation or otherwise) such number of offic.ers and other employees 'asit may consider necessary:

(2) Every officer or other employee appointed by the Council shall be subject to such conditions of service as may be determined by regulations, ;n. All orders and' decisions of the Council shall be authenticated by the signature of the Chairperson or any other Member authorised by the Council in this behalf, and all other instrwnents issued by the Council shall be authentica.te~'iby th.e signature of the Member-Secretary or any other officer of the .Council authorised in like manner in this behalf by the Chairperson.

CHAPTER III FUNCTIONS OF THE COUNCIL

12. It shan be the duty of the Council to take all such steps as it may' th~nk fit for ensuring planned a'nd co-ordinated development of teacher educatiorl and for the determination and maintenance of standards for teacher educa1Jion and fODthe purposes of performing its functions under this Act, the Council may-

(a) undertake surveys a~ld studies relating to various aspects Of teacher education and publish the result thereof;

(b) make recommendations to the Central and Slate Governments, Universities, University Grants Commission and recognised institutions in the matter of preparation of suitable plans and programmes in the field of teacher education:

(c). co-ordiM~e and monitor teacheredu.cation and i:ts.~.evelopment in the coUntry;

(d) lay down guidelines in respect 'Of minimum ,qua1ifioationsfo,r a' person to be employed a.s a teach\er in schools or in rec!Og1J:1ised il1StittitioIlS;

(e) lay down norms for any specified category' of e10urses or trainings in teacher education, including the minimUm eligibility criteria for admismoil thereof, and the method of selection of candidates; duration 'Of the course, course contents arid mode of curriculum;

(j) examine and review periodically the implementation of the norms, guidelines and standards laid down by the Council, and to suitably advise the recognised institutions;

(k) evolve suitable performancR appraisal systems, n'orms and mechanisms for enforcing nccountability on reco~nised institutions;

(l) formulate schemes for various levels Of teacher edueati'On and ;identify l'e'cog'nised in~titutionsand set up newihStitutions for tead}~~ deye1opmentpTbgTall1meS'; . .

13. en For the purposes of ascertaining whether the reG'ognisedinstitutions are functioning in accordanCe with the provisions of this Act, the Council mav cause inspection of any such institution, to be made oy such person3 as it In2y direct, and in such manner as may he prescribed.

(2) The Councn shan communicate to the institution the date on which inspection under sub-section (J) is to be made and the institution shall be entitled to be associated with the inspection in such manner as may be prescribed.

(3) The Council shall communicate to the said institution, its views in regard to the results of any such inspection and may. after ascertaining the opinion of that institution, recommend to that institution the action to be taken as a result Of such inspection.

CHAPTER IV- REcOGNITION OF TEACHER EDUCATION INSTITUTIONS

14. (1). Every. institution offering or intending to offer a course or training in teacher education on or after the appointed day, may, for. grant of recognition: under this Act, make an application to the Regional Committee concerned in such form and in such mamH:;ras may be determined by regulations:

Provided:. th9ct an institution offering a course or training in teacher education inunediately.beforethe app()inted day, shall be entitled to continue such course or training for _a pedod of six monthS; if it has made ah application for recognition within the said: .period arid until the disposal of the appli~ation' by the Regional Committee.

(2) The fee to be paid along with the appli~tion:' under. sub~ection

(1) shall be such as may hie prescribed. I

(3) On receipt of an application by the Regional Committee from any institution under sub-section (J), and after obtaining from. the institution concerned such other particulars as it' may consider necessary, it sll.aU,-

(a) if it is satisfied that such institution has adequate fmancial resources, accommodation, .library, qualified staff, laboratory and that it fulfils such other conditions required for proper functioning of the instituti'On for a course Or training in tea.ch~r educ~tion, as may be detemined by regtIlations, pass an order granting, reccog'llitionto such institution, subject to such conditions as may be determined by regulations; or

(b). if it is of the. opinion that such 'inStitution does not fulfil the ; I;'eq~ir:ements.laid. d9Wn in s1,lb-:cl~u.se(a), p~s,an,,ord.er refusing . recognition to such institution for reasons to be recorded in writing:

(4) Every order granting or refusing recog'nition to an institution for a course or training in teacher education under sub-section (3) shall be published in the 0fficial Gazette an,d communicated 1,nwriting for appropriate action to such institution and to the concerned examining body, the local authority Or th!e State Government and the Central Govermnentl.

(5) Every institution, in }'espect of which' recognition has been refused shall discontinue the courSe or training in teacher education from the end of the ac~demic session next :following the date of receipt Of the order refusing recognition passed under clause -(b) of suo..:seetion (3).

15. (1), Where any recognised institution intends to sta.;-t any new course or training in teacher equcation, it may make an application tQ seek permission therefor to the Regional Committee concerned in such form and' in such manner as 'may. be detenniped by regulaUons.

(b) if it is of the opinion that such institution does n.ot fulfil the requirements laid down in sub~lause (a)., pass an order refusing per- . mission to such institution, for reasons to be recorded in writing:.

Provided that before passing an order refusing permission under sub~limse (b), the Regional Committee shall provide a reasonable opportunity to the institution concerned for making a va'itten representation.

(4) Every order ,granting or refusing permission to a recognised institution far a new course.Or training in teacher education under s~b-sectiqn (Ii), shall he published in the Official Gazette and communicated in wflting for appropriate action to such recognised institution and to the concerned examining body, the local authority, the State Government and the Central Government. I

16. Notwithstanding anything contained ip any other law. for the time being in force, nO'examining body shall, on or after the appointed daY',~

(a) grant affiliation, vihether provisional ar otherwise, to any institution; Or

(b) hold examination, whether provisional or otherwise, for a courSe or training conducted by a recognised institution, unless the institution concerned has obtained recognition from th.e Regional O:munittee concerned, under section 14 or permission for a course 01' training under section 15.

18. 0), Any person aggrieved by an order made under section 14 or section 15 or sectio,n 17 of the Act may prefer an appeal to the Council within such period as may be prescribed.

29, (1) The Council shall, in the discharge of its functions and duties unner this Act be bound by such directions on questions of policy as tbe Central Government may give in writing to it from time to time.

32. (1), The Council may, by notification in the Official Gazette, make regulations not inconsistept with the provisions of this Ac~ and the rules made thereunder, generally to carry out the provbions of.

(2) In particular, and without prejudice (0 the generality of the foregoing power, such regulations may provide for all or any of the followipg matters, namely: - I

(a), the time and the place of the meetings of the Council and the ,procedure for conducting business thereat under sub-section (1) of section 7;

(b) the mapner in which and tEe purposes for which persons 'may be c:o-optedby the Council under sub-section (1) of section 9;

(c) the appointment and terms and conditions of service of officers and other employees of the Council under sub:-section (1) and (2).'respectively of section 19;

Cd) the norms, guidelines and standards in respect of-

(i) the minimum qualifications for a person to be employed I as a teacher under clause Cd) of section 12;

(ii) the specified category of courses or training in. teacher education under clause (c) of section 12;

(iii) starting of new courses or training in recognised instilUtions under dause (f) of section 12;

(iv) standards in respect of examinations leading to teacher educatio,n qualifications referred to in clause (g) of section 12;

(v), the tUlllon fees and other fees r.hargeable by institutions under clause (h) of section 12;

Every rule and every regulation made under this Act shall be laid, as soon as may be after it is made, before each House of Parliament, while it is in session, for a total period of thirty days which may be comprised in one session or in twoOor more successive sessions, and if, before the expiry of the session immediately following the session ,or the successive sessions aforesaid, both Houses agree in making any modification in the rule or reguJ<itlon, or both Houses agree that the rule ,or regubticn should not be made, the Tu]e OI'-egulation shaH thereafter ha'le effect only in :'iuch modified form or be of 1"0 effect, as the case may be;
