No. 9-i2f.ZOO2INCTE.- in exercise of the powers conferred under Section 10(1) & (2) read with Section 32(2) (c) of National Council for Teacher Education Act, 1993 and with the approval of the Central Government the NCTE hereby makes the folloWing Regulations for regulating the method of recruitment to all the posts other than those of Chairperson, Vice-Chairperson and Member Secretary in National Council for Teacher Education:-
1. SHORT TITLE AND COMMENCEMENT
1.1 These Regulations may be called National Council for Teacher Education (Recruitment) Regulations, 2003.
1.2 They shall come into force on the date of their notification.
2. NUMBER OF POSTS, CLASSIFICATION AND SCALES OF PAY
2. I The number of posts, their classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to this notification.
3. METHOD DOF,"rM, VE AGE-L1MIT and other
3.1. The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be specified in columns 5 to 14 of the said Schedule.
3.2. The appointments to posts equivalent to Group 'A' posts in the Government of India shall be subject to prior approval of the Government of India J 54 THE GAZETTE OF INDIA : EXTRAORDINARY IPART in—sEC.4]
3.3. The age limit for direct recruitment is relaxable up to 35 years for NCTE employees.
3.4. The qualifications regarding experience are reJaxable at the discretion of the Chairperson, NCTE in case of candidates belonging to SC/ST, if at any stage of selection, the Chairperson, NCTE is of the opinion that sufficient number of candidates belonging to these categories possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.
3.5. While considering appointments by contract, the requirement of requisite length of service in the scales prescribed in the column 12 of the Schedule shall not be applicable.
3.6. While filling up of posts on direct recruitment basis by invitIng names from local employment exchange, such of the National Council for Teacher Education employees as fulfil the eligibility qualifications laid down in the recruitment rules shall also be given an opportunity for consideration.
4. DISQUALIFICATION
4. L No person who-
(a) has entered into or contracted a marir age with a person having a spouse living, or
(b) having a spouse living has entered into or contracted marriage with any person, shall be eligible for appointment to the said post.
Provided that the NCTE may, if satisfied that such marriage is permissible under the Personnel Law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this Rule. 5. FUTURE MAINTENANCE OF THE SERVICE
5.1 All persons appointed on direct recruitment basis in accordance with any administrative instructions existing prior to notification of the Regulations shall continue in the substantive posts held by them.
5.2 All the appointments in the NCTE after the notification of these Regulations shall be made only in accordance with the provisions of these Regulations .
6. POWER TO RELAX
6.1. When the Council upon a recommendation made by the Chairperson to that effect, is of the opinion that it is necessary or expedient to do so, it may, for reasons to be recorded In writing, relax any of the provisions of these Regulations with respect to any class or category of posts or persons.
7. SAVINGS
7.1. Nothing in these Regulations shall affect reservations, relaxations in age-limit and other concessions required to be provided by NCTE for the Scheduled Castes, Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Government of India from time to time in this regard.
8. INTERPRETATIONS
