Section 14: Special Disability Leave

Special disability leave may be granted to an officer or employee who is disabled by injury caused in‘ consequence of the due performance of his official duty or in consequertce of his officialposition subject to the following conditions namely: — [084 Gl/97—5 TI-IE GAZETTE OF INDIA : EXTRAORDINARY [PART III—155C.

(a) that the disability manifests itsek" within three months of the occurrence to which it is attributed and the person disabled acted with the. due promptitude in bringing it to the notice of the competent authority.

Provided that the competent authority may, if it is satisfied as to the cause of the disability permit leave to be granted even in cases where the disability manifests itself more than three months after the occurrence ofIts cause.

(b) that the‘period of leave shall be such as is certified by the attending medical officer to ,be necessary. It shall in no case exceed four months and may be combined with leave ofainy other kind.

Provided that the competent authority may direct the officer or employee to appear before a ‘Medical Board~ constituted by the Authority for the purpose who shall examine the otticer or employee and certify the nature of the disability; the cause to which the disability can be attributed; and the likely period for which the officer or employee is required to remainon‘ leave on this account;

(c) that such leave may be granted more than once if the disability is aggravated or recurs in similar circumstances at a later date but a total of“ not more than twenty tour months of such leave shall be granted in consequence ofany one disability \ l5. Encashment oflertvez- , - .

(a) where a Government servant retires on attaining the normal age prescribed for retirement under the terms and conditions governing his service,the authority competent to grant leave shall XIII) mom issue an order granting cash equivalent of leave salary for earned leave if any, at the credit of the Gmernment senant on the date oi his retirement subject to a maximum of 240 days This shall also include dearness allowance

(b) where a Government servant resigns or quits service, he may be granted by the authority competent to grant leave cash eqdivalentIn respect of earned leave at his credit on the date or" cessation of service subject to a maximum of 120 days This shall also includedearness allowance.

- l6. Residnary matters- Matters with respect of which no specific provisions have been made under these regulations, shall be regulated under'corresponding provisions of the Central Civil Services (Leave) Rules 1972 as amended from time to time and the instructions issued thereunder by the Central Government.
