Authority of India (Medical. Attendance and Treatment) Regulation, 1997 ' L ' 35 read with sub-section (1) ofsectionNHAR-1201 1/1 1/95/-ADMN.—In exercise of the powers conferred by section . . 9 ofthe National Highways Authority of India Act, 1988 (68 of 1988), the National Highways Authority of India herebyAmake: the following regulations providing for the entitlement of reimbursementof expenditure'mcurred in medical attendance an treatment by an officer ofemployee of the Authority, namely :—
1. Short title, commencement and application :
(1) These regulations may be called the National Highways Authority of India (Medical Attendance and treatment) Regulations, ‘1997.
(2) They shall come into force on the date of‘their publication in the Official Gazette. ' i h
(3) They shall apply, to all officers and employees in whole employment of the . Authority.
2. Definitions: In these regulations, unless the cohté'xtotherwi'se requires;
(a) “approved hospital” means a hoSpit‘al, itiit'spens‘ary,’‘' maternity or Child welfare centre or clinic approvedrby the-Authorityunder sub-regulation
(3) of regulation 4; ‘ ,
(b) “cOmpet'ent authority’? means the Chairman or a Member or any other officer authorised as such by the Authority in this behalf;
(c) “family” in relation to an officer or employee means the wife or _ husband, as the case may be,. Of such officer or employee, and includes his or her - ' - ‘
(i) parents;
(ii) sons including adopted and step sons below the age of 25 years and daughters inéluding adopted and ‘step daughters who are? minor, unmarried or are widoWed; wt III—“ave 4]

(iii) minor brothers and sisters, if they are fully dependent on the officer or employee. “officer or employee” means any person who is in whole time employment ofthe Authority; “pay” means basic pay, special pay, dearness pay or other emoluments classified as pay drawn by the officer or employee at the time ofmedical treatment; “medical treatment” means comprehensive medical cover involving out patient and other specialised treatment in a approved hospital andincludes-
(i) connected pathological, radiological and other methods of diagrosis;
(ii)‘ treatment at a clinic or consultation room of a registered“ medical practitioner;
(iii) treatment provided at the residence of the oflicer or employee in cases where it is certified by a registered medical practioner to be in the interest of the health of the patient;
(iv) treatment takenas an out-door patient in an approved hospital;
(v) supply of medicines, vaccines, sera or other theraupeutic substances, but does not include :-
(a) Vitamins unless certified as essential by a registered medical practitioner as a supplement to the medicines prescribed;
(b) tonics;
(0) baby food, milk food, beverages.
(vi) ordinary dental treatment but does not include supply of dentures, crown work, bridgework, orthodontic work and other specialer dental work.
(vii) treatment of eyes and testing of eyesight but does not include supply ofspectacles;
(viii) pre-natal and post-natal treatment;

(x) ordinary nursing and hospital accommodation appropriate to the status of the officer or employee.
3. Reimbursement of medical expenses :
(1) An officer or employee be entitled to reimbursement of expenditureincurred on medical treatment ofhimself and any member ofhis family provided by a registered medical practitioner and/ or approved hospital subject to a maximum of one month’s pay per year.
(2) Where the competent authority is satisfied that it is necessary to makeadvance payment to meet the expenses of medical treatment in an approved hospitalas an indoor patient of an officer or employee or any member of his family, it maysanction an advance not exceeding fifty per cent of the monthly pay of the officer or employee or the anticipated cost of medical treatment, whichever is less, subject tothe production ofa certificate from the said hospital as to the total likely expenditure.
4. Hospitalintion : (I) An officer or employee or any member of his family may obtainmedical treatment as an indoor patient in the All India Institute of Medical Sciences,a Government hospital, a hospital run by any local authority or any other approvedhospital.
(2) Reimbursement on account of accommodation charges in the hospitalsreferred to in sub-regulation (I) shall be limited to the rates specified in the tablebelow :- Category of Govt. (3) For the purpose of sub—regulation ( l), the Anthority may, from time totime, approve any private hospital, dispensary, maternity or child Welfare centre orclinic.
5. Treatment for special diseases:
(1) For medical treatment of special diseases relating to heart (open heart surgery, by-pass, etc.) cancer, diseases related to kidney, neurosurgery: tuberculardiseases and such other diseases as may be notified by the Authority from time totime, the oflicer or employee or any member ofhis family may take indoor treatmentfrom one of the hospitals specified in the Schedule annexed to these regulations or —Gve4] mmmzamm such other hospitals as may be notified and added to, the said,Schedule by the Authority from time to time. 7 V ' . -_
(2) Where an officer or employee takes medical treatment under ‘ sub-y regulation (1), full expenses for treatment or pathological tests includingmedicines relating to such diseases shall be reimbursed to the officer or employee.
6. Treatment abroad:
(1) An officer or employee, if he or any member of his family is suffering from a disease, the treatment of which is not available in India, may make an application to the Authority to sanction the expenditure involved in such ueatment.
(2) After considering the application under. sub-regulation (1), if the Authority is satisfied about the genuines of the facts stated in the application it may make a reference to the Standing Committee constituted by the Ministry ofHealth and Family Welfare for the purpose through the Ministry of SurfaeeTransport that the l Standing Committee has approved the expenditure and the Authority is authorised to . sanction the expenditure involved in treatment abroad, it may sanction the amount to the officer or employee.
7. Reimbursement of medical expenses incurred abroad: When an officer or employee undertakes tour abroad in connection with the affairs of’the Authority and is compelled to take medical treatment as an indoor patient in a hospital, the Authority shall reimburse the entire medical expenditure . incurred abroad in such hospital.
8. Power to relax:
(1) Where an officer or employee-
(a) has been compelled because of emergency to take medical treatment in nursing home or hospital which is not an approved hospital, for himself or any member ofihie finnilyv : -'
(b) exceed his entitlement of 'reimbursemen‘tofimediealrfipenses . under these regulations, the Chairman may, after considering the genuiness of the ease, relax any of the provisions of these regulations.
(2) For the purpose of considering the genuiness of a case referred to in ' Sub-regulation (l ), the Chairman may constitute a Committee of officers consisting of General Manager (F&A), General Manager (Adrnm), GeneralManager of appropriate division and 3 mm of an apparopriate rank to be nominated by the Chairman. .gzoqflolcn 1% THE GAZETIE OF INDIA : EXTRAORDINARY [PART Ulises. 4]
(3) A, quarterly report of the cases in which the powers under subregulation (1) have been exercised by the Chaimmr. flea}! be placed before the Authority for information.
9. Claimiof-Inedical reimbursement :‘
(l) ' Where both the husband and the wife are in the service of the Authority, either of the spouses may claim the benefits under these regulatidns for himselfand any member of the family.
(2) Where the spouse of the officer or employee is in the service of the Government 01' an‘ organisation owned or controlled by the Government and’such spouse claims the benefits under the corresponding rules applicable to them fa. himself? or any-member of his family, the officer or employee shall not claim the benefits undemhegte regulations. ‘
10.
