1. These regulations may be called the National Highways Authority of India (Transaction of Business ' Amendment) Regulations, 2001. '
2. They shall come into force on 3rd August, 2000. Regulation No. 4 of the National Highways Authority of India (Transaction of Business Regulations, 1997) shall be substituted as under w.e.f. the 3rd August, 2000.

2. Definitions : In these regulations, unless the context otherwise requires.—
(a) “Act” means the National Highways Authority of India Act, 1988 (68 of 1988);
(b) “Authority” means the National Highways Authority of India constituted under section 3 of the Act; 3
(c) “Chairman”means the Chairman appointed by the Central Government under section 3 of the Act;
(d) “Member”means a Member of the Authority appointed under section 3 ofthe Act and includes the Chair man.
3. Meetings of the Authority:
(1) Ordinary meetings of the Authority shall be held atleast once in three months
Provided that Chairman by himself or on a request in writing made by at least two Members may arrange to convene a special meeting of the Authority to censider any specialissue ofan immediate nature.
(2) The Chairman shall cause to circulate the noticeofevery ordinary meeting along withthe agenda notes so as to reach the Members at least seven days before the date fixed for such meeting.
(3) On receipt of a request referred to in the proviso to sub regulation (1), the Chairman shall fix a date for the special meeting, such date not being later than three days from the date of the notice and cause to be sent notices for such meetingalongwith the agenda at least twenty-fourhours before such date.
(4) Notice for all meetings of the Authority may be served open a memberbySending them to theirofficial and also to their residential addresses. ,
4. Quorum: . , ,
(1) The quorum for every meeting of the Authority shall not beless than four
(2) If at any time, the number of Members present at a meetingis less than the number specified1n sub—clause
(1) above, the Member presiding shall adjourn the meetingto a date not later than three days from the date of such meeting after informing the Members of the date not earlier than 24 hours, time and place of the adjourned mutingto dispose of the business intendedto be presented at the original meeting irrespective of the number of members present. I
5. conduct of meetings'
(1) At an ordinary meeting of the Authority, business shall be conductedin the followingOrder,namely.
(a) _ the minutes of.the previous [ordinary meeting and any special meeting held shall be read and; confirmed,
(b) confirmation of decision taken by the Authority by circulation under regulation 7;? v
(c) the business posponed at the previous meeting shall then be considered;
(d) subject included in the agenda shall thereafter be considered;
(e) any other matter may also-be considered with the permission of the Chair. ._
Provided that the Chairman or, the Presiding Officer may at his discretion, change the order of business.
(2) At a special meeting, the business Or the business for which the special meeting has been called shall Only be considered -
6. Minutes of meetings: (I) The Chairman shall cause to be maintained a Minute Book recording therein the proceedings of every ‘ ‘ ‘ meeting of the Authority along with the names of the Members present thereat.
(2) The Minute Book shall be keptin the Office of the Authority and be open for inspection of any Member without payment at all reasonable times.
7. Transaction of business by circulation of papers:
(1) Notwithstanding anything containedin regulation 3, ifin the opinion of the Chairman, any matter requires urgent attention of the Authority, he may direct that the decision of the Authority thereonmay be obtained by circulation of papers. [‘lFTIH-Wfl wmmzmurm 9
(2) If the decision of majority of Members of the Authority indicates approval thereon, the matter may bedeemed to have been approved by the Authority. ‘
(3) Any decision taken under this regulation shall be e placed before the next ordinary meeting of the Authorityfor confirmation. .
8. Matters to be considered in an ordinary meeting of the Authority : The Authority shall consider and take a decision in an ordinary meeting on all or any of the following matters, namely:
(a) Any decision in connnection, with entering into any contract necessary for the discharge of its functions under the Act;
(b) Any decision in discharge of its functions to develop, maintain and manage any national highway or anyother highway vested in or entrusted to it;
(c) Any decision relating to the utilisation ofthe National Highways Authority of India Fund constituted under section 18 of the Act; '
(d) Examination of the budget proposals for the next financial year before it is forwarded to the Central Government; ’
(e) Any decision relating to investment of funds (including any reserve fund) in the securities of the Central Government or any other manner as may be prescribed by the Central Government;
(t) Exercise of the borrowing powers of the Authority under section 21 of the Act;
(g) Preparation of the Annual Report of the Authority under section 22 ofthe Act;
(h) Consideration of the audited accounts of the Authority and the auditor's report thereon;
(i) Delegation of powers of the Authority to the Chairman or any Member or to any officer of the Authority,under section 25 of the Act; .
(j) Authorising any person to enter upon any land or premises as required under section 30 of the Act;
(k) ~ Exercise ofpowers under section 35 of the Act to make or to amend regulations and forwarding copies ofthe same to the Central Government for being laid before the Parliament. ' ‘ ‘ ’
9. Member not to participate in meetings in certain cases : Any Member who has any direct or indirect pecuniary interest in any matter coming up for considerationat a meeting of the Authority shall not take any part in any deliberation or decision of the Authority with respect to that matter.
