कहा जाएगा] का नागालै� ड तथा पूव-. तर /े0 के अ2 य सश4 0 पृथकतावादी संगठन7 के साथ िमलकर नागालै� ड को भारत संघ से पृथक करते 8ए भारत-� यांमार /े0 के नागा आबादी वाले /े0 को िमलाकर एक सं<भु नागालै� ड क> 4 थापना करने का अपना एक घोिषत ल@ य ह;ै और जब�क, के2 C सरकार का यह मत है �क एनएससीएन (के.) :
(i) एक पृथक राD य <ाE त करने के अपने उGे& य को <ाE त करने के िलए भारत क> सं<भुता एवं /े0ीय एकता को भंग करने के आशय वाली या भंग करने वाली अवैध तथा Iहसक गितिविधय7 म% संिलE त रहा ह:ै
(ii) एक पृथक राD य <ाE त करने के अपने उGे& य को <ाE त करने के िलए पूव-Jर भारत के अ2 य भूिमगत संगठन7 के साथ अपना गठबंधन कर रहा ह;ै
(iii) भारत सरकार, नागालै� ड, मिणपुर तथा अLणाचल <दशे सरकार7 के <ािधकार को चुनौती दतेे 8ए िविधिवLN तथा Iहसक गितिविधय7 म% और लोग7 के मO य आतंक और डर फैलाने म% संिलE त रहा है;
(iv) अपनी योजनाQ तथा गितिविधय7 के िव. तपोषण तथा िन� पादन के उGे& य से समाज के िविभ2 न वगR से जबरन धन वसूली म% संिलE त रहा है;
(v) अपनी पृथकतावादी गितिविधय7 को चलाने के िलए देश क> सीमा के पार िशिवर तथा िछपने के 4 थान 4 थािपत कर रहा ह;ै और जब�क, भारत सरकार क> यह राय भी है �क एनएससीएन (के.) क> Iहसक एवं िविधिवLN गितिविधय7 म% ये शािमल हT:-
(i) कोिहमा िजले म% इं�दरा गांधी 4 टेिडयम के िनकट असम राइफ� स के 19 काYमक7 पर अंधाधंुध गोलीबारी करते 8ए 26 माचZ, 2015 को चार असम राइफ� स काYमक7 को ज[ मी करना;
(ii) 26 माचZ, 2015 को लोक िनमाZण िवभाग कॉलोनी, वोखा शहर, िजला वोखा म% बम िव4 फोट ]ारा चार नाग�रक7 को घायल करना;

(iii) असम राइफ�स के सात जवान मारे गए एवं नौ घायल 8ए, तोबु पुिलस थाने, िजला मोन के अंतगZत चांगलांगशु ^ाम म% �दनांक 3 माचZ, 2005 को नागा टे�रटो�रयल आमc के एक सुर/ा कमc भी घात लगाकर �कए गए हमले म% मारा गया;
और
(iv) चांगलांग िजला के उप मंडल जैराम के अंतगZत 6 फरवरी, 2015 को भारत-� यांमार सीमा पर 14व% असम राइफ� स का एक सुर/ा कमc मारा गया और दो कुली भी गंभीर eप से घायल 8ए;
और जब�क के2 C सरकार क> यह राय है �क एनएससीएन (के.) क> गितिविधयां भारत क> एकता और अख� डता के िलए नुकसानदहे ह ैऔर यह एक िविधिवeN संगठन ह;ै और जब�क के2 C सरकार क> यह भी राय ह ै�क य�द एनएससीएन (के.) क> िविधिवLN गितिविधय7 को तुर2 त िनयंि0त नहf �कया जाता ह,ै तो संगठन नई भतc करेगा और Iहसा. मक, आतंकवादी और पृथकतावादी गितिविधय7 म% संिलE त रहगेा, िनिधयां सं^ह करेगा ओर िनद-ष लोग7 तथा सुर/ा काYमक7 के जीवन को खतर7 म% डालेगा; अत: ऐसी प�रि4थितयां िवiमान हT िजनम% एनएससीएन (के) को तुरंत <भाव से िविधिवeN संगठन घोिषत �कए जाने क> आव& यकता है;
अब, अत: िविधिवLN �jयाकलाप (िनवारण) अिधिनयम, 1967 (1967 का 37) क> धारा 3 क> उप धारा (1) ]ारा <द. त शिkय7 का <योग करते 8ए, के2 C सरकार नेशनल सोशिल4 ट काउंिसल ऑफ नागालTड (खापलांग) [(एनएससीएन (के)] को िविधिवLN संगठन घोिषत करती ह।ै और जब�क, उपयुZm त प�रि4थितय7 को O यान म% रखते 8ए, के2 C सरकार क> दढ़ृ राय ह ै�क एनएससीएन (के) को िविधिवLN संगम तुरंत <भाव से घोिषत �कया जाए; तथा तदनुसार, िविधिवLN �jयाकलाप (िनवारण) अिधिनयम, 1967 क> धारा 3 क> उप-धारा (3) के परंतुक ]ारा <द. त शिkय7 का <योग करते 8ए, के2 C सरकार ,rn~}kjk िनदशे दतेी ह ै �क यह अिध सूचना, उm त अिधिनयम क> धारा 4 के अंतगZत जारी �कसी आदेश के अO यधीन, राजप0 म% <काशन क> तारीख से <भाव म% आएगी। [सं. 11011/45/2015-एनई-V] एम. ए. गणपित, संयुm त सिचव MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 28th September, 2015 S.O. 2648(E).—Whereas, the National Socialist Council of Nagaland (Khaplang) [hereinafter referred to as NSCN (K)] has its professed aim to create a sovereign Nagaland incorporating the Naga inhabited areas of Indo-Myanmar region by secession from the Indian Union in alliance with other armed secessionist organisations of Nagaland and North Eastern Region;
And whereas, the Central Government is of the opinion that the NSCN (K), has been:—
(i) indulging in illegal and violent activities intended to disrupt, or which disrupt, the sovereignty and territorial integrity of India in furtherance of its objective of achieving a separate State;
(ii) aligning itself with other undergrounds outfits of the North Eastern Region in furtherance of its objectives to create a separate State;
(iii) engaging in unlawful and violent activities thereby undermining the authority of the Government of India and the Governments of Nagaland, Manipur and Arunachal Pradesh and spreading terror and panic among the people;
(iv) indulging in extortion of money from various sections of the society with a view to financing and executing its plans and activities;
(v) establishing camps and hideouts across the Country’s border to carry out its secessionist activities;
And whereas, the Central Government is also of the opinion that the violent and unlawful activities of the NSCN (K) include –
(i) injuring four Assam Rifles personnel on the 26th March, 2015 by indiscriminately firing upon 19 personnel of Assam Rifles near Indira Gandhi Stadium in district Kohima;
(ii) injuring four civilians by exploding a bomb at PWD Colony, Wokha Town, district Wokha, on the 26th March, 2015;

(iii) killing seven and injuring nine Security Force personnel of Assam Rifles, killing one Security Force personnel of Naga Territorial Army in an ambush on the 3rd May, 2015, at village Changlangshu, under Tobu Police Station of district Mon; and
(iv) killing one Security Force personnel and two porters and also critically injuring nine Security Force personnel of 14th Assam Rifles at Indo-Myanmar border on 6th February, 2015, falling under Jairam Sub-division of Changlang district;
And whereas, the Central Government is of the opinion that the aforesaid activities of the NSCN (K) are detrimental to the sovereignty and integrity of India and that it is an unlawful association;
And whereas, the Central Government is also of the opinion that if there is no immediate curb and control of unlawful activities of the NSCN(K), the organisation may make fresh recruitments, indulge in violent, terrorist and secessionist activities, collect funds and endanger the lives of innocent citizens and security forces personnel; and therefore, circumstances do exist which render it necessary to declare the NSCN (K) as an unlawful association with immediate effect;
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the National Socialist Council of Nagaland (Khaplang )[NSCN (K)] as an unlawful association.
And whereas, the Central Government, having regard to the above circumstances, is of the firm opinion that it is necessary to declare the NSCN (K) as an unlawful association with immediate effect; and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of Section 3 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect from the date of its publication in the Official Gazette.
