7. Notwithstanding any1biu11 contained in the Group Insurance Scheme. if on the death of an employee the amounrs pay .. ole under the Scheme be less wan the amount tbut would be rayable hnd the employees been • covered under u.e ,:iid Scheme. the employer shall pay the difference to the nomint'e(s)/lt'?nl beir(s) of the employee as compen­ sat ion.

6. Th~ emoloyer shall arrange 10 enhance •he benefits available to the emplovecs under thr Group Tns1m111c:~ Scheme anpronr:~tc!v if the benefits available to the emplo­ yees under the 1111icl Scheme are enhanced so th~t the benefits "vqili>ble under •he Group Insurance Scheme are more he f°'11e In thl" rmelovees than It'(' henl"fir~ r111r,iqsible u lhe said Scheme.

S. Whereas an emplovee, who is alreadv a member c! the Emp\oyeer.' Provident Fund or the Provident Pond of an establi~ ... ment exemnted under the said Act. i~ emeloved in his establishment the ernplover shall imrnediatelv admit him ns a member of the Group Insurance Scheme and nav neces­ sary nreminm i11 respect of him to the Life Insurance C"or· poration of Indi11.

4. The employer shall di51'llav on the Notice Board of the establishment, a copy ot the rules of the Group Insurance Scheme as !lpnrovt"d. bv the Centrnl Government /Ct'11tral Provident Fund Commissioner as and when amended. along.

with tramlstion of the salient Iearures thereof in the lan­ guage of the majority of the employees.

2. The employer shall pav such inspection charges as the Central Oovemment may, from time to time. direct under Oe (a) o' sub-section DA) of Section 17 of the said within IS days from the close of every month

3. All expenses involved ir rhe administration of the Group Insurance Scheme. including maintenance of accounts, submlseion of returns. pavment of insurance premia, trans­ fer of accounts, payment of Inspection charges etc. shnll be borne b:,, the employer.

l. The employer in relation to each of the said establish· ment (hereinafter referred to as the employer) shall sobmit such returns to the Regional Provident Fund Commissioner concerned and maintain such accounts and provide such facilities for fnq,ection. as the Centro! Provident Fund Com­ missioner may direct from time to time.

COND:TIONS AND RATES or SUBSCRIPTIONS

7. Conditions of subsertptionv-e-I I) A subscriber sboll subscribe monthly to the fund when on duty or foreign service but not during tpe period when he is under suspen­ Mon :

Provided 1h111 a subscriber on rein~101emcnt after o period pu~sc<l under suspension shall be allowed the option of P">int:

in one lump sum. or in instalmems. any sum not exceeding the maxunurn amount or arrear subscriprions payable for thut period.

(2) The subscriber may, at his option. not subscribe during leave which either does not carry any leave salary equ .. 11 to or less than half pay or half average pay.

(3) The subscriber shall intimate his election not to subs­ cribe dunng the leave referred 10 in sub-regulation (2) in the following manner :-

(a) if he is. an officer who draws h1~ own bills. hy making no deduction on account of subscription in his urst pay bill drown after proceeding on leave;

(b) if he is not an officer who draws his own pay bills.

Failure 10 make due and timely intimation shull be deemed to constitute an election 10 subscribe.

5. Subscribe, 's Account=-An accoum shl\ll be opened in the name of each suh~cribcr in which mall be shown :- ( iJ his subscnpuons;

(6) The amount of any contribution payable in respect of a period of foreiii:n service shall. unless it is recovered from the foreign employer. be recovered by Board from the subs· criber, CONTRlBUTION BY OOARD t l. (2) The contribution shall be such percentage of the subscriber's emoluments drawn on duty during rbe year or period, as the case may be, as has been or may be prescribed by Central Government by general or special order for its own employees :

Provided that if, through oversight or otherwise, the amount subscribed is less than the minimum subscription payable by the subscriber under the Sub-regulation (I) of regulation 8 and if the short subscnption together with the interest accrued thereon is not paid by the subscriber within such time as may be specified by tbe authority competent 10 sanction on advance for the gram of which special reasons are required under Sub-regulation (2) of regulation 13 the contribution payable by the Board shall be equal to the amount actually paid by the subscriber or the amount normallv pavable by the Board, whichever is less, unless the Bo;irct' in any parti­ cular case, otherwise directs.

(3) U a subscriber is on deputation out of India. the emoluments which be would have drawn had he been on duty in India shall. for the purposes of this regulation be deemed to be emolumems drawn on duty.

(4) Should a subscriber elect to subscribe dui inu leave.

his leave salary shall. for the purposes of this repulation, be deemed to emoluments drawn on duty.

on deputation out of India, he shall remain ~ubjecl to the regulation of the Fund in lbe SaJl!C manner as if he were not so transferred or sent on deputation.

REALISATION OF SUBSCRIPTIONS

10. Realisation of subscription :-(I) When emoluments are drawn fro::n uie Board's Fun~ io Jn~ia or from an autho­ rised office of disbursement outside India, recovery of subs­ criptions on account of these emoluments and of the principal and interest of advances shall be made from tbe emoluments themselves.

(2) When emoluments arc. drawn from any other source, the subscriber shall forwnrd bis dues monthly 10 rhc Accounts Officer:

Provided that in the case o( n subscriber (In deputation Central /State Government or a body corporate, own«:d . or con I rolled by Central /State Government, the subscriprions shall br recovered and forwarded to the Accounts Officer by such Government Zbody.

(7) In case a subcriber •~ Iound to have drawn from the Fund an amount in e~c"\ of the amount suindin11 tu his credit on tbe date of the drawal, the overdrawn amount, irrespective of whether the overdrawat occurred rn the course of an advance or a wuhdruwul or the final payment from the fund, shall be repaid by him with interest thereon in one lump sum, or in defuuk, be ordered to be recovered by deduction in one lump sump, from the emoluments of the sub-'..cribcr. If the total amount to be recovered is more than half of the subscriber's emoluments, recoveries shall be m11de Ill monthly instalments of moieucs of his emoln­ ments till the entire amount together with interest, is re­ covered. For this sub-regulation the rate of interest lo be chargeJ on overdrawn amount \I ould be 21/2% over and above the oormol rate on Provident Fund balance under sub-regulation (I). The interest realised on the overdrawn amount shall be credited 10 the Board's account under a distinct sub-bed "Interest on ovcrdruwals from Provident Fund" under the beacJ-.other receipts.

CONDITIONS AND RATES OF SUBSCRIPTIONS

7. Conditions of subscriptions.-(1) A subscriber shall subscribe monthly to the Fund except duriug the period when he is under suspension.

I~) The subscriber shall intimate his election not to subs­ cribc during the leave referred to in the first proviso to sub· regulation (I) in the following manner :- ta J if he is an officer who draws his own bilk. by making no deduction on account of subscription in his first pay bill drawn after proceeding on leave;

l 11) if he is not an officer who draws his own pay bills.

SUBSCRIBER'S ACCOUNT

6. Where the sunbscribcr confers such a right on more than one oerson under this clause. he shall snecifv the amount or share payable tu each of such per­ sons in such a manner as 10 cover the whole of the amount payable to the nominee.

5. Ncunaauons-e-t I) A subscriber shall al the Lime of joining the Fund, send to the Accounts Officer through the Head of Office a nomination conferring on one or more persons the right to receive the amount that may stand to his credit io the Fund io the event of his deatb, before that amount has become payable or having become payable ha.s not been paid.

Provided that where a subscriber is a minor, be shall be required to make the nomination only on his attaining the age of rnalority.

Provided further that a subscriber wbo has .. family at the time of making the nomination shall make such nomination only in favour of a member or mebers of his family.

Provided further that the nomination made bv the subs­ criber in respect of any other provident fund io' which he was subscribing before joining the Fund shall, if. the amount 10 his credit in such other fund has been transferred to his credit in the Fund, be deemed 10 be a nomination duly made under this regulation until he makes a nomination in accordance with this regulation.

( 2 J Jf a subscriber nominates more than one persons under sub-regulation ( 11. he shall specify in the nomination the amount or share payable to each of the nominees in such manner as to cover the whole of the amount that may stand to his credit in the Fund at any Lime.

(3) Every nomination shall be made in the Form set forth in the First Schedule.

(4) A subscriber may al any time cancel a nominaucn by sending a notice in wnting to the Accounts Officer. The subscriber shall. along with such notice or separately, send a fresh nomination made in accordance wuh the provision, of this regulation.
