PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 83] ubZ fnYyh] lkseokj] iQjojh 6] 2017@ek?k 17] 1938 No. 83] NEW DELHI, MONDAY, FEBRUARY 6, 2017/MAGHA 17, 1938 कृिष और ᳰकसान क᭨ याण मंᮢालय (कृिष, सहकाᳯरता और ᳰकसान क᭨ याण िवभाग) अिधसचूना नई ᳰद᭨ली, 1 फरवरी, 2017 सा.का.िन. 106(अ).—कᳱटनाशी िनयम, 1971 का और संशोधन करने के िलए कितपय ᮧाᱨप िनयम, िज᭠ हᱶ के᭠ ᮤ ीय सरकार, कᳱटनाशी अिधिनयम, 1968 (1968 का 46) कᳱ धारा 36 ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करत ेᱟए, बनान ेका ᮧ᭭ ताव करती ह,ै भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (i), तारीख 20 अग᭭ त, 2016 मᱶ भारत सरकार कृिष और ᳰकसान क᭨ याण मंᮢालय (कृिष सहकाᳯरता और ᳰकसान क᭨ याण िवभाग) कᳱ अिधसूचना सं. सा.का.िन. 808(अ), तारीख 17 अग᭭ त, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे िजनमᱶ उन सभी ᭪ यि तयᲂ से, िजनके उनसे ᮧभािवत होने कᳱ संभावना ह,ै उस तारीख से, िजसको उ त अिधसूचना को अंतᳶव᭬ ट करन ेवाले राजपᮢ कᳱ ᮧितयां पᱹतालीस ᳰदन कᳱ अविध कᳱ समाि᭡ त से पहले जनता को उपल᭣ ध करा दी जाती ह,ᱹ से आᭃेप और सुझाव आमंिᮢत ᳰकए गए थ;े और जबᳰक उ त राजपᮢ अिधसूचना कᳱ ᮧितयां 20 अग᭭ त, 2016 को जनता को उपल᭣ ध करा दी गई थᱭ; और जबᳰक उ त अिधसूचना के संबंध मᱶ आᭃेपᲂ या सुझावᲂ पर स᭥ यकत: िवचार कर िलया गया था ; और जबᳰक के᭠ ᮤ ीय सरकार कᳱ यह राय ह ैᳰक ऐसी पᳯरि᭭ थितयां उ᭜ प᭠ न हो गई ह ᱹिजनके कारण बोडᭅ से परामशᭅ ᳰकए िबना िनयम बनाना आव᭫ यक हो गया ह;ै और जबᳰक अिधिनयम कᳱ धारा 36 के परंतुक के िनबंधनानुसार बोडᭅ से िनयमᲂ के बनाए जाने के छह मास के भीतर परामशᭅ ᳰकया जाएगा और के᭠ ᮤ ीय सरकार ᳰक᭠ हᱭ ऐसे सुझावᲂ पर िवचार करेगी िज᭠ हᱶ बोडᭅ उ त िनयम के संशोधनᲂ के संबंध मᱶ बनाए ; अत:, अब, के᭠ ᮤ ीय सरकार कᳱटनाशी अिधिनयम, 1968 (1968 का 46) कᳱ धारा 36 ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करते ᱟए कᳱटनाशी िनयम 1971 का और संशोधन करने के िलए िन᭥ निलिखत िनयम बनाती ह,ै अथाᭅत:्- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
1. (1) संिᭃ᭡ त नाम और ᮧारंभ:- (1) इन िनयमᲂ का संिᭃ᭡ त नाम कᳱटनाशी (दसूरा संशोधन) िनयम, 2017 ह ै।
(2) ये राजपᮢ मᱶ उनके ᮧकाशन कᳱ तारीख को ᮧवृ᭜ त हᲂग े।
2. कᳱटनाशी िनयम, 1971 के, िनयम 10 मᱶ, उपिनयम (1क) के ᭭ थान पर, िन᭥ निलिखत रखा जाएगा, अथाᭅत:्- “(1क) ऐसा ᭪ यि त जो कᳱटनाशी का िवᮓय करन ेया िवतरण करन ेके िलए िबᮓᳱ, ᭭ टाक या ᮧदशᭅन करन ेके िलए अन᭄ुि᭡ त के अनुद᭜ त ᳰकए जान े के िलए आवेदन करता ह,ै ᳰकसी मा᭠ यताᮧा᭡ त िव᭫ विव᳒ालय या सं᭭ थान से कृिष िव᭄ान या जैव रसायन या जैव ᮧौ᳒ोिगकᳱ या जीव िव᭄ान या िव᭄ान िजसमᱶ रसायन िव᭄ान या वन᭭ पित िव᭄ान या ᮧािण िव᭄ान िवषय हᲂ, मᱶ ᭭ नातक िडᮕी रखेगा या ᳰकसी ऐसे ᭪ यि त को िनयोिजत करेगा जो, ᳰकसी मा᭠ यताᮧा᭡ त िव᭫ विव᳒ालय या सं᭭ थान से कृिष िव᭄ान या जैव रसायन या जैव ᮧौ᳒ोिगकᳱ या जीव िव᭄ान या िव᭄ान िजसमᱶ रसायन िव᭄ान या वन᭭ पित िव᭄ान या ᮧािण िव᭄ान िवषय हᲂ, मᱶ ᭭ नातक िडᮕी रखता हो ;या ᳰकसी सरकारी मा᭠ यता ᮧा᭡ त िवि᭫ व᳒ालय या सं᭭ थान से कृिष या उ᳒ान कृिष या संब िवषयᲂ मᱶ एक वषᱮय िड᭡ लोमा पाᲹᮓम रखता हो िजसमᱶ पादप संरᭃण और कᳱटनाशी ᮧबंध पर पाᲹᮓम अंतवᭅ᭭ त ुहो: परंतु कᳱटनाशी (दसूरा संशोधन) िनयम, 2017 ᳇ारा यथा संशोिधत इन िनयमᲂ के ᮧकाशन कᳱ तारीख को िविहत अहᭅता के िबना िविधमा᭠ य अन᭄ुि᭡ त रखन ेवाल ेसभी फुटकर िवᮓेताᲐ या ᭪ यौहाᳯरयᲂ को उ त अहᭅताᲐ का अनुपालन करन े के िलए दो वषᭅ कᳱ अविध अनु᭄ात कᳱ जाएगी: परंत ुयह और ᳰक कᳱटनािशयᲂ के िव᳒मान ऐसे अन᭄ुि᭡ तधारी जो पᱹतालीस वषᭅ से अिधक कᳱ आयु के ह ᱹऔर जो अपना ᭪ यापार या तो ᭭ वयं चला रह ेह ᱹया कᳱटनाशी (दसूरा संशोधन) िनयम, 2017 ᳇ारा यथा संशोिधत इन िनयमᲂ के ᮧकाशन कᳱ तारीख को दस वषᭅ कᳱ संचयी अविध से अिधक का अनुभव रखते ह ᱹऔर िजनका वाᳶषक आवतᭅ पांच लाख ᱧपए से कम ह,ै उनके नाम मᱶ चालू अनु᭄ि᭡ त᭜ व कᳱ अविध के िलए पवूᲃ त िनयम से छूट ᮧा᭡ त हᲂग े।

15. सा.का.िन. 794(अ), तारीख 12 अग᭭ त, 2016 ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture, Co-operation and Farmers Welfare) NOTIFICATION New Delhi, the 1st February, 2017 G.S.R. 106(E).—Whereas certain draft rules further to amend the Insecticides Rules, 1971, which the Central Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968) was published under the notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture, Co-operation and Farmers Welfare) vide number G.S.R. 808(E), dated 17th August, 2016, in the Gazette of India, Extraordinary Part-II, Section-3, Sub-section (i), dated 20th August, 2016, inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of the period of forty five days from the date on which the copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 20th August, 2016; And whereas, objection or suggestion were duly considered in respect of the said notification; And whereas, the Central Government is of the opinion that circumstances have arisen, which render it necessary to make rules without consultation with the Board; And whereas in terms of the proviso to section 36 of the Act, the Board shall be consulted within six months of making of the rules and the Central Government shall take into consideration any suggestions which the Board may make in relation to the amendments of the said rule; Now, therefore, in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following rules, further to amend the Insecticides Rules, 1971, namely:-
1. Short title and commencement.—(i) These rules may be called the Insecticides (Second Amendment) Rules,
2017.
(ii) They shall come into force on the date of their publication in the Official Gazette.
2. In the Insecticides Rules, 1971, in rule 10, for sub-rule (1A), the following shall be substituted namely:— “(1A) Person who applies for the grant of licence to sell, stock or exhibit for sale or distribute insecticides shall possess or employ a person possessing a graduate degree in Agricultural Sciences or Biochemistry or Biotechnology or Life Sciences or in Science with Chemistry or Botany or Zoology from a recognised university or Institute ; Or One year diploma course in Agriculture or Horticulture or related subjects from any government recognised university or institute with course content on plant protection and pesticides management:
Provided that all retailers or dealers possessing a valid licence without the prescribed qualification as on the date of publication of these rules as amended by The Insecticides (Second Amendment) Rules, 2017 shall be allowed a period of two years to comply with the said qualifications:
Provided further that the existing licensee of pesticides, who are more than forty-five years of age and who have been running their trade either themselves or have inherited with cumulative period of experience of more than ten years as on the date of publication of these rules as amended by The Insecticides (Second Amendment) Rules, 2017 and the annual turn over is less than Rs. five lakh are exempted from the aforesaid rule for a period of licenceship continuing in their name.
(3) The payment of salary of the employee shall be made by licensees through digital mode or by a cheque to ensure that the person is employed with them”. [F. No. 13035/28/2014-PP-I (vol.iii)] ASHWANI KUMAR, Jt. Secy.
