“fecquy 4: oa ter 11 AF feu ae ares fafaface faa faaen sufrat At sat aura fad ata HWA h fore set sHrsal Hl erga 1h aelta aahadas areot ar saa aid EU qe ahatht site arhtrisasH erfdar (wet Us Fh) & wa F foray se” [wH. 4.10/13/2002-EuF] adie Ha, dah ahr [YM Tare 3(ii)] ART Al UST : SAAR 3 MINISTRY OF POWER NOTIFICATION New Delhi, the 29th December, 2015 S.O. 3542(E).— Whereas the Central Government in consultation with the Bureau of Energy Efficiency, having regard to the intensity or quantity of energy consumed and the amount of investment required for switching over to the energy efficient equipment and capacity of industry to invest in it and availability of the energy, energy efficient machinery and equipment required by the industry, notified under clause (e) of section 14 of the Energy Conservation Act, 2001 (52 of 2001) [hereinafter referred to as the said Act], nine energy intensive industries and other establishments specified in the Schedule to the said Act, as designated consumers by notification of the Government of India in the Ministry of Power Number S.O. 394(E) dated the 12th March, 2007 [hereinafter referred to as the said Order] published in the Gazette of India, Extraordinary, Part H, Section 3, Sub-section (ii) dated the 19th March, 2007;
And whereas, the Central Government, in consultation with the Bureau of Energy Efficiency, has reviewed the list of energy intensive industries and other establishment specified in the Schedule to the said Act, and the limit of energy consumption in terms of metric tonne of oil equivalent stated in Note 2 in the said order, and is satisfied that some other user or class of users of energy may be specified as designated consumers;
And whereas, the Central Government considered it necessary to provide that only those energy intensive industries and other establishment having annual energy consumption as indicated against each industry or establishment by the Central Government from time to time shall be notified as, designated consumers:
Now, therefore, in exercise of the powers conferred by the clause (e) of section 14 of the said Act, the Central Government, in consultation with the Bureau of Energy Efficiency, hereby amends the said Order to specify the following energy intensive industries and other establishments, as Designated Consumers, namely:— In the said order,—
(11) In sub-paragraph 7 relating to Railways,- (A) for clause (a), the following clause shall be substituted, namel y:— “(a) All zonal railways having traction annual energy consumption of 70,000 metric tonne of oil equivalent (MTOE) per year and above, as per Table given below:- S.No. Zonal Railway 1 Central Railway Zone 2 East Central 3 East Coast 4 Eastern 5 North Central 6 North Eastern 7 Northeast Frontier 8 Northern 9 North Western 10 South Central 11 South East 12 South Eastern 13 Southern 14 South Western 15 West Central 16 Western”;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEc. 3(4i)] (B) clause (b) shall be omitted;
(ii) after sub paragraph (9), the following shall be inserted, namely:— “10. Petroleum Refinery—Units of such industry having energy consumption of 90,000 metric tonne of oil equivalent (MTOE) per year or above.
11. Electricity Distribution Companies—Units of such industry having energy consumption of 86,000 metric tonne of oil equivalent (MTOE) per year and above”;
(iii) after Note 3, the following note shall be inserted, namely:- “Note: 4 For the purpose of establishing energy consumption of Electricity Distribution Companies specified in the order at sub-paragraph 11, energy consumption of such units shall be considered as Aggregate Technical and Commercial (AT&C) losses by using conversion Table under Note 1.” [F.
