PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY िल िजि मतं्रालय (िलससंाधन, नदी जिकास और गगंा संरक्षण जिभाग) अजधसचूना नई ददल्ली, 16 िुलाई, 2020 का. आ. 2412(अ).—अन्तरराजययक नदी िल जििाद अजधजनयम, 1956 (1956 का 33) (जिसे इसमें इसके पश्चात उि अजधजनयम कहा गया ह)ै की धारा 4 के अधीन अजधसूचना संखयांक का0 आ0 451 (अ),तारीख 2 अप्रलै, 2004 द्वारा कृष्णा िल जििाद अजधकरण (जिसे इसमें इसके पश्चात् उि अजधकरण कहा गया ह)ै का गठन अन्तरराजययक कृष्णा नदी और उसकी नदी घाटी से संबंजधत िल जििादों के न्यायजनणणयन के जलए दकया गया था;
और, उि अजधकरण ने उि अजधजनयम की धारा 5 की उपधारा (2) के अधीन अपनी ररपोटण और जिजनश्चय तारीख 30 ददसम्बर 2010 को प्रस्ट्ततु कर ददया ह;ै और, केन्रीय सरकार और पक्षकार रायय आन्र प्रदेि, कनाणटक और महाराष्ट्र द्वारा उनस े संबंजधत जनदेि उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन उि अजधकरण को तारीख 29 माचण, 2011 को भेि ददए गए हैं;
और, उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन उि अजधकरण द्वारा अजतररि ररपोटण तारीख 29 माचण 2011 को या उससे एक िर्ण पहल,े केन्रीय सरकार को भेिना अपेजक्षत था;
और उि अजधकरण के अनुरोध पर उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अजतररि ररपोटण प्रस्ट्तुत करन े की अिजध समय-समय पर अजधसूचना संखयांक का0 आ0 653 (अ),तारीख 29 माचण, 2012, का0 आ0 2339 (अ),तारीख 28 जसतंबर, 2012, का0 आ0 916 (अ),तारीख 2 अप्रैल,2013,का0 आ0 2939 (अ),तारीख 27 स.ं 2127] नई ददल्ली, बृहस्ट् पजतिार, िुलाई 23, 2020/ श्रािण 1, 1942 No. 2127] NEW DELHI, THURSDAY, JULY 23, 2020/SHRAVANA 1, 1942 सी.जी.-डी.एल.-अ.-23072020-220654 CG-DL-E-23072020-220654 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जसतंबर,2013, का0 आ0 3515 (अ) तारीख 27 निंबर, 2013 द्वारा 31 िनिरी, 2014 तक बढ़ाई गई थी जिसे िल संसाधन मंत्रालय के तारीख 5 फरिरी, 2014 के आदेि, अजधसूचना संखया का0 आ0 1290 (अ), तारीख 15 मई, 2014, का0 आ0 2462 (अ), तारीख 18 िुलाई, 2016, का0 आ0 2459 (अ), तारीख 31 िुलाई, 2017 और का0 आ0 3950 (अ), तारीख 9 अगस्ट्त, 2018 द्वारा और बढ़ा ददया गया था और, उि अजधकरण न े उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन कें रीय सरकार को अपनी अजतररि ररपोटण 29 निम्बर, 2013 को अग्रेजर्त कर दी ह ै और, उि अजधजनयम की धारा 12 के अधीन अजधकरण द्वारा ररपोटण अग्रेजर्त दकये िाने के पश्चात और कें रीय सरकार का यह समाधान होन ेपर दक इस मामले में अजधकरण को कोई अजतररि जनदेि भेिा िाना आिश्यक नहीं होगा, कें रीय सरकार अजधकरण का यथािीघ्र जिघटन कर दगेी और, आंर प्रदेि पुनगणठन अजधजनयम, 2014 (2014 का 6) की धारा 89 में यह उपबंध दकया गया ह ैदक कृष्णा िल जििाद अजधकरण की अिजध उि धारा के खंड (क) और खंड (ख) में जिजनर्दणष्ट जनबंधनानुसार बढाई िायेगी और, कें रीय सरकार न,े उि अजधजनयम की धारा 5 की उपधारा (3) के द्वारा प्रदत्त िजियों का प्रयोग करते हुए, उि अजधकरण द्वारा अजतररि ररपोटण प्रस्ट्ततु करन ेकी अिजध को द्वारा भारत के रािपत्र में प्रकाजित भारत सरकार के िल संसाधन, नदी जिकास और गगंा संरक्षण मंत्रालय की अजधसूचना संखयांक का0 आ0 3146 (अ), तारीख 29 अगस्ट्त, 2019 द्वारा तारीख 1 अगस्ट्त, 2019 से एक िर्ण की और अिजध के जलए बढ़ाया गया था तादक उि धारा के खंड (क) और खंड (ख) में जिजनर्दणष्ट जनबंधन के जनदेिों का जनदान दकया िा सके और, उि अजधकरण ने ररपोटण और जिजनश्चय प्रस्ट्तुत करने के जलए 1 अगस्ट्त, 2020 से और एक िर्ण की अिजध बढ़ाने का अनरुोध दकया अतः, अब, केन्रीय सरकार, अन्तरराजययक नदी िल जििाद अजधजनयम 1956 (1956 का 33) की धारा 5 की उपधारा (3) के परंतुक द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, कृष्णा िल जििाद अजधकरण द्वारा अजतररि ररपोटण और जिजनश्चय प्रस्ट्ततु करने की अिजध को तारीख 1 अगस्ट्त, 2020 से और एक िर्ण की अिजध के जलए बढ़ाती ह।ै [फा.सं. एन-57012/1/2020-बी.एम.]
देिश्री मुख़िी, अपर सजचि MINISTRY OF JAL SHAKTI (Department of Water Resources, River Development and Ganga Rejuvenation) NOTIFICATION New Delhi, the 16 th July, 2020 S.O. 2412(E).—Whereas, the Krishna Water Disputes Tribunal (hereafter in this notification referred to as the said Tribunal) was constituted on the 2nd April, 2004 vide notification number S.O. 451(E), dated the 2nd April, 2004, under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereafter in this notification referred to as the said Act), for the adjudication of the water disputes regarding Inter-State river Krishna and river valley thereof;
And, whereas, the said Tribunal has submitted its report and decision under sub-section (2) of section 5 of the said Act on 30th December, 2010;
And, whereas, the Central Government and the Party States of Andhra Pradesh, Karnataka and Maharashtra have preferred their respective references, to the said Tribunal under sub-section (3) of section 5 of the said Act on 29th March, 2011;
And, whereas, the said Tribunal was required to forward to the Central Government a further report under sub-section (3) of section 5 of the said Act on or before one year from 29th March, 2011;
And, whereas, on the request of the said Tribunal, the period of submission of further report under sub- [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 section (3) of section 5 of the said Act was extended from time to time vide notifications number S.O 653(E), dated the 29th March, 2012, S.O. 2339 (E), dated the 28th September, 2012, S.O. 916 (E), dated the 2nd April, 2013 and S.O. 2939 (E), dated the 27th September, 2013, S.O. 3515(E), dated the 27th November, 2013 up to the 31st January, 2014, which was further extended up to 31st July, 2014, vide Ministry of Water Resources order dated 5 th February, 2014, S.O.1290 (E), dated the 15 th May, 2014, S.O. 2462 (E) dated 18 th July, 2016, S.O. 2459 (E) dated 31 st July, 2017 and S.O. 3950 (E) dated 9 th August, 2018;
And, whereas, the said Tribunal has forwarded to the Central Government its further report under sub-section
(3) of section 5 of the said Act on the 29th November, 2013;
And, whereas, under section 12 of the said Act, the Central Government shall dissolve the Tribunal after it has forwarded its report and as soon as the Central Government is satisfied that no further reference to the Tribunal in the matter would be necessary;
And, whereas, section 89 of the Andhra Pradesh Re-organisation Act, 2014 (6 of 2014) provides that the term of the Krishna Water Disputes Tribunal shall be extended with the terms of reference specified in clauses (a) and
(b) of the said section;
And, whereas, in exercise of the powers conferred under sub-section (3) of section 5 of the said Act, the Central Government extended the period of submission of further report by the said Tribunal for a further period of one year with effect from the 1st August, 2018 so as to address the terms of reference specified in clauses (a) and (b) of the said section vide notification of the Government of India, Ministry of Water Resources, River Development and Ganga Rejuvenation number S.O. 3146 (E), dated the 29 th August, 2019;
And, whereas, the said Tribunal had requested to extend the period of submission of report and decision for a period of one year with effect from the 1 st day of August, 2020;
Now, therefore, in exercise of the powers conferred under the proviso to sub-section (3) of section 5 of the Inter-State River Water Disputes Act, 1956 (33 of 1956), the Central Government hereby extends the period of submission of report and decision by the Krishna Water Disputes Tribunal for a period of one year with effect from 1 st day of August, 2020.
