PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2879] ubZ fnYyh] 'kqØokj] vxLr 30] 2019@Hkknz 8] 1941 No. 2879] NEW DELHI, FRIDAY, AUGUST 30, 2019/BHADRA 8, 1941 जल शि� मं ालयजल शि� मं ालयजल शि� मं ालयजल शि� मं ालय ((((जलससंाधनजलससंाधनजलससंाधनजलससंाधन, नदी िवकास और गंगा सरं�ण िवभाग, नदी िवकास और गंगा सरं�ण िवभाग, नदी िवकास और गंगा सरं�ण िवभाग, नदी िवकास और गंगा सरं�ण िवभाग)))) अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द�ली, 29 अग� त, 2019 का.आ.का.आ.का.आ.का.आ. 3146314631463146(अ)(अ)(अ)(अ)....————अ�तरराि�यक नदी जल िववाद अिधिनयम, 1956 (1956 का 33) (िजसे इसम� इसके प�ात उ� अिधिनयम कहा गया ह)ै क� धारा 4 के अधीन अिधसूचना स&ंयांक का.आ. 451(अ), तारीख 2 अ)ैल, 2004 +ारा कृ-णा जल िववाद अिधकरण (िजसे इसम� इसके प�ात् उ� अिधकरण कहा गया है) का गठन अ�तरराि�यक कृ-णा नदी और उसक� नदी घाटी से संबंिधत जल िववाद3 के �यायिनण4यन के िलए �कया गया था; और, उ� अिधकरण ने उ� अिधिनयम क� धारा 5 क� उपधारा (2) के अधीन अपनी 7रपोट4 और िविन�य तारीख 30 �दस;बर 2010 को )�तुत कर �दया ह;ै और, के�?ीय सरकार और प@कार रा�य आ�B )दशे, कना4टक और महाराD +ारा उनसे संबंिधत िनदEश उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन उ� अिधकरण को तारीख 29 माच4, 2011 को भेज �दए गए हH; और, उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन उ� अिधकरण +ारा अित7र� 7रपोट4 तारीख 29 माच4, 2011 को या उससे एक वष4 पहले के�?ीय सरकार को भेजना अपेि@त था; और उ� अिधकरण के अनुरोध पर उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन अित7र� 7रपोट4 )�तुत करने क� अविध समय-समय पर अिधसूचना सं&यांक क.आ. 653(अ), तारीख 29 माच4, 2012, का.आ. 2339(अ), तारीख 28 िसतंबर, 2012, का.आ. 916(अ), तारीख 2 अ)ैल,2013, का.आ. 2939(अ), तारीख 27 िसतंबर, 2013, का.आ. 3515(अ) तारीख 27 नवंबर, 2013 +ारा 31 जनवरी, 2014 तक बढ़ाई गई थी िजसे जल संसाधन मंKालय के तारीख 5 फरवरी, 2014 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] के आदशे, अिधसूचना सं&या का.आ. 1290(अ), तारीख 15 मई, 2014, का.आ. 2462(अ), तारीख 18 जुलाई, 2016, का.आ. 2459(अ), तारीख 31 जुलाई, 2017 और का.आ. 3950(अ), तारीख 9 अग�त, 2018 +ारा और बढ़ा �दया गया था; और, उ� अिधकरण ने उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन क� ?ीय सरकार को अपनी अित7र� 7रपोट4 29 नव;बर, 2013 को अMेिषत कर दी ह;ै और, उ� अिधिनयम क� धारा 12 के अधीन अिधकरण +ारा 7रपोट4 अMेिषत �कये जाने के प�ात और क� ?ीय सरकार का यह समाधान होने पर �क इस मामल े म� अिधकरण को कोई अित7र� िनदEश भजेा जाना आवPयक नहQ होगा, क� ?ीय सरकार अिधकरण का यथाशीS िवघटन कर दगेी; और, आंB )दशे पुनग4ठन अिधिनयम, 2014 (2014 का 6) क� धारा 89 म� यह उपबंध �कया गया ह ै�क कृ-णा जल िववाद अिधकरण क� अविध उ� धारा के खंड (क) और खंड (ख) म� िविनYद4Z िनबंधनानुसार बढाई जायेगा; और, क� ?ीय सरकार ने, उ� अिधिनयम क� धारा 5 क� उपधारा (3) के +ारा )द\ शि�य3 का )योग करते ]ए, उ� अिधकरण +ारा अित7र� 7रपोट4 )�तुत करने क� अविध को +ारा भारत के राजपK म� )कािशत भारत सरकार के जल संसाधन, नदी िवकास और गंगा संर@ण मंKालय क� अिधसूचना सं&यांक का.आ. 3950(अ), तारीख 9 अग�त, 2018 +ारा तारीख 1 अग�त, 2018 स ेएक वष4 क� और अविध के िलए बढ़ाया गया था ता�क उ� धारा के खंड (क) और खंड (ख) म� िविनYद4Z िनबंधन के िनदEश3 का िनदान �कया जा सके; और, उ� अिधकरण ने 7रपोट4 और िविन�य )�तुत करने के िलए 1 अग�त, 2019 से और एक वष4 क� अविध बढ़ाने का अनुरोध �कया; अतः, अब, के�?ीय सरकार, अ�तरराि�यक नदी जल िववाद अिधिनयम, 1956 (1956 का 33) क� धारा 5 क� उपधारा (3) के परंतुक +ारा )द\ शि�य3 का )योग करते ]ए, कृ-णा जल िववाद अिधकरण +ारा अित7र� 7रपोट4 और िविन�य )�तुत करने क� अविध को तारीख 1 अग�त, 2019 से और एक वष4 क� अविध के िलए बढ़ाती ह।ै [फा. सं. 17/4/2016-बी.एम.] टी. राजे�वरी, अपर सिचव MINISTRY OF JAL SHAKTI (Department of Water Resources, River Development and Ganga Rejuvenation) NOTIFICATION New Delhi, the 29th August, 2019 S.O. 3146(E).—Whereas, the Krishna Water Disputes Tribunal (hereafter in this notification referred to as the said Tribunal) was constituted on the 2nd April, 2004 vide notification number S.O. 451(E), dated the 2nd April, 2004, under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereafter in this notification referred to as the said Act), for the adjudication of the water disputes regarding Inter-State river Krishna and river valley thereof;
And, whereas, the said Tribunal has submitted its report and decision under sub-section (2) of section 5 of the said Act on 30th December, 2010;
And, whereas, the Central Government and the Party States of Andhra Pradesh, Karnataka and Maharashtra have preferred their respective references, to the said Tribunal under sub-section (3) of section 5 of the said Act on 29th March, 2011;
And, whereas, the said Tribunal was required to forward to the Central Government a further report under sub-section (3) of section 5 of the said Act on or before one year from 29th March, 2011;
And, whereas, on the request of the said Tribunal, the period of submission of further report under sub-section (3) of section 5 of the said Act was extended from time to time vide notifications number S.O. 653(E), dated the 29th March, 2012, S.O. 2339(E), dated the 28th September, 2012, S.O. 916(E), dated the 2nd April, 2013 and S.O. 2939(E), dated the 27th September, 2013, S.O. 3515(E), dated the 27th November, 2013 up to the 31st January, 2014, which was further extended up to 31st July, 2014, vide Ministry of Water Resources order dated 5 th February, 2014, ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 S.O. 1290(E), dated the 15 th May, 2014, S.O. 2462(E) dated 18 th July, 2016, S.O. 2459 (E) dated 31 st July, 2017 and S.O. 3950 (E) dated 9 th August, 2018;
And, whereas, the said Tribunal has forwarded to the Central Government its further report under sub-section (3) of section 5 of the said Act on the 29th November, 2013;
And, whereas, under section 12 of the said Act, the Central Government shall dissolve the Tribunal after it has forwarded its report and as soon as the Central Government is satisfied that no further reference to the Tribunal in the matter would be necessary;
And, whereas, section 89 of the Andhra Pradesh Re-organization Act, 2014 (6 of 2014) provides that the term of the Krishna Water Disputes Tribunal shall be extended with the terms of reference specified in clauses (a) and (b) of the said section;
And, whereas, in exercise of the powers conferred by the sub-section (3) of section 5 of the said Act, the Central Government extended the period of submission of further report by the said Tribunal for a further period of one year with effect from the 1st August, 2018 so as to address the terms of reference specified in clauses (a) and (b) of the said section vide notification of the Government of India, Ministry of Water Resources, River Development and Ganga Rejuvenation number S.O. 3950 (E), dated the 9th August, 2018;
And, whereas, the said Tribunal had requested to extend the period of submission of report and decision for a period of one year with effect from the 1 st day of August, 2019;
Now, therefore, in exercise of the powers conferred by the proviso to sub-section (3) of section 5 of the Inter- State River Water Disputes Act, 1956 (33 of 1956), the Central Government hereby extends the period of submission of report and decision by the Krishna Water Disputes Tribunal for a period of one year with effect from 1 st day of August, 2019.
