PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY िल िजि मतं्रालय ऄजधसचूना नइ ददल्ली, 17 फरवरी, 2020 का.अ. 768(ऄ).—ऄन्तरराजययक नदी महादायी और ईसकी नदी घाटी के संबंध में िल जववादों के न् यायजनण यन के जलए ऄन्तरराजययक नदी िल जववाद ऄजधजनयम, 1956 (1956 का 33) (जिसे आसमें आसके पश्चात ् ईि ऄजधजनयम कहा गया ह)ै की धारा 4 के ऄधीन तारीख 16 नवम् बर, 2010 की ऄजधसूचना संख् या का.अ. 2786 (ऄ) द्वारा तारीख 16 नवम् बर, 2010 को महादायी िल जववाद ऄजधकरण (जिसे आसमें आसके पश्चात ्ईि ऄजधकरण कहा गया ह)ै का गठन दकया गया था;
और ईि ऄजधकरण से ईि ऄजधजनयम की धारा 5 की ईप-धारा (2) के ऄधीन तीन वर् की ऄवजध में, ऄथा त तारीख 15 नवम् बर, 2013 को या ईससे पहले ऄपनी ररपोट और जवजनश्चय प्रस्ट् ततु करने की ऄपेक्षा की गइ थी;

और, केन्रीय सरकार न े ऄजधसूचना संख्या का.अ. 2908 (ऄ), तारीख 13 नवम्बर, 2014 द्वारा यह जवजनश्चय दकया था दक ईि ऄजधकरण के गठन की प्रभावी तारीख 21 ऄगस्ट् त, 2013 होगी और तदनुसार, ईि ऄजधजनयम की धारा 5 की ईप-धारा (2) के ईपबंधों के ऄधीन महादायी िल जववाद ऄजधकरण द्वारा ररपोट और जवजनश्चय देने के जलए तीन वर् की ऄवजध तारीख 21 ऄगस्ट् त, 2013 से प्रारम्भ होगी;
और, ईि ऄजधकरण से तारीख 20 ऄगस्ट् त, 2016 को या ईसके पूव ईसकी ररपोट और जवजनश्चय प्रस्ट्तुत करने की ऄपेक्षा की गइ थी;
और, ईि ऄजधकरण ने केन्रीय सरकार से ररपोट और जवजनश्चय प्रस्ट्ततु करने की ऄवजध तारीख 21 ऄगस्ट् त, 2016 से एक वर् के जलए और बढाने का ऄनरुोध दकया था;
और, केन्रीय सरकार न ेऄजधसूचना संख्या का.अ. 2686 (ऄ.) तारीख 11 ऄगस्ट्त, 2016 द्वारा ररपोट और जवजनश्चय की प्रस्ट्तुजत की ऄवजध को तारीख 21 ऄगस्ट् त, 2016 से एक वर् की और ऄवजध के जलए जवस्ट्ताररत कर ददया था;
और, ईि ऄजधकरण ने केन्रीय सरकार से ररपोट और जवजनश्चय प्रस्ट्ततु करने की ऄवजध तारीख 21 ऄगस्ट् त, 2017 से एक वर् के जलए और बढाने का ऄनरुोध दकया था;
और, केन्रीय सरकार न ेऄजधसूचना संख्या का.अ. 2332 (ऄ.) तारीख 24 िुलाइ, 2017 द्वारा ररपोट और जवजनश्चय की प्रस्ट्तुजत की ऄवजध को तारीख 21 ऄगस्ट् त, 2017 से एक वर् की और ऄवजध के जलए जवस्ट्ताररत कर ददया था;
और, ईि ऄजधकरण न ेईि ऄजधजनयम की धारा 5 की ईपधारा (2) के ऄधीन ऄपनी ररपोट और जवजनश्चय तारीख 14 ऄगस्ट्त, 2018 को प्रस्ट्तुत कर ददया था;
और, गोवा रायय न ेतारीख 20 ऄगस्ट्त, 2018 को ईि ऄजधजनयम की धारा 5 की ईपधारा (3) के साथ परठत जसजवल प्रदिया संजहता, 1908 (1908 का 5) के अदिे 39 जनयम 2(क) के ऄधीन ईि ऄजधकरण में एक अवेदन दाजखल दकया था तथा तारीख 20 जसतम्बर, 2018 को ईि ऄजधजनयम की धारा 5 की ईपधारा (3) के परंतुक के ऄधीन ईि ऄजधकरण में ऄजतररि जनदेि दकया;
और, कना टक रायय न े तारीख 13 नवम्बर, 2018 को ईि ऄजधजनयम की धारा 5 की ईपधारा (3) के परंतुक के ऄधीन ईि ऄजधकरण में ऄजतररि जनदिे दकया, महाराष्ट्र रायय ने तारीख 14 ऄगस्ट्त, 2018 को ईि [PART II—SEC. 3(ii)] THE GAZETTE OF INDIA : EXTRAORDINARY 3 ऄजधकरण में ऄजतररि जनदेि दकया तथा केन्रीय सरकार ने तारीख 14 िनवरी, 2019 को ईि ऄजधकरण में ऄजतररि जनदिे दकया तथा ईि ऄजधकरण को 20 ऄगस्ट्त, 2018 से प्रभावी एक वर् की ऄवजध के भीतर ऄपनी ऄजतररि ररपोट प्रस्ट्ततु करनी थी;
और, ईि ऄजधकरण न ेकेन्रीय सरकार से ऄपनी ऄजतररि ररपोट प्रस्ट्ततु करन ेकी ऄवजध ईि ऄजधजनयम की धारा 5 की ईपधारा (2) के ऄधीन बढान ेका ऄनुरोध दकया ह;ै ऄतः ऄब, केन्रीय सरकार, ईि ऄजधजनयम की धारा 5 की ईप-धारा (3) के परंतुक द्वारा प्रदत्त िजियों के ऄनुसरण में, ईि ऄजधकरण द्वारा ऄजतररि ररपोट प्रस्ट्तुत करने की ऄवजध 19 ऄगस्ट् त, 2020 तक के जलए बढाती ह।ै [फा.सं. 19/4/2017-बीएम] टी. रािेस्ट्वरी, ऄपर सजचव MINISTRY OF JAL SHAKTI NOTIFICATION New Delhi, the 17th February, 2020 S.O. 768(E).— Whereas, the Mahadayi Water Disputes Tribunal (hereinafter referred to as the said Tribunal) was constituted on the 16 th November, 2010 vide notification number S.O.2786 (E), dated the 16 th November, 2010 under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereinafter referred to as the said Act), for the adjudication of the water disputes regarding Inter-State river Mahadayi and river valley thereof;
And whereas, the said Tribunal was required to submit its report and decision under sub-section (2) of section 5 of the said Act within a period of three years, i.e. on or before the 15 th November, 2013 ;
And whereas, the said Tribunal had requested the Central Government to reckon the effective date of its functioning, i.e. 21 st August, 2013 to be the date of its constitution for the propose of sub-section (2) of section 5 of the said Act;
And whereas, the Central Government vide notification number S.O.2908 (E), dated the 13 th November, 2014, had decided that the effective date of constitution of the said Tribunal shall be the 21 st August, 2013, and accordingly, under the provisions of sub-section (2) of section 5 of the said Act, the period of three years for submission of report and decision by the Mahadayi Water Disputes Tribunal shall commence from the 21 st August, 2013;
And whereas, the said Tribunal was required to submit its report and decision on or before the 20 th August, 2016;
And whereas, the said Tribunal had requested the Central Government to extend the period of submission of report and decision for a period of one year with effect from the 21 st August, 2016;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And whereas, the Central Government vide notification number S.O. 2686(E), dated the 11 th August, 2016, had extended the period of submission of report and decision for a period of one year with effect from the 21 st August, 2016;
And whereas, the said Tribunal had requested the Central Government to extend the period of submission of report and decision for a period of one year with effect from the 21 st August, 2017;
And whereas, the Central Government vide notification number S.O. 2332(E), dated the 24 th July, 2017, had extended the period of submission of report and decision for a period of one year with effect from the 21 st August, 2017;
And whereas, the said Tribunal submitted its report and decision under sub-section (2) of section 5 of the said Act on the 14 th August, 2018;
And whereas, the State of Goa had filed an application under Order 39 Rule 2A of the Code of Civil Procedure, 1908 (5 of 1908) read with sub-section (3) of section 5 of the said Act on the 20 th August, 2018 and had made further reference to the said Tribunal under the proviso to sub-section (3) of section 5 of the said Act on the 20 th September, 2018.
And whereas, the State of Karnataka had made further reference to the said Tribunal under the proviso to sub-section (3) of section 5 of the said Act on the 13 th November, 2018, the State of Maharashtra had made further reference to the said Tribunal on the 14 th August, 2018 and the Central Government made further reference to the said Tribunal on the 14 th January, 2019 and the said Tribunal had to submit its further report within a period of one year with effect from the 20 th August, 2018;
And whereas, the said Tribunal has now requested the Central Government to extend the period of submission of further report under sub-section (3) of section 5 of the said Act;
Now, therefore, in pursuance of the powers conferred by the proviso to sub-section (3) of section 5 of the said Act, the Central Government hereby extends the period of submission of further report by the said Tribunal upto the 19 th day of August, 2020.
