PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY िल िजि मतं्रालय अजधसचूना ubZ fnYyh] 17 vxLr] 2020 का. आ. 2830(अ).—अन्तरराजययक नदी महादायी और उसकी नदी घाटी के संबंध में िल जििादों के न् यायजनण यन के जलए अन्तरराजययक नदी िल जििाद अजधजनयम, 1956 (1956 का 33) (जिसे इसमें इसके पश्चात् उि अजधजनयम कहा गया ह)ै की धारा 4 के अधीन तारीख 16 निम् बर, 2010 की अजधसूचना संख् या का.आ. 2786 (अ) द्वारा तारीख 16 निम् बर, 2010 को महादायी िल जििाद अजधकरण (जिसे इसमें इसके पश्चात् उि अजधकरण कहा गया ह)ै का गठन ककया गया था;
और उि अजधकरण से उि अजधजनयम की धारा 5 की उप-धारा (2) के अधीन तीन िर् की अिजध में, अथा त तारीख 15 निम् बर, 2013 को या उससे पहल ेअपनी ररपोट और जिजनश्चय प्रस्ट् तुत करन ेकी अपेषा ा की गथ थी;
और उि अजधकरण न ेकेन्रीय सरकार से यह अनरुोध ककया था कक उि अजधजनयम की धारा 5 की उप-धारा (2) के प्रयोिन के जलए उनके काय िुरू करने की प्रभािी तारीख अथा त 21 अगस्ट्त, 2013 को इसके गठन की तारीख माना िाए;
और, केन्रीय सरकार न ेअजधसूचना संख्या का.आ. 2908 (अ), तारीख 13 निम्बर, 2014 द्वारा यह जिजनश्चय ककया था कक उि अजधकरण के गठन की प्रभािी तारीख 21 अगस्ट् त, 2013 होगी और तदनुसार, उि अजधजनयम की स.ं 2506] नथ कदल्ली, बृहस्ट् पजतिार, अगस्ट् त 20, 2020/श्रािण 29, 1942 No. 2506] NEW DELHI, THURSSDAY, AUGUST 20, 2020/SRAVANA 29, 1942 सी.जी.-डी.एल.-अ.-21082020-221260 CG-DL-E-21082020-221260 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] धारा 5 की उप-धारा (2) के उपबंधों के अधीन महादायी िल जििाद अजधकरण द्वारा ररपोट और जिजनश्चय देने के जलए तीन िर् की अिजध तारीख 21 अगस्ट् त, 2013 से प्रारम्भ होगी;
और, उि अजधकरण से तारीख 20 अगस्ट् त, 2016 को या उसके पूि उसकी ररपोट और जिजनश्चय प्रस्ट्ततु करने की अपेषा ा की गथ थी;
और, उि अजधकरण न ेकेन्रीय सरकार से ररपोट और जिजनश्चय प्रस्ट्तुत करन ेकी अिजध तारीख 21 अगस्ट् त, 2016 से एक िर् के जलए और बढाने का अनुरोध ककया था;
और, केन्रीय सरकार न े अजधसूचना संख्या का.आ. 2686 (अ.) तारीख 11 अगस्ट्त, 2016 द्वारा ररपोट और जिजनश्चय की प्रस्ट्तुजत की अिजध को तारीख 21 अगस्ट् त, 2016 से एक िर् की और अिजध के जलए जिस्ट्ताररत कर कदया था;
और, उि अजधकरण न ेकेन्रीय सरकार से ररपोट और जिजनश्चय प्रस्ट्तुत करन ेकी अिजध तारीख 21 अगस्ट् त, 2017 से एक िर् के जलए और बढाने का अनुरोध ककया था;
और, केन्रीय सरकार ने अजधसूचना संख्या का.आ. 2332 (अ.) तारीख 24 िुलाथ, 2017 द्वारा ररपोट और जिजनश्चय प्रस्ट्तुत करने की अिजध को तारीख 21 अगस्ट् त, 2017 से एक िर् की और अिजध के जलए जिस्ट्ताररत कर कदया था;
और, उि अजधकरण न े उि अजधजनयम की धारा 5 की उपधारा (2) के अधीन अपनी ररपोट और जिजनश्चय तारीख 14 अगस्ट्त, 2018 को प्रस्ट्तुत कर कदया था;
और, गोिा रायय न ेतारीख 20 अगस्ट्त, 2018 को उि अजधजनयम की धारा 5 की उपधारा (3) के साथ परठत जसजिल प्रकिया संजहता, 1908 (1908 का 5) के आदेि 39 जनयम 2(क) के अधीन उि अजधकरण में एक आिेदन दाजखल ककया था तथा तारीख 20 जसतम्बर, 2018 को उि अजधजनयम की धारा 5 की उपधारा (3) के परंतुक के अधीन उि अजधकरण में अजतररि जनदिे ककया;
और, कना टक रायय न ेतारीख 13 निम्बर, 2018 को उि अजधजनयम की धारा 5 की उपधारा (3) के परंतुक के अधीन उि अजधकरण में अजतररि जनदेि ककया, महाराष्ट्र रायय ने तारीख 5 निम्बर, 2018 को उि अजधकरण में अजतररि जनदेि ककया तथा केन्रीय सरकार न ेतारीख 14 िनिरी, 2019 को उि अजधकरण में अजतररि जनदिे ककया तथा उि अजधकरण को 20 अगस्ट्त, 2018 से प्रभािी एक िर् की अिजध के भीतर अपनी अजतररि ररपोट प्रस्ट्तुत करनी थी;
और, उि अजधकरण न ेकेन्रीय सरकार से उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अपनी अजतररि ररपोट प्रस्ट्ततु करने की अिजध तारीख 20 अगस्ट् त, 2019 से एक िर् के जलए और बढाने का अनुरोध ककया था;
और, केन्रीय सरकार ने अजधसूचना संख्या का.आ. 768 (अ.) तारीख 17 फरिरी, 2020 द्वारा उि अजधकरण द्वारा अजतररि ररपोट प्रस्ट्तुत करने की अिजध को तारीख 19 अगस्ट् त, 2020 तक जलए जिस्ट्ताररत कर कदया था;
और, माननीय उच्चतम न्यायालय द्वारा आथ.ए. संख्या 109720/2019 के साथ एसएलपी संख्या 33018/2018 के संदभ में कदए गए 20 फरिरी, 2020 के आदिेानुसार कें रीय सरकार न ेअजधसूचना संख्या का.आ. 888 (अ.) तारीख 27 फरिरी, 2020 द्वारा उि अजधजनयम की धारा 5 की उपधारा (2) के अधीन कदए गए उि अजधकरण की ररपोट और जिजनश्चय को 14 अगस्ट्त, 2018 को प्रकाजित ककया;
और, उि अजधकरण न ेकेन्रीय सरकार से उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अपनी अजतररि ररपोट प्रस्ट्ततु करने की अिजध तारीख 20 अगस्ट् त, 2020 से एक िर् के जलए और बढाने का अनुरोध ककया ह;ै [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 अतः अब, केन्रीय सरकार, उि अजधजनयम की धारा 5 की उप-धारा (3) के परंतुक द्वारा प्रदत्त िजियों के अनुसरण में, उि अजधकरण द्वारा अजतररि ररपोट प्रस्ट्तुत करने की अिजध को तारीख 20 अगस्ट् त, 2020 से एक िर् के जलए बढाती ह।ै [फा.सं. N-58012/1/2020-BM Section-MOWR] देिश्री मुख़िी, अपर सजचि MINISTRY OF JAL SHAKTI NOTIFICATION New Delhi, the 17th August, 2020 S.O. 2830(E).—Whereas, the Mahadayi Water Disputes Tribunal (hereinafter referred to asthe said Tribunal) was constituted on the 16 th November, 2010 vide notification number S.O.2786 (E), dated the 16 th November, 2010 under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereinafter referred to asthe said Act), for the adjudication of the water disputes regarding Inter-State river Mahadayi and river valley thereof;
And whereas, the said Tribunal was required to submit its report and decision under sub-section (2) of section 5 of the said Act within a period of three years, i.e., on or before the 15 th November, 2013;
And whereas, the said Tribunal had requested the Central Government to reckon the effective date of its functioning, i.e., 21 st August, 2013 to be the date of its constitution for the propose of sub-section (2) of section 5 of the said Act;
And whereas, the Central Government vide notification number S.O.2908 (E), dated the 13 th November, 2014, had decided that the effective date of constitution of the said Tribunal shall be the 21 st August, 2013, and accordingly, under the provisions of sub-section (2) of section 5 of the said Act, the period of three years for submission of report and decision by the Mahadayi Water Disputes Tribunal shall commence from the 21 st August, 2013;
And whereas, the said Tribunal was required to submit its report and decision on or before the 20 th August, 2016;
And whereas, the said Tribunal had requested the Central Government to extend the period of submission of report and decision for a period of one year with effect from the 21 st August, 2016;
And whereas, the Central Government vide notification number S.O. 2686(E), dated the 11 th August, 2016, had extended the period of submission of report and decision for a period of one year with effect from the 21 st August, 2016;
And whereas, the said Tribunal had further requested the Central Government to extend the period of submission of report and decision for a period of one year with effect from the 21 st August, 2017;
And whereas, the Central Government vide notification number S.O. 2332(E), dated the 24 th July, 2017, had extended the period of submission of report and decision for a further period of one year with effect from the 21 st August, 2017;
And whereas, the said Tribunal submitted its report and decision under sub-section (2) of section 5 of the said Act on the 14 th August, 2018;
And whereas, the State of Goa had filed an application under Order 39 Rule 2A of the Code of Civil Procedure, 1908 (5 of 1908) read with sub-section (3) of section 5 of the said Act on 20 th August, 2018 and had made further reference to the said Tribunal under theproviso to sub-section (3) of section 5 of the said Act on 20 th September, 2018.
And whereas, the State of Karnataka had made further reference to the said Tribunal under the proviso to sub-section (3) of section 5 of the said Act on 13 th November, 2018, the State of Maharashtra had made further 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] reference to the said Tribunal on 5 th November, 2018 and the Central Governmentmade further reference to the said Tribunal on 14 th January, 2019 and the said Tribunal had to submit its further report within a period of one year with effect from the 20 th August, 2018;
And whereas, the said Tribunal had requested the Central Government to extend the period of submission of further report under sub-section (3) of section 5 of the said Act for a period of one year with effect from the 20 th August, 2019.
And whereas, the Central Government vide notification number S.O. 768(E), dated the 17 th February, 2020, had extended the period of submission of further report by the said Tribunal upto the 19 th August, 2020;
And whereas, as per Hon’ble Supreme Court’s Order dated the 20 th February, 2020 in I.A. No.109720/2019 with SLP No.33018/2018, the Central Government vide notification number S.O. 888(E), dated the 27 th February, 2020, had published the report and decision of the said Tribunal given under sub-section (2) of section 5 of the said Act on the 14 th August, 2018;
And whereas, the said Tribunal has now requested the Central Government to extend the period of submission of further report under sub-section (3) of section 5 of the said Act for a period of one year with effect from the 20 th August, 2020;
Now, therefore, in pursuance of the powers conferred by the proviso to sub-section (3) of section 5 of the said Act, the Central Government hereby extends the period of submission of further report by the said Tribunal for a period of one year with effect from the 20 th August, 2020.
