[TO BE PUBLISHED IN THE GAZETTE OF INDIA, EXTRAORDINARY, PART-II, SECTION-3, SUB-SECTION (i)] GOVERNMENT OF INDIA MINISTRY OF FINANCE (DEPARTMENT OF REVENUE) (CENTRAL BOARD OF EXCISE AND CUSTOMS) Notification No. 108/ 2016-Customs (N.T.) New Delhi, the11th August, 2016 G.S.R. ... (E).- In exercise of the powers conferred by clause (a) of sub-section (2) of section 157 of the Customs Act, 1962 (52 of 1962), the Central Board of Excise and Customs hereby makes the following regulations further to amend the Import Manifest (Aircraft) Regulations, 1976, namely: -

1. (1) These Regulations may be called the Import Manifest (Aircraft) Amendment Regulations, 2016.

(2) They shall come into force on the date of their publication in the e-gazette of India.

2. In the Import Manifest (Aircraft) Regulations, 1976 (hereinafter referred to as the said regulations), in regulation 5, -

(a) for sub-regulation (1), the following shall be substituted, namely:- “(1) The passenger manifest shall be delivered within fifteen minutes of the closure and departure of the flights from the port of embarkation outside India.”;

(b) for sub-regulation (2), the following shall be substituted, namely:- “(2) The manifest shall be transmitted electronically to the Indian Customs either in flat file format or in United Nations/ Electronic Data Interchange for Administration, Commerce and Transport Passenger List Advance Passenger Information (UN/EDIFACT PAXLST API) message format as per Annexure.”;

(c) in sub-regulation (3), after the word “concerned”, the following words shall be inserted, namely:- “Principal Commissioner of Customs or”.

3. In the said regulations, after regulation 5 and before FORM I, the following Annexure shall be inserted, namely:- “ANNEXURE

(i) Flat File Naming Convention: The structure of file name will be as below:- 160401PJFKDELBY161.api where 160401 6 digit scheduled Arrival date in YYMMDD format P/C P for PAX and C for Crew JFK Departure Airport Code (Last Leg port) DEL 3 character destination airport code (DEL=Delhi) BY 2/3 digit IATA carrier code 161 3/4 digit IATA flight number .api File extension

(ii) File structure Details: One file structure will contain a complete manifest for Pax/Crew of a particular flight. Separate file for Crew and PAX for each flight needs to be sent.

(iv) For furnishing the information in United Nations/ Electronic Data Interchange for Administration, Commerce and Transport Passenger List Advance Passenger Information (UN/EDIFACT PAXLST API) message format, airlines/ carriers may refer WCO/IATA/ICAO passenger list message (PAXLST) implementation guide. (www.wcoomd.org).”.
