PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY कोयला मतं्रालय अजधसचूना नई दिल्ली, 12 अप्रैल, 2023 का.आ. 1728(अ).— सेवाओं या लाभों या सहाजयदकयों के पररिान के जलए पहचान िस्ट्तावेि के रूप में आधार का उपयोग सरकारी पररिान प्रदियाओं को सरल बनाता ह,ै पारिर्ििता और िक्षता लाता ह,ै और लाभार्थियों को उनकी पात्रता को सीधे सुजवधािनक और जनबािध तरीके से प्राप्त करने में सक्षम बनाता ह ैऔर आधार दकसी की पहचान साजबत करने के जलए कई िस्ट्तावेिों की आवश्यकता को समाप्त करता ह;ै और कोयला मंत्रालय (जिसे इसमें इसके पश्चात मंत्रालय कहा गया ह)ै कोयला खान भजवष्य जनजध और जवजवध उपबंध अजधजनयम, 1948 (1948 का 46) के अंतगित बनाई गई कोयला खान पेंिन योिना, 1998(जिसे इसमें इसके पश्चात स्ट्कीम कहा गया ह)ै का प्रिासन कर रहा ह ैऔर जिसमें सिस्ट्य और पेंिनभोगी हैं;
और उक्त योिना में अंििान के रूप में कें द्रीय सरकार द्वारा भारत की समेदकत जनजध से आवती व्यय िाजमल ह;ै अतः अब, कें द्रीय सरकार आधार (जवत्तीय और अन्य सहाजयदकयों, प्रसुजवधाओं और सेवाओं का लजक्षत पररिान) अजधजनयम, 2016 (2016 का 18) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया ह)ै की धारा 7 के उपबंधों के अनुसरण में, जनम्नजलजखत अजधसूजचत करती ह,ै अथाित्: - स.ं 1648] नई दिल्ली, बृहस्ट् पजतवार, अप्रलै 13, 2023/चतै्र 23, 1945 No. 1648] NEW DELHI, THURSDAY, APRIL 13, 2023/CHAITRA 23, 1945 सी.जी.-डी.एल.-अ.-13042023-245164 CG-DL-E-13042023-245164 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
1. (1) उक्त योिना के आधीन कें द्रीय सरकार के योगिान का लाभ उठाकर योिना में पेंिन और सिस्ट्यता िारी रखने के इच्छुक कोयला खान पेंिन योिना के सिस्ट्य और पेंिनभोगी को आधार नम्बर होने का प्रमाण प्रस्ट्तुत करना आवश्यक ह ैया आधार के माध्यम से बेहतर और परेिानी मुक्त पहचान के जलए कोयला खान भजवष्य जनजध संगठन द्वारा जनधािररत प्रदिया के अनुसार आधार प्रमाणीकरण से गुिरना होगा।
(2) उक्त योिना के लाभ को िारी रखन ेके इच्छुक योिना के सिस्ट्य या पेंिनभोगी, जिन्हें अभी तक आधार के जलए नामांदकत नहीं दकया गया ह,ै को आधार नामांकन के जलए आवेिन करने की आवश्यकता होगी, यदि वह उक्त अजधजनयम की धारा 3 के उपबंधों के अनुसार आधार प्राप्त करन ेके जलए पात्र ह ैऔर ऐसे सिस्ट्य और पेंिनभोगी भारत की जवजिष्ट पहचान प्राजधकरण (यूआईडीएआई) (वेबसाइट www.uidai.gov.in) में नामांदकत होने के जलए आधार नामांकन कें द्र (यआूईडीएआई में उपलब्ध सूची) िा सकते हैं।
(3) आधार (नामांकन और अद्यतन) जवजनयम, 2016 के जवजनयम 12 के अनुसार, मंत्रालय को अपनी कायािन्वयन एिेंसी के माध्यम से उन जनवाजसयों के जलए आधार नामांकन सुजवधाएं प्रिान करना आवश्यक ह ैिो अभी तक आधार के जलए नामांदकत नहीं हैं और यदि संबंजधत ब्लॉक या तालुका या तहसील में कोई आधार नामांकन कें द्र जस्ट्थत नहीं ह,ै मंत्रालय अपनी कायािन्वयन एिेंसी के माध्यम से यूआईडीएआई के जवद्यमान रजिस्ट्रार के सहयोग से या स्ट्वय ं यआूईडीएआई रजिस्ट्रार बनकर सुजवधािनक स्ट्थानों पर आधार नामांकन सुजवधाएं प्रिान करेगा:
परन्त ुिब तक उक्त सिस्ट्य को आधार नहीं दिया िाता ह,ै तब तक कोयला खान पेंिन योिना के अधीन कें द्रीय सरकार का योगिान पहचान के वैकजल्पक और व्यवहायि साधनों के आधार पर दिया िाएगा िैसा दक कोयला भजवष्य जनजध संगठन द्वारा अजधसूजचत दकया गया ह,ै िो जनम्नजलजखत िस्ट्तावेिों के प्रस्ट्ततु करने के अधीन ह:ै - (क) (i) जनयोक्ता या के्षत्र द्वारा िारी दकया गया पहचान प्रमाण पत्र उक्त संगठन द्वारा िारी जवजिष्ट खाता संख्या (यूएएन) के साथ कोयला खान भजवष्य जनजध संगठन (कोयला मंत्रालय द्वारा जनर्ििष्ट टेम्पलेट) के के्षत्र कायािलय या जनयोक्ता द्वारा िारी दकया गया पहचान प्रमाण-पत्र;
(ii) यदि सिस्ट्य या पेंिनभोगी ने नामांकन दकया ह,ै तो उसकी आधार नामांकन पहचान पची; और (ख) जनम्नजलजखत िस्ट्तावेिों में से कोई एक, अथाित्: -
(i) भारत के जनवािचन आयोग द्वारा िारी मतिाता पहचान पत्र; या
(ii) आयकर जवभाग द्वारा िारी स्ट्थायी खाता संख्या (पैन) काडि; या
(iii) पासपोटि; या
(iv) मोटर यान अजधजनयम, 1988 (1988 का 59) के तहत लाइसेंससंग प्राजधकरण द्वारा िारी ड्राइसवंग लाइसेंस;
या
(v) रािपजत्रत अजधकारी या तहसीलिार द्वारा आजधकाररक लेटर हडे पर िारी दकए गए ऐसे सिस्ट्य की फोटो वाले पहचान का प्रमाण पत्र; या
(vi) कोयला खान भजवष्य जनजध संगठन द्वारा जनर्ििष्ट कोई अन्य िस्ट्तावेि:
परन्त ुयह और दक उपरोक्त िस्ट्तावेिों की िांच कोयला खान भजवष्य जनजध संगठन द्वारा जविेष रूप से नामजनर्ििष्ट अजधकारी द्वारा अपन ेक्षेत्रीय कायािलयों और अपन ेनेटवकि के माध्यम से की िाएगी।
2. सिस्ट्यों के लाभ के जलए योिना के अधीन कें द्रीय सरकार के योगिान को सुजवधािनक और बाधा मुक्त उपलब्ध कराने के जलए, कोयला खान भजवष्य जनजध संगठन अपन ेक्षते्रीय कायािलयों और अपन ेनेटवकि के माध्यम से यह सुजनजश्चत [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 करन ेके जलए सभी आवश्यक व्यवस्ट्था करेगा दक मीजडया के माध्यम से व्यापक प्रचार और संबंजधत प्रजतष्ठानों के माध्यम से व्यजक्तगत नोरटस सिस्ट्य आवेिकों को दिए िाएंग ेतादक उन्हें योिना के अधीन कें द्रीय सरकार के योगिान का लाभ उठान े के उदे्दश्य से आधार की आवश्यकता से अवगत कराया िा सके।
3. सभी मामलों में, िहां सिस्ट्यों या पेंिनरों के खराब बायोमेररक्स के कारण या दकसी अन्य कारण से आधार प्रमाणीकरण जवफल हो िाता ह,ै जनम्नजलजखत उपचारात्मक ततं्र को अपनाया िाएगा, अथाित्: - (क) खराब फफंगरसप्रंट गणुवत्ता के मामले में, प्रमाणीकरण के जलए आईररस स्ट्कैन या फेस ऑथेंरटकेिन सुजवधा को अपनाया िाएगा, जिससे मंत्रालय अपनी कायािन्वयन एिेंसी के माध्यम से आईररस स्ट्कैनर या फेस ऑथेंरटकेिन के साथ-साथ फफंगरसप्रंट प्रमाणीकरण के जलए उपबंध करेगा तादक लाभ का जवतरण सहि तरीके से दकया िा सके;
(ख) उंगजलयों के जनिान या आईररस स्ट्कैन या चेहरे के प्रमाणीकरण के माध्यम से बायोमेररक प्रमाणीकरण सफल नहीं होन ेकी जस्ट्थजत में, िहां भी संभव हो, यथा जस्ट्थजत आधार एक बारगी पासवडि या सीजमत समय वैधता के साथ समय -आधाररत एक बारगी पासवडि, द्वारा प्रमाणीकरण दकया िाएगा;
(ग) अन्य सभी मामलों में िहां बायोमेररक या आधार एक बारगी पासवडि या समय आधाररत एक बारगी पासवडि प्रमाणीकरण संभव नहीं ह,ै योिना के अधीन पेंिन वास्ट्तजवक आधार पत्र के आधार पर िी िा सकती ह,ै जिसकी प्रामाजणकता आधार पत्र पर मुदद्रत त्वररत प्रजतदिया कोड के माध्यम से सत्याजपत की िा सकती ह ैऔर मंत्रालय द्वारा अपनी कायािन्वयन एिेंसी के माध्यम से सुजवधािनक स्ट्थानों पर त्वररत प्रजतदिया कोड रीडर की आवश्यक व्यवस्ट्था प्रिान की िाएगी।
4. यह अजधसूचना सभी राज्यों और संघ राज्य क्षेत्रों में रािपत्र में इसके प्रकािन की तारीख को प्रवृत होगी। [फा. सं. 20090/24/2016-पीआरआईडब् ल् य3ू] संतोष, डीडीिी (कोयला) MINISTRY OF COAL NOTIFICATION New Delhi, the 12th April, 2023 S.O. 1728(E).— WHEREAS, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one’s identity ;
AND WHEREAS, the Ministry of Coal (hereinafter referred to as the Ministry) is administering the Coal Mines Pension Scheme, 1998 (hereinafter referred to as the Scheme) framed under the Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 (46 of 1948) and which is having members and pensioners ;
AND WHEREAS, the aforementioned Scheme involves recurring expenditure from the Consolidated Fund of India by the Central Government in the form of contribution;
NOW, THEREFORE, in pursuance of the provision of section 7 of the Aadhaar (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Central Government hereby notifies the following, namely :-
1. (1) Members and pensioners of the Coal Mines Pension Scheme desirous of continuing to avail pension and membership to the Scheme by availing the Central Government’s contribution under the said Scheme, are hereby required to furnish proof of the possession of the Aadhaar number or undergo Aadhaar authentication as per the procedure laid down by the Coal Mines Provident Fund Organisation for better and hassle free identification through Aadhaar.
(2) A Member or a pensioner of the Scheme desirous of continuing the benefit of the said Scheme, who is not yet enrolled for Aadhaar shall be required to make an application for Aadhaar enrolment, in case he is entitled to obtain Aadhaar as per the provisions of section 3 of the said Act and such 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] members and pensioners may visit any Aadhaar enrolment centre (list available at Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar.
(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the residents who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:
Provided that till the time Aadhaar is assigned to the said member, the Central Government’s contribution under the aforesaid Coal Mines Pension scheme shall be given based on the alternate and viable means of identification as notified by the Coal Mines Provident Fund Organisation subject to the production of the following documents, namely:-
(a)(i) Identity Certificate issued by the employer or field office of the Coal mines Provident Fund Organisation (the template as specified by the Ministry of Coal) with the Unique Account Number (UAN) issued by the said Organisation;
(ii) if the member or pensioner has enrolled, his Aadhaar Enrolment Identification slip; and
(b) any one of the following documents, namely:-
(i) voter identity card issued by the Election Commission of India; or
(ii) permanent Account Number (PAN) Card issued by the Income- tax Department; or
(iii) Passport; or
(iv) driving licence issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988);
or
(v) certificate of identity having photo of such member issued by a Gazetted Officer or a Tehsildar on an official letter head; or
(vi) any other document specified by the Coal Mines Provident Fund Organisation:
Provided further that the above documents shall be checked by an officer specifically designated by the Coal Mines Provident Fund Organisation through its field offices and their networks.
2. In order to provide convenient and hassle free Central Government’s contribution under the Scheme for the benefit of the members, the Coal Mines Provident Fund Organisation through its field offices and their networks shall make all the required arrangements to ensure that wide publicity through media and individual notices through the concerned establishments shall be given to the member applicants to make them aware of the requirement of Aadhaar for the purpose of availing the Central Government’s contribution under the Scheme.
3. In all cases, where Aadhaar authentication fails due to poor biometrics of the members or pensioners or due to any other reason, the following remedial mechanisms shall be adopted, namely:-
(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Ministry through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;
(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Timebased One-Time Password with limited time validity, as the case may be, shall be offered;
(c) in all other cases where biometric or Aadhaar One Time Password or Time- based One-Time Password authentication is not possible, pension under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Ministry through its Implementing Agency.
4. This notification shall come into effect in all the States and Union territories from the date of its publication in the Official Gazette.
