238.000 (Orrisa/Chhattisgarh Border -Aurang section) of National Highway No. 6 in the State of Chhattisgarh to the National Highways Authority of India (hereinafter referred to as the “Authority”);
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement on 25.01.2012 (hereinafter referred to as “said agreement”) with M/s BSCPL Aurang Tollway Ltd. having its registered office 6-2-913/914, V Floor, Progressive Towers, Khairatabad, Hyderabad – 500 004 (hereinafter referred to as the “Concessionaire”) for the bid submitted on 29.07.2011 for the development of Chhattisgarh/Orissa Border–Aurang Section from km. 88.000 to km. 239.000 (having design chainage km 88.000 to chainage 238.335) the end point is same on ground as the start point of succeeding 4-laning project of Raipur-Aurang section although having different chainage value i.e. km 238.535) on National Highway No. 6 (hereinafter referred to as the “said section”) to four lane standards as BOT (Toll) on Design, Build, Finance, Operate and Transfer basis:
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R. 838(E) dated 5 th December, 2008 and amended vide G.S.R 950(E) dated 3 rd December, 2010, G.S.R 15(E) dated 12th January, 2011 (hereinafter referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of four and more lane of the said section at the rate specified in column (2) of Table 1 below for net road section length of
121.495 km, at one and half times the base rate specified in column (2) of Table 1 below for the use of bypasses, costing Rupees ten crore or more, having total length of 27.990 km and at the base rate specified in Table 2 below for use of permanent bridge of length 0.800 km having an estimated cost of Rs. 132.15 Cr. on the Type of Vehicles specified in Table 1 and 2 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

4. The rate of monthly pass for local personal traffic is Rs. 230.00 (Rupees Two Hundred and Thirty Only) for the year 2015-16 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
5. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

A mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall not be permitted to use the National Highway for crossing the Toll plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in-charge of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the Toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicles under the rules.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table 1 & Table 2 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority.
The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the Rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from the date of preceding revision of fee.
