4. राजमाग� ख? ड पर बWया2ा7 हतेु पास िनX निलिखत दरO पर जारी �कया जायेगा, अथा�त्:
संदये धनरािश अनु{ात एकतरफा या2ा7 क* अिधक तम संd या िविधमा� यता क* अविध एकतरफा या2ा के िलए शु� क का डढ़े गुना दो संदाय के समय से चौबीस घंटे पचास या अिधक एकल या2ा7 के िलए संदये शु� क क* रािश का दो-ितहाई पचास या अिधक संदाय क* तारीख से एक मास
5. िजस िजल ेम= टोल _ लाजा पड़ता ह ैउस िजले म= पंजीकृत वािणि<यक वाहन (रा� �ीय परिमट के अधीन चल रह े वाहनO को छोड़कर) के िलए शु� क उस }ेणी के वाहन के िलए िनधा�-रत शु� क का 50% होगा बशत~ के ऐसे वािणि<यक वाहनO के उपयोग के िलए कोई सDवस रोड अथवा वैकि�पक lM+d उपलi ध न हो ।
6. जो यांि2क वाहन िनयमO के अधीन अपने वग� के िलए िनधा�-रत अनु{ेय भार क* अपेbा अिधक भार से लद े Wए हOगे, उ�ह= उन दरO पर शु� क का संदाय करना होगा जो उनसे अगली उ� च }ेणी के वाहनO के िलए लागू होता ह ै और उ� ह= तब तक राजमाग� ख? ड का उपयोग करने का अिधकार नह� होगा जब तक �क ऐसे यांि2क वाहन से अिधक भार को हटा न �दया जाए।
7. यांि2क वाहनO के वग�, उनके िलए अनु{ेय भार, छूट ा_ त वाहनO के वग�, सDवस रोड, वैकि�पक सड़क आ�द सिहत सभी प-रभाषाए ंिनयमO म= िविनlद� ट प-रभाषा7 के अनसुार हOगी ।
8. उI त िनयमO के िनयम 12 के अनुसार, उपयोगक+ ता�7 क* जानकारी के िलए शु� क क* दरO को दDशत �कया जाएगा ।
9. ऊपर सारणी-1 म= यथा-उि�लिखत, आधार वष� 2007-08 के िलए ित �क.मी.शु� क क* आधार दर के आधार पर, यांि2क वाहनO से िलए जानेवाले वा\ तिवक शु� क और कटौितयO क* गणना ािधकरण 8ारा क* जाएगी। उसे ािधकरण 8ारा कािशत कराया जाएगा तथा उसमे, उI त िनयमO के िनयम 5 के अनुसार, वाDषक तोर पर संशोधन �कया जायेगा तथा कािशत कराया जायेगा पर� तु शत� यह ह ै�क शु� क म= िपछली बार �कय ेगये संशोधन क* तारीख से छ: मास क* अविध के भीतर कोई संशोधन नह� �कया जायेगा तथा उसे, तदनुसार, अंPेजी ओर \थानीय भाषा के कम-से-कम एक-एक समाचारप2 मे कािशत �कया जाएगा।
10. वािणि<यक चालन क* तारीख (सीओडी) से वसूल क* जानेवाली प-रयोजना क* पुंजीगत लागत का वत�मान मू� य 2948.91 करोड़ qपए (दो हजार नौ सौ अड़तालीस करोड़ इकानवे लाख qपए मा2) ह।ै -रयायतPाही 8ारा टोल का संPहण वािणि<यक चालन क* तारीख से रा� Nीय राजमाग� शु� क (दरO का अवधारण और संPहण) िनयम, 2008 और बोली क* िनयत तारीख तक उसम= आगे �कये गये संशोधनO के अधीन, लागू दरO पर �कया जायेगा। पूंजीगत लागत क* वसूली हो जाने क* तारीख के बाद ली जाने वाली टोल क* दरO का घटाकर 40 ितशत कर �दया जायेगा। य�द �कसी कारण से, वािणि<यक चालन क* तारीख 90 �दन तक पहल/े बाद म= कर दी जाती ह ैतो वसूल क* जानेवाली पूंजीगत लागत का �फर से िहसाब लगाया जाएगा और इंजीिनयर/ \ वतं2 इंजीिनयरO 8ारा वािणि<यक चालन क* वा\ तिवक तारीख के बाद 30 �दन के अ� दर -रयायतPाही को सूिचत कर �दया जाएगा। [फा. सं. भारारा ा/13-14/सीओ/जीसी/कानपुर-अयो]या] अलकेश शमा�, संयुI त सिचव ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 3rd July, 2013 S.O. 1987 (E).— Whereas by following notification of the Government of India in the erstwhile Ministry of Road Transport and Highways number, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the following stretches of National Highways in the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the “Authority”);

0.000 - 365.570 465(E) 26.04.2002 And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act 1956 (48 of 1956) read with National Highways Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows:
(i) Vide S.O. No. 759 (E) dated 18 th March, 2009 for the stretch from km 11.000 to km 59.000 on NH-25 in the State of Uttar Pradesh.
(ii) Vide S.O. No. 2906 (E) dated 14 th December, 2012 for the stretch from km 8.250 to km 70.000 on NH- 28 in the State of Uttar Pradesh.
(iii) Vide S.O. No. 1589 (E) dated 8 th July, 2011 for the stretch from km 70.000 to km 135.000 on NH-28 in the State of Uttar Pradesh.
And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) on
08.04.2013 with M/s PNC Kanpur Ayodhya Tollways Private Limited having its registered office at Cabin No.
5, NBCC Plaza, Tower II, 4 th floor, Pushp Vihar, Sector V, Saket New Delhi-110017 India (hereinafter referred to as the “Concessionaire”), for bids submitted on 31.12.2012 for the Operation and Maintenance of Kanpur – Ayodhya section from km 11.005 to km 75.500 on NH-25, from km 0.000 to km 22.850 on NH-56A&56B and from km 8.000 to km 137.970 on NH-28 (hereinafter referred to as the “said section”) on Operation, Maintenance & Transfer (OMT) basis.
Now, therefore, in exercise of the powers conferred by Section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5 th December, 2008 and amended vide G.S.R 950(E) dated 3 rd December, 2010, G.S.R 15(E) dated 12 th January, 2011, G.S.R 1756(E) dated 12 th October, 2011 (hereinafter referred to as the “Rules”) and in supersession of the notification number S.O. No. 759 (E) dated 18.03.2009, S.O. No. 2906 (E) dated 14.12.2012 and S.O. No. 1589 (E) dated 08.07.2011, except as respect things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in maintenance, management and operation of the said section, interest on the capital invested, reasonable 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length of 198.356 km for use of the four and more lane sections (hereinafter referred to as “base rate”) and at one and half times the base rate for bypasses having an aggregate length of 18.959 km costing each bypass Rupees ten crore or more on the Type of Vehicles specified in Table 1 below, and authorizes the said Concessionaire to collect and retain the fee for the use of the said section on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for the distance specified for such Toll Plaza(s):

2. In addition to above, the following fee shall also be due and payable for the use of the following bypass(es) at the following Toll Plaza(s) at one and half times of the base rate mentioned in table 1 above for the length of bypass(es) specified for such Toll Plaza(s):

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred and Fifteen only) for the year 2013-14, which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

4. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority.
The same shall be got published by the Authority and will be revised annually and got published in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months from the date of the preceding revision of fee and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
10. The present value of Capital Cost of the Project to be recovered from the date of COD is Rs. 2948.91 crores (Rs. Two Thousand Nine Hundred Forty Eight Crores and Ninety One Lakhs only). From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and further amendments till bid due date. After the day on which the Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of rate being charged. In case, due to any reason, COD is advanced/ postponed upto 90 days, the Capital Cost to be recovered shall be reworked and intimated to the Concessionaire within 30 days after actual COD, by the Engineer/ Independent Engineers.
