5. फ�स ? लाजा ि' थत होने वाले िजले म. पंजीकृत वािणि- यक वाहनD (रा/ 0ीय परिमट के अधीन )चािलत �कए जा रह ेवाहनD को छोड़कर) के िलए फ�स उस Xेणी के वाहन हेतु िनधा��रत दर क� 50% होगी, बशतY �क ऐसे वािणि- यक वाहनD के उपयोग के िलए कोई स[वस रोड या वैकि4 पक सड़क उपलH ध न हD । 6. िनयमD के अंतग�त संबंिधत Xेणी के वाहनD के िलए िविनKद/ ट अनुम� य भार से अिधक भार लदे यांि$क वाहन, उस दर पर फ�स का भुगतान करने का दािय� व होगा जो अगली उ\ च Xेणी के वाहनD के िलए )यो- य ह ैऔर वह राजमाग� खंड का उपयोग करने के िलए तब तक हकदार नह] होगा जब तक ऐसे यांि$क वाहन से लदा अितभार हटाया नह] जाता । 7. सभी प�रभाषाएं, यांि$क वाहनD क� Xेणी, इनके अनुम� य भार, छूट )ा? त वाहनD क� Xेणी, स[वस रोड, वैकि4 पक सड़क इ� या�द किथत िनयमD म. िविनKद/ ट प�रभाषाQ के अनु2प हDगी । 8. फ�स क� दर. किथत िनयम के िनयम 12 के अनुसरण म. )यो= ताQ के सूचनाथ� )द[शत करनी हDगी । 9. यांि$क वाहनD से फ�स क� वा' तिवक रािश तािलका-। म. यथा-उि4 लिखत आधार वष� 2007-08 के िलए )ित �कमी फ�स क� आधार दर के आधार पर )भा�रत होगी और छूटD क� गणना )ािधकरण +ारा क� जाएगी । )ािधकरण +ारा इसे �रयायतCाही के माI यम से )� येक अंCेजी और देशी भाषा म. कम से कम एक समाचार प$ म. )कािशत कराया जाएगा और त� प^ चात् किथत िनयमD के िनयम 5 और �रयायत करार के उपबंध के अनुसरण म. वा[षक 2प से संशोिधत कराया और )कािशत कराया जाएगा बशतY �क फ�स के पूव�वत_ संशोधन क� तारीख से 6 महीनD क� अविध के भीतर कोई संशोधन नह] �कया जाएगा । [फा. सं.आरडH 4 यू/एनएच-37016/2/2013-एनएचडीपी-IVए] अलकेश शमा�, संयु= त सिचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATON New Delhi, the 29th April, 2014 S.O. 1164(E).—Whereas, by notification of the Government of India in the erstwhile Ministry of Shipping, Road Transport and Highways (Department of Road Transport &Highways) number S.O.1096(E) dated 4th August 2005 and 1051(E) dated 24th April, 2009 issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted National Highway No. 65 in the State of Rajasthan to the State Government of Rajasthan (hereinafter referred to as the “Authority”) And whereas, the Authority has entered into an Agreement on 28.02.2013 (hereinafter referred to as said “Agreement”) with M/s Jodhpur Pali Expressway Limited, having its Registered Office at Plot No. 11, B-1, Local Shopping Complex, Vasant Kunj, New Delhi-110070 (hereinafter referred to as “Concessionaire”), for the bid submitted on 29.11.2012 for the development & operation of Jodhpur - Pali Section of NH-65 from Km 308.000 to Km. 366.000 & including bypass to Pali starting from Km 366.000 of the National Highway No. 65 connecting at Km 114.000 of NH-14 [Design length 71.550 km] (hereinafter referred to as the “said section”) in the State of Rajasthan on Design, Build, Finance, Operate and Transfer (DBFOT) basis;
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended upto the date of receipt of bid, (herein referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the Agreement entered into between the Authority and the Concessionaire, hereby notifies that 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in column (2) of the Table 1 for net road section of 59.250 km length for use of the four and more lane sections (hereinafter referred to as “base rate”) and at one and half times of the base rate for one number of bypass having design length of 12.300 km on the Types of Vehicles specified in column (1) of the Table 1 below, and authorizes the said Concessionaire to collect and retain the fees on and from the date of commercial operation dated (COD) declared by the Authority and on getting the completion certificate or the provisional completion certificate as the case may be from the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the Agreement;

2. In addition to the above, the following fee shall also be due and payable for the use of following bypass at the base rate mentioned in the Table below, cost of which is specified hereunder and at the following toll plaza:

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for noncommercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs 215.00 (Rupees Two Hundred Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National Highway fee (determination of Rates and collection) Rules, 2008.
4. 5. Fee for commercial vehicles (excluding vehicles plying under National Permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rule.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed portion of the length of the project Highway. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the concessionaire and thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be effected with in a period of six months from the date of the preceding revision of fee.
