. to Koehl section) ofNational Highway No. 47 in the State ofKerala to the National High\VaysAuthority of India (hereinafter referred to as the "Authority"); · . And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/s IVRCL Chengapalli Tollways Limited~ having,_ its regiStered office at M22/3RT, Vijayanagar Coiony, Hyderabad-500057, Andhra Pradesh, India, (herefuafter referred to as the "Concessionaire"), the successful bidder for bids submitted on 26.11.2009 for the development of Chengapalli to Start of Coimbatore Bypass from Km 102.035 (Design Chainage) to Km 144.680 (Design Chainage) and End of Coimbatore Bypass to Tamil Nadu/Kerala Border from Km 170.880 (Design Chainage) to Km 183.010 (Design Chainage) on NationatMighway No. 47 (hereinafter referred to as the "said section") to six lane and four lane divided carriageway respectively and operation and maintenance of the said section.
Now, therefore, in exercise of the powers conferred by section SA of the National Highways· Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and CollectionY Rules, 2008 (hereinafter referred to as the "Rules''), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said .

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non commercial purposes and resides within a ~ nf twenty kilometers from the toll plaza is Rs. 200.00 (Rupees Two Hundred only).for the year 2012-13 which is subject to revision -e~ery year as per the _provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely. · Amount Payable . 5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section.unless the excess load has been removed from such mechanical vehicle.
6. All 'definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall.be..as.,pet..definitions. specified in., the Rules.
7. The ,fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.
8. Based on the Base rate offee per km for the base year 2007-08 as mentioned in Table-1 & 2, the actual amount of fee to be charged from the mechanical-vehicfes andtlie discounts wiii"~e calculated by the Au1}1ority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper; e_ach in English and vernacular language ac~rdingly.
