NOTIFICATION New Delhi, the lst March, 2013 S.O. 500(E).-Whereas by notification of the Govcmment of ·India . in the erstwhile Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways) number S.O 1096 (E) dated 4th August, 2005, issued under section 5 of the National Highways Act, 1956 ( 48 of 1956), the Central Government has entrusted National Highway No. 92 to the State Government of Madhya Pradesh. · And whereas, a Memorandum of Understanding was entered between Central Government and the State Government of Madhya Pradesh on August 6, 2009 for the development of National Highway No. 92 from Gwalior to MP!UP Border situated in the State of Madhya Pradesh .
And whereas, the State Government of Madhya Pradesh authorized Madhya Pradesh Road Development Corporation Limited, Bhopal (hereinafter referred to as the "Authority") to ~ct as implementing Authority on behalfofthe Government ofMadhya Pradesh.
And whereas, the Authority has entered into an Agreement (hereinafter referred to as said "Agreement") with M/s MP Highways Limited, having its registered office at D-5/7, Vasant Vihar, New Delhi (hereinafter referred to as the "Concessionaire"), the successful bidder for the bids submitted on 21.05.2010 for the development of the existing road from kilometer 0.000 to kilometer I 08.000 (Approximately 107.50 km) on the Gwalior-Bhind to MPIUP Border Section of National Highway No 92 (hereinafter referred to as the "said section") in the State of Madhya Pra{jesh by Two Laning thereof on Design, Build, Finance, Operate and Transfer (DBFO:r) basis.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 ( 48 of 1956),. read with rule 3 of the National Highways . Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "Rules"), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the Agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in column (2) of the Table 1 for net road section length of 107.50 Kms for use of the two and more lane sections (hereinafter referred to as "base rate") on the Types of Vehicles specified in column (1) of the Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified .in the agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plazas for the distance specified for such Toll Plazas:

2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial pirrposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 200.00 (Rupees Two Hundred only) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and · Collection) Rules, 2008.
3. For multiple journey on the highway section, passes shall be issued at the following rates, namely.
Amount Payable Maximum number of one Period of validity way journeys allowed One and half times of the fee Two Twenty four hours from the for one way journey time of payment Two-third of amount of the Fifty or more One month from date of fee payable for' fifty or more payment single journeys
4. Mechanical vehicle which is loaded in excess of permissible load specified fqr its cate~ory wrder the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and sh?-11 not pe entitled to make use of the highway section unless the e~cess load has been removed from such mechanical vehicle. · 6 ------------------, THE GAZETTE OF INDIA : EXTRAORDINARY [PART II-SEC. 3(ii)J
5. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions speeified in the said Rule.
6. The fee rates shall be displayed for information of the users in accordance:with rules 12 of the said Rule.
7. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and ~he discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly, provided that no revision shall be effected within six months.
