'ITT\TWJG ct ~I\KJ-qra ct "-iTli" "ft c1m Ji ITTi~=rn, ~- ~. ffib, 'fif'tq Naya Raipur, the 13th July 2018 NOTIFICA Tl ON 522 ( 1) No. F 06-1 l/2018/CT(R)/V(53). - In exercise of the powers conferred by Clause-a of sub-section- I of Section-9 of the "Indian Stamp Act 1899 (No.2 of 1899)", the State Government hereby exempts those firms, established under the "Chhattisgarh State Logistics Park Policy 2018", from Stamp Duty chargeable on the deeds executed for seeking loans/advances from Banks/Financial fnstitutions,which have been duly permitted by the Reserve Bank Of fndia,within a period of three years from the sanction of such loan.
Explanation:- For the purpose ofthis notification :-
1. Eligibility of exemption to above units will be in accordance with the criteria mentioned in point-6 of "Chhattisgarh State Logistics Park Policy 201811.
2. The definitions for the purpose of exemption will be same as in the "Chhattisgarh State Logistics Park Policy 2018", as defined in its Appendix(!).
3. Only those units will be eligible for exemption from Stamp Duty as per the prov1s10n of the "Chhattisgarh State Logistics Park Policy 2018", whose certificate of exemption from Stamp Duty (Appendix "A") has been issued by the Commissioner-Industries/Director-Industries or Authorised Officer, authorised by notification. Certificate issued for above-mentioned purpose shall necessarily have exemption criteria mentioned.
4. Such certificate shall be presented in original with the deed presented for registration and will be attached to the office copy of relevant document and also be made part of the record.
5. In relation to this exemption of Stamp Duty, on violation of the conditions mentioned in para .. IO (in the part pertaining to Duties of the Developer) of "Chhattisgarh State Logistics Park Policy 2018" the exemption given will be immediatly rendered ineffective and recovery of the stamp duty so exempted will be made akin to land revenue through The Collector with the assistance of Industries department, including interest @12 .5% from the date ofreceipt of exemption from such stamp duty.
6. The above notification shall be effective from the date of publication in the gazette.
7. Suc.h deeds in which the Stamp Duty has been paid before the date of publication in the gazette of this notification by respective parties, will not be eligible for exemption from the stamp duty under this notification.
