¼ty lalk/ku] unh fodkl vkSj xaxk laj{k.k foHkkx½ vf/klwpuk ubZ fnYyh] 13 fnlEcj] 2019 का.आ. का.आ. का.आ. का.आ. 4533453345334533(अ(अ(अ(अ))))————अंतरराि�यक नदी जल िववाद अिधिनयम, 1956 (1956 का 33) (िजसे इसम� इसके प ात् उ# अिधिनयम कहा गया ह)ै क' धारा 4 के अधीन अिधसूचना सं+यांक का.आ. 465 (अ), तारीख 24 फरवरी, 2010 2ारा वंसधारा जल िववाद अिधकरण (िजसे इसम� इसके प ात् उ# अिधकरण कहा गया ह)ै का अंतरराि�यक वंसधारा नदी और उसक' नदी घाटी से संबंिधत जल िववाद8 के 9यायिनण:यन के िलए गठन =कया गया था; और, उ# अिधिनयम क' धारा 5 क' उपधारा (2) के अधीन उ# अिधकरण से, तीन वष: क' अविध के भीतर, अथा:त, तारीख 23 फरवरी, 2013 को या उससे पूव: अपनी Cरपोट: और िविन य देना अपेिDत था; और, उ# अिधकरण ने Cरपोट: और िविन य EFतुत करने क' अविध को 24 फरवरी, 2013 से एक वष: क' और अविध बढ़ाने का अनुरोध =कया था और के9Iीय सरकार ने अिधसूचना सं+यांक का.आ. 436(अ), तारीख 22 फरवरी, 2013 2ारा Cरपोट: और िविन य EFतुत करने क' अविध को 24 फरवरी, 2013 से एक वष: क' और अविध के िलए िवFताCरत कर =दया था; और, ओिडशा सरकार ने 2006 क' Cरट यािचका (िसिवल) सं+यांक 443 म� अंतव:तM आवेदन सं+यांक 2013 का 8 2ारा माननीय उOतम 9यायालय से के9Iीय सरकार को अिधकरण के गठन क' तारीख 17 िसतQबर, 2012 से संगणना का िनदRश देने का अनुरोध =कया; और, माननीय उOतम 9यायलय ने तारीख 13 =दसंबर, 2013 को मामले क' सुनवाई क' और यह आदेश पाCरत =कया =क Tय8=क अिधकरण ने 17 िसतंबर, 2012 से काय: करना Eारंभ =कया था इसिलए उस तारीख को उ# अिधिनयम क' धारा 5 क' उपधारा (2) के अधीन यथा उपबंिधत तीन वष: क' अविध क' संगणना के Eयोजन के िलए वंसधारा जल िववाद अिधकरण के गठन क' Eभावी तारीख के Uप म� समझा जाएगा; और, के9Iीय सरकार ने अिधसूचना सं+यांक का.आ. 778(अ) तारीख 14 माच:, 2014 2ारा यह िविन य =कया =क उ# अिधकरण के गठन क' Eभावी तारीख 17 िसतंबर, 2012 होगी और तदनुसार उ# अिधिनयम क' धारा 5 क' 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उपधारा (2) के उपबंध8 के अधीन वंसधारा जल िववाद अिधकरण 2ारा Cरपोट: और िविन य EFतुत करने के िलए तीन वष: क' अविध 17 िसतंबर, 2012 से Eारंभ होगी; और, उ# अिधकरण ने Cरपोट: और िविन य EFतुत करने क' अविध को 17 िसतंबर, 2015 से एक वष: क' और अविध बढ़ाने का अनुरोध =कया था और के9Iीय सरकार ने अिधसूचना सं+यांक का.आ. 2581(अ), तारीख 18 िसतंबर, 2015 2ारा Cरपोट: और िविन य EFतुत करने क' अविध को 17 िसतंबर, 2015 से एक वष: क' और अविध के िलए िवFताCरत कर =दया था; और, उ# अिधकरण ने Cरपोट: और िविन य EFतुत करने क' अविध को 17 िसतंबर, 2016 से एक वष: क' और अविध बढ़ाने का अनुरोध =कया था और के9Iीय सरकार ने अिधसूचना सं+यांक का.आ. 2971(अ), तारीख 16 िसतंबर, 2016 2ारा Cरपोट: और िविन य EFतुत करने क' अविध को 17 िसतंबर, 2016 से एक वष: क' और अविध के िलए िवFताCरत कर =दया था; और, उ# अिधकरण ने उ# अिधिनयम क' धारा 5 क' उपधारा (2) के अधीन अपनी Cरपोट: और िविन य तारीख 13 िसतंबर, 2017 को EFतुत कर =दया था; और, उड़ीसा रा�य ने तारीख 11 =दसंबर, 2017 को उ# अिधिनयम क' धारा 5 क' उपधारा (3) के परंतुक के अधीन उ# अिधकरण को और िनदRश =कया तथा क� Iीय सरकार ने उ# अिधकरण म� तारीख 12 =दसंबर, 2017 को और िनदRश =कया तथा उ# अिधकरण ने 10 =दसंबर, 2017 को या उससे पहल ेएक वष: क' अविध के भीतर अपनी अितCर# Cरपोट: EFतुत करनी थी; और, उ# अिधकरण ने अपनी अितCर# Cरपोट: EFतुत करने क' अविध 11 =दसQबर, 2018 से एक वष: क' और अविध बढ़ाने का अनुरोध =कया था और के9Iीय सरकार ने अिधसूचना सं+यांक का.आ. 474(अ), तारीख 25 जनवरी, 2019 2ारा अितCर# Cरपोट: EFतुत करने क' अविध को 11 =दसQबर, 2018 से एक वष: क' और अविध के िलए िवFताCरत कर =दया था; और, कुछ काय: अभी भी उ# अिधकरण 2ारा पूरा करने के िलए लंिबत हY, उ# अिधकरण ने अपनी अितCर# Cरपोट: EFतुत करने क' अविध 11 =दसंबर, 2019 से एक वष: के िलए और बढ़ाने का अनुरोध =कया ह;ै अतः अब, के9Iीय सरकार, उ# अिधिनयम क' धारा 5 क' उपधारा (3) के पर9तुक 2ारा Eद[\ शि#[य8 का Eयोग करते ]ए, उ# अिधकरण 2ारा अितCर# Cरपोट: EFतुत करने क' अविध को तारीख 11 =दसंबर, 2019 से एक वष: क' और अविध के िलए बढाती ह|ै [ फा. सं. 18/3/2013- बी.एम.] टी. राजेFवरी, अपर सिचव MINISTRY OF JAL SHAKTI (DEPARTMENT OF WATER RESOURCES, RIVER DEVELOPMENT AND GANGA REJUVENATION) NOTIFICATION New Delhi, the 13th December, 2019 S.O. 4533(E).ÑÑÑÑÑÑÑÑWhereas, the Vansadhara Water Disputes Tribunal (hereinafter called the said Tribunal) was constituted on the 24 th February, 2010 vide notification number S.O. 465(E), dated the 24 th February, 2010 under section 4 of the Inter-State River Water Disputes, Act, 1956 (33 of 1956)(hereinafter called the said Act) for the adjudication of the water disputes regarding Inter-State river Vansadhara, and river valley thereof;
And whereas, the said Tribunal was required to submit its report and decision under sub-section (2) of section 5 of the said Act within a period of three years, that is, on or before the 23 rd February, 2013 ;
And whereas, the said Tribunal had requested to extend the period of submission of report and decision for a further period of one year with effect from the 24 th February, 2013 and the Central Government vide notification number S.O. 436(E), dated the 22 nd February, 2013, had extended the period of submission of report and decision for a further period of one year one year with effect from the 24 th February, 2013;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 And whereas, the Government of Odisha approached the Hon’ble Supreme Court vide Interlocutory Application number 8 of 2013 in Writ Petition (C) number 443 of 2006 to direct the Central Government to reckon the date of constitution of the Tribunal as the 17 th September, 2012;
And whereas, the Hon’ble Supreme Court heard the matter and passed the order on the 13 th December, 2013 that as the Tribunal started functioning with effect from the 17 th September, 2012, that date be considered as the effective date of the constitution of the Vansadhara Water Disputes Tribunal for the purpose of calculating the period of three years as provided under sub-section (2) of section 5 of the said Act;
And whereas, the Central Government vide notification number S.O. 778(E), dated the 14 th March, 2014, had decided that the effective date of constitution of said Tribunal shall be the 17 th September, 2012, and accordingly, under the provisions of sub-section (2) of section 5 of the said act, the period of three years for submission of report and decision by the Vansadhara Water Disputes Tribunal shall commence from the 17 th September, 2012;
And whereas, the said Tribunal had requested to extend the period of submission of report and decision for a further period of one year with effect from the 17 th September, 2015 and the Central Government vide notification number S.O. 2581(E), dated the 18 th September, 2015, had extended the period of submission of report and decision for a further period of one year with effect from the 17 th September, 2015 ;
And whereas, the said Tribunal had requested to extend the period of submission of report and decision for a further period of one year with effect from the 17 th September, 2016 and the Central Government vide notification number S.O. 2971(E), dated the 16 th September, 2016, had extended the period of submission of report and decision for a further period of one year with effect from the 17 th September, 2016;
And whereas the said Tribunal submitted its report and decision under sub-section (2) of section 5 of the said Act on the 13 th September, 2017;
And whereas the State of Odisha made further reference to the said Tribunal under the proviso to sub-section (3) of section 5 of the said Act on the 11 th December, 2017 and the Central Government made further reference to the said Tribunal on the 12 th December, 2017 and the Tribunal had to submit its further report within a period of one year, that is, on or before the 10 th December, 2018;
And whereas, the said Tribunal had requested to extend the period of submission of further report for a further period of one year with effect from the 11 th December, 2018 and the Central Government vide notification number S.O. 474(E), dated the 25 th January, 2019, had extended the period of submission of further report by the said Tribunal for a further period of one year with effect from the 11 th December, 2018;
And whereas certain actions are still pending for completion by the Tribunal, the said Tribunal has now requested to extend the period of submission of further report for a further period of one year with effect from the 11 th December, 2019;
Now, therefore, in exercise of the powers conferred by the proviso to sub-section (3) of section 5 of the said Act, the Central Government hereby extends the period of submission of further report by the said Tribunal for a further period of one year with effect from the 11 th December, 2019.
