(Published in the Official Gazette Series-I No. 16 dated 16-7-1992) _____________________________ - 42 - GOVERNMENT OF GOA Department of Industries Notification 15/14/92-IND Whereas vide proclamation dated 6-1-2000, published in the Official Gazette, Series I, No. 41, dated 7- 1-2000 (hereinafter referred to as the "said Proclamation"), the Government had published its proposal to declare the industrial Areas as specified in the Schedule to the said Proclamation, to the notified areas and to declare that the provisions of any law relating to local authorities providing for control or erection of. buildings, levy and collection of taxes, fees and other dues to the local authorities, which is in force in the said areas shall cease to apply thereof and that the Municipalities is and the Village Panchayats, which were receiving house tax from the occupants of the said areas under their respective laws shall be compensated by the Government to the extent of the last financial year's collection of taxes for such period as may be determined by the Government, which shall not be for less than five years (hereinafter referred to as the 'said proposal') in terms of clause (a) and (c) respectively of sub-section (1) of section 37 A of the Goa, Daman and Diu Industrial Development Act, 1965 (Act 22 of 1965) (hereinafter referred to as the 'said Act'); And whereas in pursuance of sub-section (2) of section 37 A of the said Act, the Government had, vide said Proclamation, invited all persons who entertained any objections to the said proposal to submit the same in writing with reasons therefore to the Director of Industries and Mines, Panaji within two months from the date of publication of the said Proclamation in the Official Gazette; And whereas the said Gazette was made available to the public on 7-1-2000; And whereas written objections to the said proposal were received from the public, village Panchayats and organizations by the Director of Industries and Mines, Panaji, within the stipulated period of 2 months; And whereas, some of the persons/Organizations, besides filing written objections to the said proposal, requested to give them personal hearing in order to put forth then objections, which request was granted by the Director of Industries and Mines, Panaji; And whereas the main contention of the local bodies/Panchayats is that they will be deprived of financial assets in the form of house tax/fees, etc; And whereas the aforesaid contention is not correct as the Municipalities and Village Panchayats which were receiving house tax will be compensated by the Government as specified in the said Proclamation; And whereas the Director of Industries and Mines vide his Report No. 125/NA/DIM/Dev/99- 2000/vol. II/563 dated 24-10-2000, recommended to the Government that a final notification may be issued declaring notified areas subject to certain conditions for the purpose of section 37 A of the said Act; And whereas the Government is of the opinion that the objections submitted under Subsection (2) of section 37 A of the said Act, are' insufficient or invalid. Now therefore, in pursuance of clauses (a) and (c) of sub-section (1) of section 37 A of the Goa ,Daman & Diu Industrial Development Act, 1965 (Act 22 of 1965), Government is pleased to declare the Industrial areas as specified in the Schedule to the said - 43 - Proclamation and reproduced in the Schedule herein below to be notified areas and to declare that the provisions of any law relating to local authorities providing for control or erections of buildings, levy and collections of taxes, fees and dues to the local authorities which is in force in the said areas shall cease to apply thereof and that the Municipalities and the Village Panchayats which were receiving house tax from the occupants of the said areas under their respective laws shall be compensated by the Government to the extent of the last financial years collection of taxes for such period as may be determined by the Government, which shall not be for less than five years.

(1) of section 37 A of the Goa, Daman and Diu Industrial Development Act, 1965 (Act 22 of 1965), (here in after called the "said Act"), vide Notification No. 15/14/92-IND dated 20-2-2001 published in the Extraordinary Official Gazette, Series I No. 47 dated 22-2-2001 and specified in the Schedule hereto, (here in after called the "said areas"), in terms of clause (b) of sub-section
(1) of section 37 A of the said Act; And whereas the Government of Goa also proposes to authorise the said Corporation for the purpose of exercising all the powers, such as, control or erection of buildings, levy and collection of taxes, fees another dues in respect of local authority which is in force in the said areas, in terms of clause (d) of sub- section (1) of section 37 A of the said Act. 02. Collection of House tax from the Occupant in the Industrial Estates. (hereinafter collectively called as the said proposal.) And whereas in pursuance of sub-section (2) of section 37 A of the said Act, the Government of Goa had, vide said Proclamation, invited all persons who entertain any objections to the said proposal to submit the same in writing with reasons there or to the Director of Industrial, Trade and Commerce, Government of Goa, Panaji, Goa within two months from the date of publication of the said Proclamation in the Official Gazette; And whereas the said Official Gazette was made available to the public on 12-1-2005; And whereas no objection is received by the Director of Industries, Trade and Commerce on the said proposal within the said period of two months. Now, therefore, in exercise of the powers conferred by clauses (a) and (c) of sub-section
(1) of section 37 A of the said Act, the Government of Goa is hereby pleased to declare certain additional industrial areas as specified in the Schedule to the said Proclamation and - 73 - specified in Schedule hereto to be notified areas and also declare that the provisions of any law relating to local authorities providing for control or erection of buildings, levy and collection of taxes, fees and other dues to the local authorities which is in force in the said areas shall lease to apply thereof and that the Municipalities and the Village Panchayats, which were receiving house tax from the occupants of the said areas, under their respective laws, shall be compensated by the Government to the extent of the last financial year’s collection of taxes, for period of five years. Also, in exercise of the powers conferred by clauses (b) and (d) of sub-section (1) of section 37 A of the said Act, the Government of Goa is pleased to appoint the said Corporation for the purpose of the assessment and recovery of any taxes as per the provisions of law as in force, and authorise said Corporation for the purpose of exercising all the powers, such as, control or erection of building, levy and collection of taxes, fees and other dues in respect of local authority which is in force in the said notified areas. House tax, other taxes, fees and all other types of dues so collected by the Goa Industrial Development Corporation in respect of said notified areas shall be deposited with the Government immediately by the said Corporation after such collection under Budget Head.

1. Short title and commencement.— (1) This Scheme may be called the Goa Waste (Scrap) Recycling Units Scheme, 2010.
(2) It extends to the whole State of Goa.
(3) It shall come into force from the date of its publication in the Official Gazette.
2. Definitions.—In this Scheme, unless the context otherwise requires—
(a) “Goa Industrial Development Corporation” means the Goa Industrial Development Corporation established under the Goa, Daman and Diu Industrial Development Corporation Act, 1965 (Goa Act 22 of 1965);
(b) “District” means the District of State of Goa;
(c) “Director” means the Director of Industries, Trade and Commerce;
(d) “Sub-Divisional Magistrate” means the Magistrate having jurisdiction over Sub- Division of a District;
(e) “recyclable waste” means all waste that can be recycled including scrap except waste covered under the Bio-Medical Waste (Management and Handling) Rules, 1998 and the Hazardous Wastes (Management and Handling) Rules, 1989;
(f) “State” means the State of Goa.
3. Objectives of the Scheme.— (1) To provide for orderly establishment of wasteRecycling units in the State of Goa.
(2) To provide for establishment of trade zones to conduct the business of buying, Selling and processing of recyclable waste.
(3) To identify and allot land for the units dealing in buying and selling of recyclable waste.
4. Registration.— (1) No person shall conduct any business in the recyclable waste in the State of Goa unless he gets himself registered with the Directorate of Industries, Trade and Commerce.
(2) Every person who on the date of commencement of this Scheme is engaged in the business of recyclable waste shall get himself registered with the Directorate of Industries, Trade and Commerce within two months of such commencement.
(3) Every application for registration shall be made in the Form I hereto and addressed to the Director of Industries, Trade and Commerce.
5. Eligibility for Registration.— (1) A person who has established the business of recyclable waste anywhere in the State of Goa shall be eligible to apply for registration under this Scheme.
(2) The application for registration shall be accompanied by registration fee of Rs. 1000/- (Rupees one thousand only) and other documents as desired by the Director, shall be submitted to the Director as and when required thereof. The Director shall issue - 89 - acknowledgement and receipt of the application.
(3) Any person who fails to apply for registration shall not be allowed to continuewith the business of recycling waste and the necessary action shall be taken as per law as in force.
6. Registration process.— (1) The applications which are complete in all respect shall be referred by the Director of Industries to the Joint Committee constituted at the Sub- Divisional Office level. Such Joint Committees shall be constituted by the District Magistrates for North and South Goa Districts at Panaji, Mapusa, Bicholim, Pernem, Ponda, Margao, Vasco, Quepem and Canacona and shall consist of the following members, namely:—
(i) Sub-Divisional Magistrate concerned —Chairman.
(ii) Sarpanch/Chief Officer of the village/ /Municipality concerned —Member
(iii) Sub-Divisional Police Officer concerned —Member
(iv) Station Fire Officer Incharge of the area concerned —Member
(v) Representative from the Health Department —Member
(vi) Representative from the Town and Country Planning Department —Member
(vii) Representative of Commissioner of Labour and Employment —Member
(viii) Representative from the Goa Industrial Development Corporation —Member
(ix) Representative from the Goa State Pollution Control Board —Member
(x) Functional Manager from the Directorate of Industries —Convener
(2) The Joint Committee shall scrutinize and assess all the applications referred to it by the Director of Industries.
(3) The Joint Committee shall meet on fortnightly basis and shall endeavor to decide on each application within a period of three months.
(4) The decision of the Joint Committee shall be in the form of recommendations either to register unit or not by giving reasons therefore.
(5) The Director of Industries shall issue a certificate upon registration on the receipt of recommendations from the Joint Committee in the Form II. The applicant shall display registration certificate prominently at his/her place of business.
(6) Those persons whose applications for registration have been rejected shall forthwith stop all the trade operations, remove all material and vacate the place, failing which, action will be initiated as per law as in force.
(7) The Director of Industries shall send one copy of certificate of registration to the Commissioner of Commercial Taxes for tax assessment and another copy of the registration shall be sent to the Sub- Divisional Magistrate concerned, for information.
(8) The certificate of registration shall be valid for one to three years depending upon the type of trading activities as carried out by the persons and the Director may renew the same on payment of renewal fee of Rs. 500/- (Rupees five hundred only).
7. Trade zones.— The Government may, in consultation with the Goa Industrial Development Corporation establish trade zones for recyclable waste within 2 years. Such trade zones shall be established in different parts of the State after assessing and studying the needs of the traders. Such zones shall also be located considering the proximity to the existing - 90 - Industrial Estates. Land should be clear from all encumbrances and conducive for the running of the recyclable waste units while confirming to the laws as in force. The Goa Industrial Development Corporation shall undertake the development of the land and provision of necessary infrastructure for the conduct of the trade zones. Besides, the Goa Industrial Development Corporation shall endeavour to identify vacant plots in the existing Industrial Estate for location of scrapyard as short term measure.
8. Allocation of land.— The allotment of land in the trade zone shall be made by the Goa Industrial Development Corporation strictly to registered persons only after detailed assessment of the requirement. Preference will be given to those persons who establish processing facility attached to the trading business. The land shall be allotted on lease basis/rental basis subject to such terms and conditions and at rates as may be fixed by the Goa Industrial Development Corporation, taking into consideration the prevailing market price, development cost and other factors in conformity with the policy of the Goa Industrial Development Corporation. Once the allotment of land is completed by the Goa Industrial Development Corporation, the applicant shall take possession of the land as allotted and translocate the business within a period of three months from the date of allotment of land, failing which, the land shall be reverted back to the Goa Industrial Development Corporation and the registration of the trader shall be liable to be cancelled. The utilization of the land for purpose it is allotted will be monitored by the Additional Collector every year and submit report to Secretary (Revenue) who may take appropriate decision in case the land is not utilised for the purpose it is allotted.
9. Financial assistance.— All registered recyclable waste units shall be eligible for financial assistance as applicable under the various existing Government Schemes.
10. Enforcement mechanism.— The Joint Committee specified in Clause 6 of this Scheme shall have the powers to enquire into any complaint against waste recycling units and take all necessary action deemed fit including recommending cancellation of registration, if it is found necessary. And whereas the Corporation have approached the Government with a request to grant exemption from effecting conversion of the use of land in respect of the said lands; And whereas the Government have carefully considers the said request of the Corporation. 1. Short title and commencement.— (1) These regulations may be called the Goa Industrial Development Corporation Allotment (Second Amendment) Regulations,
2021.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Amendment of Regulation 3.— In Regulation 3 of the Goa Industrial Development Corporation Allotment Regulations, 2014 (hereinafter referred to as the “principal Regulations”) for clause (g), (h) (i), (h) (v), (h) (vii), (k) and (l), the following Clause shall be substituted, namely:— “(g) Local Person” means a person born in the State of Goa or a person residing in the State of Goa for the past 15 years or more or a person having at least one of the parents born in the State of Goa”. “(h) (i) Manufacturing Industry related to manufacture (manufacturing, processing etc. classified as per the National Industrial Classification which is used to issue Udyog Adhar Memorandum/Udhayam registration by Ministry of MSME and for large scale Industry and Internal Trade Ministry of Commerce & Industry) of all types of goods except tobacco products and any other product/activity barred by the specific orders of the Government or ‘by the Corporation’”. “(h) (v) Automobile/Aircraft/Ships repair & services with showroom area not exceeding 10% of the built up area”. “(h) (vii) Deleted Existing scrap yard will however continue on the same terms & conditions”. “(k) “Utilities” for the purpose of these Regulations shall mean & include:-
(i) Canteens set up and/or promoted by the Corporation;
(ii) Electricity sub-station;
(iii) Water treatment and sewage/ water treatment plant and other common infrastructure/facilities requirement of the Industrial Estate;
(iv) Emergency Services similar to that of Medical Emergency services and; Any other activity similar in nature with prior approval of the Board. “(l) “Commercial activity” for the purpose of these Regulations shall mean and include:—
(i) Hotels;
(ii) Kiosks; - 104 -
(iii) Canteen/Restaurant other than those promoted or set up by the Corporation;
(iv) Bank;
(v) Trade Centre (means a common central place which will supply business with access to trade services and facilities in order to simplify and stimulate Trade by bringing together various organizations and Industries that serve and carry on trade);
(vi) Petrol Pump;
(vii) Gala Types Services (small built up and readymade sheds for providing essential and ancillary services to industrial units); All other activities not falling under definitions 3(h), (i), (j), (k) and (i) to (iv) of (l).
3. Amendment of regulation 8.— In regulation 8 of the principal Regulations, the following item shall be substituted, namely:— “The allotment done by the Corporation shall be generally in consonance with the Investment Policy of the State of Goa and norms prescribed under the environmental guidelines issued by the Government from time to time. Accordingly allotment in Industrial Estates will be restricted to Industries in the Green and Orange categories only. Further, no new allotment for tobacco product industry will be allowed in the Industrial Estates of the Corporation”. Derrick P. (Published in the Official Gazette Series I No. 49 (Extraordinary No. 2) dated 8th March, 2021) ____________________ - 105 - GOVERNMENT OF GOA Department of Industries Goa Industrial Development Corporation —— Notification Goa-IDC/Regulation/4952 In exercise of the powers conferred by clause (d) of sub-section (1) of section 51 read with sub- section (2) of section 29 of the Goa Industrial Development Act, 1965 (Act 22 of 1965), the Goa Industrial Development Corporation, with prior approval of the Government of Goa, hereby makes the following regulations so as to amend the Goa Industrial Development Corporation Transfer and Sub- Lease Regulations, 2018, namely:—
1. Short title and commencement.— (1) These regulations may be called the Goa Industrial Development Corporation Transfer and Sub-Lease (First Amendment) Regulations, 2021.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Amendment of regulation 5.— In regulation 5 of the principal Regulations clause
(iv) following Clause is Deleted. “Provided that for any Industrial Undertaking unit which is or was utilized as Industrial Undertaking unit by the original allottee/transferee/sub-lessee cumulatively for a minimum of 15 years, having a plot area not exceeding 2000 sq. mtrs. shall be allowed to change the use from Industrial Undertaking unit to Service Industry unit, either for itself or for use of sub-lessee/ transferee as the case may be”.
3. Amendment of regulation 6.— In regulation 6 of the principal Regulations, clause
(iv) shall be substituted namely:— “(iv) The allottee shall make the payment within a period of 14 days from the date of issue of Order by the Corporation. If the allottee fails to pay the fees within 14 days, an interest @ 12% per annum shall be charged on the fees payable. If the allottee fails to pay within 120 days, the transfer shall stand cancelled”.
4. Amendment of regulation 7.— In regulation 7 of the principal Regulations, clause
(v) shall be substituted namely:— “(v) The Corporation shall be at liberty to change this fee structure from time to time upon concurrence with the State Government duly notified in Government Gazette. It is made clear that Fee Structure prevailing as on date of decision to allow transfer would be relevant”.
5. Amendment of regulation 8.— In regulation 8 of the principal Regulations, clause
(iii) shall be substituted namely:— “(iii) The Corporation shall issue an Order for sub-lease with demand for payment of sub-lease fees as stipulated below. The period for payment will be 14 days from the date of issue of Order by the Corporation. If the allottee fails to pay the fees within 14 days, a simple interest @ 12% per annum shall be charged on the fees payable. If the allottee fails to pay within 120 days, the sub-lease shall stand cancelled”.
6. Amendment of regulation 9.— In regulation 9 of the principal Regulations, clause - 106 -
(v) shall be substituted namely:— The Corporation shall be at liberty to change this fee structure from time to time upon consultation with the State Government duly notified in Government Gazette. Whereas, vide Notification No. 15/14/92-IND dated 20-02-2001, published in the Official Gazette, Extraordinary, Series I No. 47 dated 22-02-2001 (hereinafter called the “said Notification”), the Government of Goa has declared, interalia, the industrial areas as specified in the Schedule to the said Notification to be notified areas under the provisions of clauses (a) and (c) of sub-section (1) of section 37 A of the Goa Industrial Development Act, 1965 (Act 22 of 1965) (hereinafter called the “said Act”); And whereas, the Government of Goa now proposes to declare certain additional industrial area as specified in the Schedule hereto (hereinafter called the “said area”), to be notified area and to declare that the provisions of any law relating to local authorities providing for control or erection of buildings, levy and collection of taxes, fees and other dues to the local authorities which are in force in the said area shall cease to apply thereof and that the Municipalities and the Village Panchayats, which were receiving house tax from the occupants of the said area, under their respective laws, shall be compensated by the Government to the extent of the last financial year’s collection of taxes for a period of five years in terms of clauses (a) and (c), respectively of sub-section (1) of section 37 A of the said Act; And whereas the Government of Goa also proposes to appoint the Goa Industrial Development Corporation (hereinafter called the “said Corporation”) for the purpose of the assessment and recovery of any taxes as per the provisions of law as in force and to authorize the said Corporation for the purpose of exercising all the powers, such as, control or erection of building, levy and collection of taxes, fees and other dues in respect of local authorities which arc in force in the said area, in terms of clauses (b) and (d) of sub-section
(1) of section 37 A of the said Act (hereinafter collectively called the “said proposals”). House tax, other taxes, fees and all other types of dues so collected by the said Corporation in respect of said area, shall be deposited with the Government immediately by the said Corporation after such collection under Budget Head:— 0851—Village and Small Industries; 101 —Industrial Estate; 02 —Collection of house tax from the occupant of the Industrial Estate. Now, therefore, in pursuance of sub-section (2) of section 37 A of the said Act, the Government of Goa, hereby invites all persons who entertain any objections to the said proposals to submit the same in writing with reasons therefor to the Director of Industries, Trade and Commerce, Government of Goa, Panaji, within two months from the date of publication of this proclamation in the Official Gazette.

3. Amendment of section 49.— In section 49 of the principal Act,-
(i) in sub-section (1), for the expression “with imprisonment for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both”, the expression “with fine which may extend to fifty thousand rupees” shall be substituted;
(ii) in sub-section (2), for the expression “with imprisonment for a term which may extend to three months or with fine which may extend to Rs. 1000/- or with both”, the expression “with fine which may extend to fifty thousand rupees” shall be substituted.
