Whereas vide Notification Series I No. 35 dated 5-12-2006, published in the Official Gazette, Extraordinary No. 2 (hereinafter called the said Notification), in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Goa promulgated the Goa Information Technology Development Ordinance 2006 and established the Goa Information Technology Development Corporation (hereinafter called the said Act); And whereas the Government of Goa now proposes to declare certain areas as specified in the Schedule hereto (hereinafter called the said areas), to be notified areas to declare that the provisions of any law relating to local authorities providing for control or erection of buildings, levy and collection of taxes, fees and other dues to the local authorities which are in force in the said areas shall cease to apply thereof and that the Municipalities and the Village Panchayats, which were receiving house tax from the occupants of the said areas, under their respective laws, shall be compensated by the Government to the extent of the last financial years collection of taxes, for a period of five years, in terms of clauses (a) and

(c) respectively of sub-section (1) of section 38 of the said Act; And whereas the Government of Goa also proposes to appoint the Dy. Director (Accts &Admn.), Directorate of Information Technology (hereinafter called the said Officer) for the purpose of the assessment and recovery of any taxes as per the provisions of law as in force and to authorize the said Officer for the purpose of exercising all the powers, such as, control or erection of building, levy and collection of taxes, fees and other dues in respect of local authorities which are in force in the said areas, in terms of clauses (b) and

(d) of sub-section (1) of section 38 of the said Act (hereinafter collectively called the said proposals). House tax, other taxes, fees and all other types of dues so collected by the said Officer in respect of said areas, shall be deposited with the Government immediately by the said Officer after such collection under Budget Head. 0851- Village and Small Industries. 101- Industrial Estates. 02- Collection of House Tax from the Occupant in the Industrial Estate. Now, therefore, in pursuance of sub-section (2) of section 38 of the said Act, the Government of Goa, hereby invites all persons who entertain any objections to the said proposals to submit the same in writing with reasons therefore to the Director of Information Technology, Government of Goa, Panaji within one month from the date of publication of this Proclamation in the Official Gazette/local newspaper. -4-

Now, therefore, in pursuance of sub-section (2) of section 38 of the said Act, read with section 21 of the General Clauses Act, 1897 (Act No. 10 of 1897), the Government of Goa hereby amends the said Proclamation dated 9-1-2007, as follows:- In the said Proclamation, published in the Official Gazette, Extraordinary No. 2, Series I No. 40, dated 10-1-2007, in the fourth paragraph, for the words within one month, the words within two months shall be substituted. (hereinafter collectively referred to as the said proposals); And whereas vide said Proclamation the Government of Goa had invited objections from all persons to the said proposals and to submit the same in writing with reasons thereof to the Director of Information Technology, Government of Goa, Panaji within 2 months from date of application of the said Proclamation in the Official Gazette and local newspaper; And whereas the said Official Gazette was made available to the public on 10-01-2007 and 02-11-2007 and the local newspaper on 11-02-2007 and 04-11-2007 respectively. And whereas no objections have been received by the Director of Information Technology on the said proposals within the said period of two months; And whereas the Goa Information Technology Development Act, 2007 (Goa Act 10 of 2007) (hereinafter referred to as the said Act) has replaced the said Ordinance. 1. Government of Goa (GoG) has a mandate to improve the efficiency and productivity of operations of all departments in addition to being citizen centric and desires to create a mechanism to deliver public services by leveraging the infrastructure like Goa Broadband Network (GBBN), State Data Centre (SDC), Digi-Locker, Payment Gateway, e-Sign, Common Service Centre, existing back-end application through the project “E-District” and which is available at https://www.goaonline.goa.in.

2. Under this project, the concerned Department has a mandate to fine tune their application and integrate with e-District Platform to deliver Government Services electronically.

3. E-District project envisages integrated and seamless delivery of citizen services by District Administration/State Administration through automation of workflow, back end computerization, data digitization across participating departments.

4. The Citizen/Applicant shall apply for desired e-services available under this project at https://www.goaonline.goa.inand shall strictly follow the prescribed procedure defined/notified for delivery of a particular e-Service by the respective Department.

5. The Citizen/Applicant shall affix his digital signature generated through AADHAAR based Online eSign Electronic Signature Service of Controller of Certifying Authority of India on the electronic record of the application available at a particular e- Service, coupled with the electronic copies of the documented presented in support thereof and shall store the same on the prescribed IT Infrastructure in the prescribed manner.

6. The appropriate public authority, after following the prescribed electronic workflow shall issue/grant of any license, permit, certificate, sanction or approval through this project by affixing his digital signature generated through AADHAAR based Online eSign Electronic Signature Service.

7. The license, permit, certificate, sanction or approval issued by an appropriate public authority can be verified online at https:// www.goaonline.gov.in.

8. The process of applying e-Services by Citizens/Applicant and also the issue/grant of any license, permit, certificate, sanction or approval through this project by an appropriate public authority using AADHAAR based Online eSign Electronic Signature Service is legally recognized with the virtue of the rules framed by Ministry of Communications and Information Technology, Government of India vide Notification dated 27-1-2015 in the exercise of the powers conferred by sub-section (4) of section 3A of the Information Technology Act, 2000 (21 of 2000) namely Electronic Signature or Electronic Authentication Technique and Procedure Rules, 2015.

9. Therefore, it is hereby notified that the e-Services which are mentioned in Annexure-A would be delivered to the Citizen through this project with immediate effect. Also, as and when new e-Services are enabled through this project the same shall https://www.goaonline.goa.in/ https://www.goaonline.goa.in/ http://www.goaonline.gov.in/ -14- be notified.

10. (i) in clause (g), for the expression “Integrated Information Technology Township/Information Technology Parks”, the expression “Integrated Information Technology Township/Information Technology Parks, Information Technology (IT) Companies, Information Technology Enabled Services (ITES), Startup, Electronic Manufacturing Cluster (EMC), Industry 4.0” shall be substituted;

(ii) after clause (g), the following clauses shall be inserted, namely:—

(ga) “Information Technology (IT) Companies” includes Information Technology Software, Information Technology Services;

(gb) “Information Technology Enabled Services (ITES)” includes Call Centres, Medical Transcriptions, Back Office Operations/Business Process Outsourcing -17- (BPO)/Knowledge Process Outsourcing (KPO), Website services and Development, AVGC (Animation, Visual Effects, Gaming and Comics), Information Technology System Audit Services, Legal Database Processing, Bioinformatics, Information Technology enabled banking, non-banking services including insurance, pension asset management and market related services, Information Technology solution provider/Implementers (including server data banks, application service provider, internet/web based e-commerce service providers and system integrators)/Visual Effects/Digital Entertainment and Information Technology Engineering Services Companies;

(gc) “Startup” means an entity, in-corporated or registered in Goa;

(i) not prior to seven years, and in case of Biotechnology Startups, not prior to ten years;

(ii) with annual turnover not exceeding Indian Rupee (INR) 25 crores in the preceding financial year; and

(iii) working towards innovation, development or improvement of products or processes or services, with a high potential of employment generation or wealth creation; and

(iv) not formed by splitting up, or reconstruction, of a business already in existence;

(gd) “Electronic Manufacturing Cluster (EMC)” means either a Greenfield EMC or a Brownfield EMC notified under the guidelines for notifying Brownfield Clusters under M-SIPS Scheme dated 14.01.2013 [F. No. 36(3)/2012-IPHW] or a Greenfield EMC as notified under clause 6.8(iii) of the guidelines No. 8(50)/2011 -IPHW dated 15th April, 2013;

(ge) “Industry 4.0” means current trend of automation and data exchange in manufacturing technologies including cyber-physical systems, the Internet of things and cloud computing;

Due to the uniform nature and characteristics of weights and measures that are used across small, medium or large businesses, no distinction may be made based on risk. (ii) Concerned Deputy Director of Directorate of Information Technology, Electronics and Communications, Government of Goa Member;

(iii) One member to be nominated by the Corporation from amongst the Directors of the Corporation Member;

(iv) an officer not below the rank of Deputy Town Planner to be nominated by the Government Member Secretary;

(v) Head of Engineering Section/Chief Engineer of the Corporation; Member; -47- “38A. Development of notified area.— (1) Notwithstanding anything to the contrary contained in any other law for the time being in force, once a notification is issued under sub-section (1) of section 38 declaring an area to be a notified area, the Government may by notification in the Official Gazette, appoint a committee consisting of— to decide and dispose of all applications for land development permissions and building construction, under all local or special laws including Goa Town and Country Planning Act, 1974 (Act 21 of 1975) and rules framed thereunder (hereinafter, in this section, referred to as the “said Act”).

(2) The committee shall discharge all the functions of the Chief Town Planner, Town and Country Planning Department in a non planning area, and functions of the Planning and Development Authority in a planning area, under the laws in force.

(3) The committee shall have regard to the provisions of all local laws including any regional plan, outline development plan, comprehensive development plan or other plans prepared under the said Act.

(4) Notwithstanding anything to the contrary contained in any other law for the time being in force, permissions for any land development and building construction in a notified area shall be decided and disposed by the said Committee and the same shall be governed by the Goa Land Development and Building Construction Regulations, 2010.

(5) Any person aggrieved by the decision or order made by the committee, may prefer an appeal to the Goa Town and Country Planning Board.
