1. (I} This Act may be called the Orissa Aided shor11i!k Educational Institutions ( Appointment of Teachers ande.\tont, Second Validation ) Act, 1978.
(2) It shall extend to the whole of the State of Orissa.
2. In this Act, unless the context otherwise Definitions requires,- ( a) ''Education Act" means the Orissa Educa tion Act, 1969 ;
(h) "managing authority" means tlie manag jng committee or governing body, as the case may be, of an aided educational institution ;
(c) words and expressions used in this Act, but not defined herein, shaU have the sarr.e meaning as assigned to them respectively under tbe Education Act or under the Rules and Regulations framed thereunder.
(d) words and expressions used in this Act but not defined berein, shall have the sa ine meaning as assjgned to them respectively under tile Edt:<:ation Act or under the Rules and Regulations framed thereunder.
3. Notwithstanding anything contained in the Valid~tion 01 Education Act or in the Rules and Regulations 1llc appoint.

Act 27 of 1978 (APi>.'.)JNfMBNT OF TEACHERS SECOND VALIDATION) AcT, 1978 {Sch. ) Schedule, of aided ,educational institutions being schools, hlade QY the managing authorities of such schools during the pe1~iod between the 1st April, 1975 and the 1st December, l976 with the approval whether -priot or subsequent to the appointment of the concerned Circle Inspector of Schools in the case of High ·schools and of'the ·concerned ·Circle Inspec tor of Schools or 'District 'Inspector of Schools in the case of Middle English ·scoots, shall, for all intents and purposes, be·deetnetl ·to have be\=fl ·validly m:adc and no such ap'po'i:ntmcnt shall be liable to be challenged or questioned .;before any autl1ority or in any ·court ·of law meMly on .the ground that the appointment -was made :0thcr·wjse -than· ·in accordance with the procedure prescribed by-the 1Education Act -and the Rules .and .Regulations framec thereunder:
Provided that nothing ,jn :this ·section shall gpply to any teacher so appointed if :he had completed. the age of fifty-eight Years ·bY the date of -his .appointment:
Provided further that in the case of teachers ·appo ,intod durfog the .aforsaid ~Period .against any :Jcave vacancy or any vacancy caused on account of deputa tion of any teacher for training ·or against a post created 'for a specific period, the provisions of this section shall apply only to lhc period. of leave or deputation or the s'{Jecific period, ffs the ·case may be.

2. Teachers who wer-e relieved prior to the J st April, 1975 for undergoing training .and have joined during the period between the !st April, 1975 and the 1st December, 1976 after successful completion of training.
3. Teachers who were releived -dru·ing the said period .for undergoing training and :have joined after successful completion-of training.
4. Teachers who are not trained but ,have acquired ' sufficient experience in teaching provided they get themselves trained within such period as the St::!tc Government may fix in .that behalf.
