(a) Where the school committee is satisfied that a parent being bound under the provisions of section 6 ot cause a child to attend, a recognised basic or primary school has, after due warning by or at the instance of the school committee failed to do so, the school committee may apply to the nearest Magistrate for an order directing such parent to cause such child to attend a recognised basic or primary school and the Magistrate shall fix a day for hearing the application and cause notice thereof to be given to the parent.
(b) On the day fixed for the hearing of the application or on any subsequent day to which in may be adjourned, and after hearing the parent or at the discretion of the Magistrate any other person on his behalf, the Magistrate may pass an order directing the parent to cause such child to attend a recognised basic or primary school on and from a data to be specified in the order.
