ORISSA ACT 6 OF 1982 ,- *THE ORlSS A SUB-ORDINATE EDUCATION SERVICE (VALIDATION OF APPOINTMENT) ACT, 1982 - , [Received the assent of the Governor on the 31st q r c h , 19826rst. pubkihed in an extraordinary issue of the Orissn Gazette, dated the 3rd April 19821 AN ACT TO VAWDATE CERTAIN APPOINTMENTS MADE IN THE OBISSA SUB-ORDINATE EDUCATION SERVICES.. , Be it enacted by the Legislature of the State of Orissa in the thirty-third Year of the Republic of India, as follows :- , ' Gbort M a I . (1) This Act may be called the Odssa Subordinate Education Service end (Validation of Appointment) Act, 1982. ,. 1 . Co-op m e
(2) It shall be deemed to have come into force on the 25th day of J-ry,
1982.
2. ln this Act, unless the wntext otherwise requ&,-
(a) "Eduation Senice Rules" means the Orissa Subordinate Edwtion Service (Gened Branch) Rules, 1972;
(b) "Service!' means the Junior -Grade of the Orissa Subordinate Education Seriice (General Branch) comprising of the posts of Assistant Teachers, Headmasters of Middle English Schools and Sub-Inspectors of Schools;

(c) words and expressions used in this Act, but not de6ned herein, shall have the same meaning as assigned to them respectively under the Education Service Rules.
3. ~otwithstapding a f l m contained in the Eduation Service Rules or in any ludgemmt, decree or order of any Court,--
(a) all appomtmeots made to the Service during the period between the 14th September, I972 and the 2lst September, 1977 by way of promotion by selection from the members of the Lower Subordinate Edutration Service shall. for. all intents and purposes, be deemed to have been validly made;
(b) the principles followed and the procedure adopted! in ,making such appointment shall, for all intents and purposes, be deemed to be forming part of this Act and to have been' in force during the aforesaid period, and no such appointment shaU be liable to be challenged in any Court of Law merely on the ground that the appointment was made othenvise than in accordance with the Education Service Rules.
