a THE ORISSA LEGISLATTYE ASSEMBLY PEAKEWS SALARY AND ALLOWANCES ACT, 19601 [Received tlie assent of the Governor on rhc 22nd December J96,first pubJished in art extraordiuary issue oj ihe Orissa Gazette, dated the 4thJanuary 1961 ] AN ACT TO PROVIDE FOR THE SALARY A N D ALLOWANCBS OF THE SPEAKER OF THE ORISSA LEC~ISMTIIYE ASSEMBLY AND OF CERTAIN OTHER MATIERS RELATPlO TO RZM BE it enacted by the Legislature of the StatG of Orissa in the Eleventh Year of the Republic of lndia as follows :-

1. ( I ) This Act may be called the Orissa LRgis- shott ,, lative Assembly Speaker's Salary and AIIowances ,d - Act, 1960. v n ~

(2) It shall be deemed to have come into f a with effect from the 30th December 1959.

2. In this Act unless there is anything repugnant mniin the subject or context-

(a) "Assembly" , means the Orissa Legislative Assembly ;

(b ) "Speaker" shall mean the Speaker of the Assembly.

3. There shall be paid to the S cakcr a salary SJ, of Tone thousand, two hundred an fifty rupeesj per memem.

5. The Speaker shall, throughout his term ofw- ofice and for a period of fifteen days immediateIy thereafter be entitled without payment of rent, to the use of a furnished residence or in lieu thereof a houaerent allowance of one hundred r u p s per mensem., No charge shall fall on hirn personally in respect of he maintenance of a furnished residence provided t o 5im.

8, (1) Subject to any rules made in t h i s behalf TZT%? by the State Goverument, the Speaker shall be entitled allowancn. w-

(a) traveUiqg allowances for himself and members of his family and for the transport of his and his family's effects- (9 is respect of the journey to the State headquarters from his usual place of residence for assuming office, ; and

(ii) in respect of the journey from the State. hadquarters to his usual place of resideil.k on .relinquishing office ;

(b) tmemg md daily allowances in respect of burs undertaken by him in. the dischage of his official duties, or in course of any &dd business whether by water, land or d r ; and

(a) railmy coupons which shall entitle him to travel without papent of any fare by first class by any railway in India for a dishace of six thousand kilometres in the aggregate in a year ; and

(b) road tramport coupons which shaU entitle him to travel without payment of any fare by any stage carriage within the ; State for a distance of ten thousand kilometres in the aggregate in a year :

Provided .that where the journey is performed I by a stap camage not being a transport undertaking vehicle, the operator of such stage carriage 8haH be entitled to be reimbursed by the State Government in such manner and subject to such conditions as may k prescribed by rules made uader this Act.

Explanation I-In computing the distance r e f e d to in clauses (a) and (b), any journey for which fhe S &er is ottcmise entitled to any travelling r' 4 owafict shalt not be taken into account.

Explartarion II-The expression "transport undertaking vehicle" shall have the same meaning as assfgned to it under the Orissa Transport Undertakings (Prevention of Tickettess Travel) Act, 1975 and the . , expression "stage carriage" shall have the same meaning as assigned to it under the Motor Vehicles 40rw9 Act, 1939.

(2) The coupons shall be issued by such autbority and shaU be subject to such conditions as may be p h b e d by rules wade under this Act.]

(2) Subject tc a certificate being appended by the Speaker in that behalf to his travelling allowance bill any jcurney undertaken by him aod to which the bill relates shall be presumed to have been so undertaken in the discharge of his official duties or in the course of official business as the case may be.
