DEPARTMENT RESOLUTION The 17th April 2010 SUBJECT—Reimbursement of VAT on Maize and Broken Rice used for poultry feed and Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced inside the State. The consumption of egg and meat of poultry is increasing at a rapid rate in Orissa. The annual egg and poultry meat production in the State is insufficient to meet the demand of the State. Owing to the increasing demand for egg and chicken in the State, the Poultry Sector has been identified as one with high growth potential capable of generating income and employment opportunities in the rural areas. Keeping this in view, the State Government has declared Poultry as Agriculture in the State vide Resolution No. 27560—AP-II(Poultry)-21/2005-Agrl., dated the 10th August 2005. Since then, numbers of steps have been taken for the development of the sector. The poultry association and entrepreneurs have been representing to the State Government from time to time seeking incentives like exemption reduction of various taxes being paid by them for poultry farming in the State. In consideration of the demands put forth by the Poultry Associations as well as the recommendation of the State Level Apex Committee on Poultry Development, the State Government have been pleased to sanction a scheme for full reimbursement of Value Added Tax (VAT) paid on the Maize and Broken Rice used for poultry feed by the Poultry Farmers and Integrators of Orissa and the Entry Tax paid by the poultry farmers and integrators of Orissa on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and on Eggs for a period of five years. The reimbursement or entry tax shall not apply to Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs imported from outside the State. The detailed operational guidelines for reimbursement of VAT and Entry Tax are enclosed to this Resolution as Annexures-I and Annexure-II, respectively. The above two reimbursement scheme shall be operational with effect from the 1st April 2010 for a period of five years. 1. Title : Reimbursement of Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State by Poultry Farmers and Integrators.
2. Definition :
2.1. Terms and expressions used in this guideline, but not specifically defined herein shall have the same meaning as follows :—
2.1.1. Poultry Farmers All the Layer Farmers having bird capacity of 10,000 or more birds in-lay capacities.
2.1.2. Broiler Farmers All the Broiler Farmers having the bird capacity of 4,000 or more birds production capacity per month.
2.1.3. Integrators All the Integrators having the bird capacity of 50,000 or more per month
2.1.4. Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds @ 2% and on Eggs @ 1% produced and marketed inside the State or as prescribed by Government from time to time.
2.1.5. Bird capacity means the actual number of birds in the firm.
3. Applicability : Reimbursement shall be applicable to the Poultry Farmers, Poultry Integrators of the State, subject to fulfilment of certain eligibility criteria.
4. Eligibility :
4.1. Following categories of Poultry Farmers shall be eligible for the reimbursement of Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State:
(a) Layer Farmers having 10,000 or more bird in-lay capacity
(b) Integrators having 50,000 or more bird marketing capacity per month
(c) Broiler farmers having 4,000 or more bird production capacity per month :
Provided that all the Farmers / Integrators are registered with the concerned Chief District Veterinary Officer (C.D.V.O.).
4.2. The Poultry Farmer / Integrator claiming the reimbursement must have to maintain the Accounts of Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State and the Entry Tax paid by him for the purpose. http://www.docu-track.com/buy/ http://www.docu-track.com/buy/ 3
5. Quantum of Assistance :
5.1. Reimbursement of Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State for all eligible Poultry Farmers / Integrators.
5.2. Reimbursement provided as above shall be considered and allowed on case to case basis keeping in view the budget provisions of the State.
6. Ineligible Farm : Notwithstanding anything contained in this guidelines, above reimbursement shall not be admissible to the Poultry Farmers / Integrators carrying out activities declared ineligible under the Paragraph 4 of this operational guideline.
7. Procedure :
7.1. Eligible Poultry Farmers / Integrators claiming reimbursement of Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State within a period of three months shall submit application in the prescribed form as in Annexure–I appended to these guidelines along with other requisite documents in duplicate through the concerned Chief District Veterinary Officer.
7.2. Application for reimbursement of Entry Tax shall be submitted, for the tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State in a quarter of a financial year within 60 days from the end of the quarter.
7.3. Documentary proof regarding payment of Entry Tax on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State to be submitted along with the application form, from the Assistant Commissioner of Commercial Taxes (Annexure–II).
7.4. The applicant shall give an affidavit to the effect that it shall refund any excess amount availed as reimbursement on Entry Tax, and intimate any change of facts like disposal of assets, reduction of bird capacity and closure of the farm, etc. to the C.D.V.Os. within 15 days of such change (Annexure–III).
7.5. The Poultry Farmer will have to produce the copy of certificate of registration of the unit from the C.D.V.O. (Annexure–IV) at the time of making application.
7.6. The C.D.V.O. shall issue an acknowledgement to the applicant on receipt of the application (Annexure–V).
7.7. On receipt of completed application form, the Chief District Veterinary Officer shall verify the authenticity of the facts concerning the claims and shall forward the application within 15 days of its receipt, with requisite documents to the Director, A.H. & V.S., Orissa, Cuttack along with a report on physical existence of the running Poultry Farm stating the present production and marketing status Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs in the previous month in the prescribed form as in (Annexure–VI). http://www.docu-track.com/buy/ http://www.docu-track.com/buy/ 4
7.8. The Chief District Veterinary Officer, if necessary, may take assistance of a Veterinary Officer having experience on poultry farming of the concerned District, duly authorised for the purpose, for quarterly verification of Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State.
7.9. Any delay up to 30 days in submission of application by the farmer may be condoned by Director (A.H.&V.S.), provided that the delay is fully explained and also provided that no application with a delay of more than 30 days shall not be entertained for condonation of delay.
8. Sanction :
8.1. The applications / proposals shall be placed before a Scrutiny Committee constituted in the following manner, which shall recommend within thirty days of receipt of the applications eligibility and quantum of reimbursement on Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State admissible. The members of the Scrutiny Committee are as follows :–

(ii) Representative of C.C.T . . Member
(iii) Accounts Officer, . . Member Directorate of A.H.& Vety. Services, Orissa, Cuttack

8.1.1. The Director, A.H.& V.S., Orissa, Cuttack on receipt of the report of the Scrutiny Committee shall after examination if necessary, shall issue— Eligibility Certificate (Sanction Order – Annexure–VII) on reimbursement of Entry Tax paid on Commercial Layer Chicks, Broiler Chicks, Broiler Birds and Eggs produced and marketed inside the State.
8.2. The above reimbursement shall be sanctioned / issued by the Director, A.H. & V.S. within 30 days of receipt of application from C.D.V.Os. under intimation to the Commissioner, Commercial Tax, Orissa. Deficiencies, if any, shall be notified to the Poultry Farmers / Integrators for submission of compliance through C.D.V.O. within another 30 days. If no response is received in time, the application shall be returned to the Poultry Farmers / Integrators through C.D.V.O. under intimation to Government.
9. The Poultry Farmers / Integrators shall forfeit the entitlement to the grant of above reimbursement, if it does not file the claim complete in all respect within the prescribed time limit. http://www.docu-track.com/buy/ http://www.docu-track.com/buy/ 5
10. Funds : The State Government in Fisheries & A.R.D. Department will make provision in the Budget (State Plan) and provide funds to the Director, A.H. & V.S., Orissa every year. The reimbursement amount of the Poultry Farmer shall be sent to the farm directly by the Director through Bank Draft / Cheque and shall maintain regular accounts for each case and shall be accountable to the Audit and the State Government. The disbursing agency will forward a list of disbursements by 5th of every month to the Administrative Department.
11. Miscellaneous :
11.1. Representative of the Directorate of A.H. & V.S., Orissa and the concerned C.D.V.Os. shall jointly visit the poultry farms that have got the reimbursement at least once in a year or more often, if necessary for review of performance of the farm and to verify continuance of the eligibility condition with prior intimation to the farm.
11.2. In any event or circumstances, the amount of Entry Tax reimbursed to the Farmers / Integrators becomes due for refund, the same shall be refunded by the Farmer / integrator to the State Government forthwith consequent upon such order of refund issued by Directorate of A.H. & V.S., Orissa.
11.3. If the Poultry Farm has availed any reimbursement by suppression of facts / furnishing incorrect / false / misleading information or facts or materials, the Directorate of A.H. & V.S., Orissa reserves the rights to recall the reimbursement amount or part thereof allowed to the Poultry Farm with penal interest as decided.
11.4. Any clarification relating to these guidelines shall be issued by the Fisheries & A.R.D. Department and such decision will be final and binding on parties. 7.2. Application for reimbursement of VAT shall be submitted, for the stock of Maize & Broken Rice used by the applicant for making the poultry feed in a quarter of a financial year, within 60 days from the end of the quarter.
7.3. Documentary proof for purchase of Maize & Broken Rice for poultry feed and amount paid as VAT for this purpose to be submitted along with the application form, from the Assistant Commissioner of Commercial Taxes (Annexure–II).
7.4. The applicant shall give an affidavit to the effect that it shall refund any excess amount availed as reimbursement on VAT, and intimate any change of facts like disposal of assets, reduction of bird capacity and closure of the farm, etc. to the C.D.V.Os. within 15 days of such change (Annexure–III).
