त ह;ै और क� ीय सरकार ने उ? त अिधिनयम क� धारा 4 क� उपधारा (1) 6ारा (दA त शि? तय� का (योग करते Bए पटसन साम ी म� पैके8जग के मानदडं� क� िसफा�रश करने के िलए का.आ. संF याकं 255(अ), तारीख 27 जनवरी, 2016 6ारा � थायी सलाहकार सिमित का गठन कर �दया ह;ै और क� ीय सरकार, � थायी सलाहकार सिमित 6ारा क� गई िसफा�रश� पर िवचार करने के पI चात् इस बात से संतु> ट ह ै �क पटसन पै$कग साम ी म� पैक �कए जाने के िलए व� तु1 या व� तु1 क� 2ेिणय� या उसके कुछ (ितशत को िविन=द> ट करना, कJ चे पटसन और पटसन पैके8जग साम ी के उA पादन और इनके उAपादन म� लगे Bए K यि? तय� के िहत म� अिनवाय' ह;ै अत: अब क� ीय सरकार, जूट पैकेज साम ी (व� तु पै$कग अिनवाय' (योग) अिधिनयम, 1987 क� धारा 16 क� उपधारा (1) के साथ प�ठत धारा 3 क� उपधारा (1) 6ारा (दA त शि? तय� का (योग करते Bए और का.आ. संF यांक 1024(अ), तारीख 9 माच', 2018 को उन बात� के िसवाय अिधMांत करते Bए िजN ह� ऐसे अिधMमण से पूव' �कया गया ह ैया करने का लोप �कया गया है,,,, यह िनदशे दतेी ह ै�क नीचे दी गई सारणी के � तंभ (2) म� िविन=द> ट व� तुएं उ? त सारणी के � तंभ (3) क� तA � थानी (िवि> टय� म� यथािविन=द> ट ऐसे N यूनतम (ितशत म� आपू;त और िवतरण के िलए इस अिधसूचना के राजपO के (काशन क� तारीख से 30 जून,,,, 2019 तक पटसन पै$कग साम ी म� पैक क� जाएगी,,,, अथा'त्:- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणीसारणीसारणीसारणी Mम सं. वस् तुए ं भारत म� उA पा�दत कJ चे पटसन स ेभारत म� िन;मत पटसन पैके8जग साम ी म� पैक करने के िलए अपेिUत व� तु1 या व� तु1 के वग' के कुल उA पादन का (ितशत 1 2 3 (i) खाVाN न *उA पादन का शत (ितशत (100 %) (ii) चीनी **उA पादन का बीस (ितशत (20 %) *आर�भ म� खाVाW के िलए मागं पO का दस (ितशत (ित वतX नीलामी के माYयम से सरकारी ई-िवपणन पोट'ल (जी ई एम) पर रखा जायेगा । ** उपापन एज�िसय� 6ारा िमल� या खुले बाजार से सीधा Mय के अधीन िविवध (कार के पटसन थैले । 2. सरकारी ई-िवपणन (जी ई एम) पोट'ल के माYयम से खाVाW� क� पै$कग के िलए पटसन थैल� का उपापन परीUण आधार पर आर�भ �कया जायेगा । 3. शुZआत म� मांग पO का दस (ितशत रा[य उपापन एज�सी 6ारा (ितवतX नीलामी के माYयम स ेसरकारी ई-िवपणन (जी ई एम) पोट'ल पर रखा जायेगा । 4. उस िव�तार तक जहाँ तक पटसन िमल� सरकारी ई-िवपणन (जी ई एम) पोट'ल बोली के माYयम से अनु\ात तीस �दन के भीतर आपू;त करने म� असफल रहती ह], व^ मंOालय आ\ापक पैके8जग मानक का अि म Uीणीकरण अनु\ात करेगा और सरकारी ई-िवपणन (जी ई एम) पोट'ल म� (ोAसाहनाAमक भागीदारी के िलए उAपादन-सह-आपू;त आवंटन सूO उपाNत�रत �कया जायेगा । 5. पटसन पैके8जग साम ी क� �कसी कमी या बाधा क� दशा म� या अNय आकि�मक या अAयावIयक दशा म�, व^ मंOालय स�बंिधत उपयो.ा मंOालय� के परामश' से उ. सारणी के �त�भ (3) म� िविन=द_ पैके8जग साम ी का अिधकतम तीस (ितशत तक और Uीणीकरण अनु\ात कर सकेगा । 6. खाV और साव'जिनक िवतरण िवभाग 6ारा तैयार आपू;त योजना के अनुसार उपापन एज�िसय� 6ारा खाVाW पैक के िलए पटसन थैल� का मांग पO नह` रखने क� दशा म� और मांगो का समूह (मांग पO) उAपW होता है तब पटसन िमल� को पटसन थैल� क� आपू;त के िलए युि.यु. अित�र. समय �दया जायेगा; परNतु य�द िमल� िव�ता�रत समय म� थलै� क� आपू;त करने म� असफल रहती ह] तो Uीणीकरण स ेस�बंिधत शतa लागू ह�गी । 7. उ. अिधिनयम के अधीन आरिUत क� प�रिध से िन� निलिखत को बाहर रखा जा सकेगा अथा'त्:- (क) िवटािमन से पु> ट चीनी; (ख) िनया'त क� जाने वाली व� त1ु क� पै$कग ; (ग) खाVाN न� के िलए दस �क. ा. और उससे कम और चीनी के िलए पbीस �क. ा. और उससे कम के छोटे उपभो? ता पैकेज; (घ) सौ �क. ा. स ेअिधक थोक पै$कग; और (ड.) िनया'त के िलए पैक क� गई चीनी जो खाV और लोक िवतरण िवभाग 6ारा �कए गए िनधा'रण और िसफा�रश� के आधार पर िनया'त नह` क� जा सक� थी। 8. यह सुिनि�त करने के िलए �क कb ेपटसन और पटसन पै$कग साम ी के उAपादन म� लगे dि. आ\ापक पै$कग से लाभ (ाe कर�, पटसन 2िमक� को कानूनी शोYय और पटसन �कसान� को तथा कb ेपटसन के उपापन पर गाँठ बनाने वाल� को Aव�रत भुगतान के िलए समथ' बनाने के िलए उिचत �Mयािविध बनाई जाएगी । 9. पैरा 8 म� िन=द_ �Mयािविध म� 2िमक� को कानूनी भुगतान करने पर स�बंिधत रा[य सरकार के 2म िवभाग से आविधक (माणपO तथा कb ेपटसन क� आपू;त के िलए िमल� स ेAव�रत भुगतान का �व (माणपO (ाe करना सि�मिलत होगा । [फा. सं. 9/7/2018-पटसन (भाग)] अतुल कुमार ितवारी, संयु. सिचव ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF TEXTILES ORDER New Delhi, the 30th November, 2018 S.O. 5878(E).—Whereas, the Central Government under sub-section (1) of section 3 of the Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987 (10 of 1987) (hereinafter referred to as the said Act) is empowered to specify the commodities or class of commodities or such percentage thereof to be packed for the purpose of its supply or distribution in such jute packaging material by an Order, after considering the recommendations of the Standing Advisory Committee;
And, whereas, the Central Government, in exercise of powers conferred under sub-section (1) of section 4 of the said Act, has constituted the Standing Advisory Committee vide number S.O. 255(E), dated the 27 th January, 2016, to recommend the norms of packaging in jute material;
And, whereas, the Central Government, after considering the recommendations made to it by the Standing Advisory Committee, is satisfied that it is necessary in the interest of production of raw jute and jute packaging material, and of persons engaged in the production thereof, to specify the commodity or class of commodities and percentage thereof to be packed in jute packaging material.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with sub-section (1) of section 16 of the Jute Packaging Materials (Compulsory Use in Packaging Commodities) Act, 1987 (10 of 1987), and in supersession of order number S.O. 1024(E), dated the 9 th March, 2018, except as things done or omitted to be done before such supersession, the Central Government hereby directs that the commodities specified in column (2) of the Table below, shall be packed in jute packaging material for supply or distribution, in such minimum percentage as specified in corresponding entries in column (3) of the said Table, with effect from the date of publication of this notification in the Official Gazette, up to 30 th June, 2019, namely:- TABLE Sl. (ii) Sugar **Twenty per cent. (20%) of the production * Initially ten per cent. of the indents for foodgrains would be placed through reverse auction on the Government e-Marketplace (GeM) portal.
**In diversified jute bags under direct purchase by the procuring agencies from the mills or open market.
2. Procurement of jute bags for packing of foodgrains through the Government e-Marketplace (GeM) portal shall be initiated on trial basis.
3. To begin with, ten per cent. of the indents shall be placed by the State Procurement Agencies through reverse auction on the Government e-Marketplace (GeM) portal.
4. To the extent jute mills fail to supply through the Government e-Marketplace (GeM) portal bidding within the permissible thirty days, the Ministry of Textiles shall allow upfront dilution of mandatory packaging norm and the allocation formula for the Production-cum-Supply Orders shall be modified to incentivise participation of jute mills in the Government e-Marketplace (GeM) portal.
5. In case of any shortage or disruption in supply of jute packaging material or in case of any other contingency or exigency, the Ministry of Textiles may, in consultation with the user Ministries 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] concerned, allow further dilution of packaging material up to a maximum of thirty per cent. of the percentage specified in column (3) of the said Table.
6. In case the Procurement Agencies do not place indents for jute bags to pack foodgrains as per supply plan prepared by Department of Food and Public Distribution and bunching of demand (indents) takes place then the jute mills shall get reasonable additional time for the supply of jute bags; provided that if the mills fail to supply the bags in the extended period, the conditions relating to dilution shall be applicable.
7. The following may be kept out of the purview of reservation under the said Act:- a) sugar fortified with vitamins;
b) packaging for export of commodities;
c) small consumer packs of ten kilograms and below for foodgrains and twenty-five kilograms and below for sugar;
d) bulk packaging of more than one hundred kilograms; and e) sugar packed for export but which could not be exported on the basis of an assessment and recommendation by Department of Food and Public Distribution.
8. To ensure that persons engaged in production of raw jute and jute packaging material are benefitted from the mandatory packaging, a suitable mechanism shall be devised for enabling payment of statutory dues to jute workers and prompt payment to jute farmers and balers on procurement of raw jute.
9. The mechanism referred to in paragraph 8 shall include obtaining periodical certification from the Labour Department of the State Government concerned on statutory payments to workers and self-certification from the mills on prompt payment for raw jute supplies.
