5.0. 1462(E).- Whereas, by notification of the Government of India in the Ministry of Road Transport and Highways number 8.0. 465 (E) dated the 26th April, 2002 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988) the Central Government has entrusted the stretch from Kilometer [82.040 to Kilometer
316.000 (Tamil Nadu/Kerala Border — Kochi section) of National Highway No. 47 in the State of Kerala to the National Highways Authority of India (hereinafter referred to as the Authority);
And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, I988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said agreement) with M/s. Thrissur Expressway Private Limited, having its registered office at MCH No. 555, Arora Colony, Road No. 3, Banjara Hills, Hyderabad — 500034, India (hereinafter referred to as the “Concessionaire”), the successful bidder for bids submitted on 25.02.2009 for the development of Vadakkaneherry — Thrissur Border section from Km. 240.00 to Km. 270.00 (Design chainage Km. 236.135 to Km. 264,490) on National Highway No. 47 (hereinafter referred to as the “said section”) to six lane divided carriageway and operate and maintenance of the said section.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of V 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the “Rules”), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table l for net road section length of 26.76 Kms. for use of the four and more lane sections (hereinafter referred to as “base rate") and at the base rates specified in the Table No. 2 for bridge/structure/ bypass costing Rupees Fifty crore or more on the Type of Vehicles specified in Table l and 2 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation and on getting work Completion Certificate from NHAI or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

4. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

5. Mechanical vehicle which is loaded in excess of permissible load specilied for its category under the Rules.
shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed ti'om such mechanical vehicle.
6. All definitions including category olirnechanical vehicles. its permissible load. category ot‘exemptcd vehicles.
service road, alternative road etc. shall be as per definitions specified in the Rules.
7. The fee rates shall be displayed for information of the users in accordance with rules 12 ot' the said Rules.
8. Based on the Base rate of fee per km. for the base year 200108 as mentioned in Table-1 and Z. the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 01‘ the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper. each in English and vernacular language accordingly.
