SECTION 6(1) (C) OF THE PASSPORT ACT, 1967 "Subject to the other provisions of this Act,.the passport authority shall refuse to issue a passport or travel document for visiting any foreign country under clause ( C) sub-scttiOll 5 of anyone or more oCthe following groonds, and on no other ground, namely:

(a) that the applicant is not a citizen oflndia.

(b) that the applkant may, or is likely to engage outside India in aaivities prejudicial to tbe sovereignty and integrity of India.

(d) that the presence oftbe applicailt oucside tndiamay, or is likely to prejudice.the friendly relations oflndilj with any foreign country.

(e) that tbe applicant has, at any time during the period offlvc years immediately preceding the date ofhis application been convicted by a court of India IOrany offence involving moral turpitude and sentenced in respect thereof imprisonment for not less than two years.

(vi) When an applicant holds I held a diplomatic I official passport and does not mention in his application at the time of applying 500/- 5001- for an ordinary passport.

(vii) If a student studying in a hostel away from his pennanent address, does not mention his present address with proof in his 5001· (in case of minor, passport application form while applying at RPO/PO in which 500/- where applicant's jurisdiction his permanent address falls. oarent is illiterate)

(viii) In case where an applicant does not disclose that he had applied for a passport earlier claiming that he never received the passport and there is, however, no record of passport 2500/· + 2500/· 1000/- + 2500 "Returned Undelivered", then the applicant may be asked to (Dup licate passport fee) (Duplicate passport fee) apply for duplicate passport with FIR.

(ix) (a) In case, there is forgery of the stamp of ECNRlPCC or any other observation in the passport, then applicant may be interviewed and in case some agent has done this then his 5000/- 1000/- name and address should be taken in writing. The forged .. endorsement should be cancelled and passport restored to the applicant.

(b) If another booklet is required by the applicant, duplicate 5000/· + 2500/- 1000/- + 2500/· passport fee or Rs. 25001· should be charaed. (Duplicate passoort fee) (Duelicate nassoort fee)

(x) In case the passport with forgery has expired, then fresh passport may be issued with normal fee of Rs. 1000/- plus. 2500/- + 10001· (normal 10001. + 1000 (normal passport fee) oassoort fee)

I< " PENALITY FOR OFFENCES UNDER PASSPORT ACT 1967 Note: (i) Under Section 12 of the Passport Act, 1967 - whoever contravenes the provisions of tbe Act by traveling without a valid passport, knowingly furnlsbes wrong information or attempts to alter entries made on the passports or travel documents, fails to produce his/her passport for inspection, knowing uses a passport or travel document used to another person or knowingly allows another person to use a passport or travel document issued to him shall be punishable with imprisonment for a term up to 2 years or with fine up to Rs. 5,000/- or with both 55

(ii) Whoever not being a citizen of India makes an application for a passport or obtains a passport by suppression of information about his nationality or holds a forged Indian passport or travel document shall be punishable by imprisonment up to 5 years and with flne up to Rs. 50,000/-.
