PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No 245] NEW DELHI, FRIDAY, DECEMBER 24, 1 9 7 1 / P A U S A 3, 1893 Separate paging is given to this Part in order that it may be filed as a separate compilation MINISTRY OF EXTERNAL AFFAIRS NOTIFICATION New Delhi, the 24th December 1971 G.S R. 1962.- -In exercise of the powers conferred by section 24 of the Passports Act, 1967 (15 of 1967), the Central Government hereby makes the following rules further to amend the Passports Rules, 1067, namely:—
1. These rules may be called the Passports (Fifth Amendment) Rules, 1971 .
2. In the Passports Rules, 1967,—
(i) in rule 2, in sub-clause (b), for items (ii) and (iii). the following items shall be substituted, namely:— "(ii) making additional endorsement on a passport or travel document in respect of foreign countries;
(iii) issue of a duplicate passport or travel document in lieu of a passport or travel document which has been lost, stolen, damaged, destroyed or otherwise rendered useless;
(iiia) adding a suplementary passport or travel document booklet, when all the pages in an existing passport or travel document have been almost used up;";
(ii) in rule 3 in sub-rule (21. in the proviso, for the words "six months", the words "twelve months" shall be substituted;

(iii) to rule 5, the following proviso shall be added, namely:— "Provided that a passport authority may require the applicant to furnish such additional information, documents or certificates, or both, as the Central Government may consider necessary.";
(iv) in rule 6—
(1) in the proviso—
(a) for item (v), the following item shall be substituted, namely.— "(v) proceeds abroad on an employment voucher or offer of employment;";
(b) after item (vlii), the following item shall be inserted, namely:— "(ix) proceeds to a foreign country to join father, mother, husband, wife, brother, sister, son or daughter anad produces a sponsorship declaration by the applicant's relation signed before an authorised officer of the local Government or Notary Public and attested by the Consular Officer In the Indian Mission or Post in that country or signed before the Consular Officer;'1;
(2) after the proviso, as so amended, the following further proviso shall be inserted, namely:— ''Provided further that no financial guarantee shall be necessary in respect of an applicant abroad, if he—
(i) satisfies the passport authority that he has sufficient means to maintain himself abroad; or
(ii) was exempted from producing financial guarantee at the time the original passport was issued to him.";
(v) after rule 8, the following rule shall be inserted, namely:— "8A. Refund of fees.—Fees shall be refunded if applied for within one year from the date of payment thereof in the following cases:— (J) if after paying the fee, a person does not submit the application for Issue of passport or travel document or for any service on a passport or travel document already held by him;
(ii) If the fee paid is* in excess of the prescribed fee; and
(ili) if the tee is paid for a service for which no fee has been prescribed;";
(vli after rule IS, the following rule shall be inserted, namely:— "16. Inspection of passport or travel document.—The authorities for the the purposes of clause (c) of sub-section (1) of section 12 shall be—
(i) the passport authority,
(ii) the Officer of Customs or police not below the rank of sub-inspector empowered by a general or special order of the Central Government.".
