PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY प्रसार भारती (भारतीय प्रसारण जनगम) अजधसचूना नई ददल्ली, 17 अगस्ट्त , 2021 स.ं ए-10/178/2012-पीपीसी/पीबीआरबी.—प्रसार भारती (भारतीय प्रसारण जनगम) अजधजनयम, 1990 (1990 का 25) के अनुच् छेद 11 के उप- अनुच् छेद (4) के साथ पठित अनुच् छेद 33 द्वारा प्रदत्त िजियों के प्रयोग में जनगम इसके तहत प्रसार भारती (भारतीय प्रसारण जनगम), अनुिासनात्मक काययवाही के जलए प्राजधकारी जवजनयम 2012 में संिोधन के जलए नामत: जनम् नजलजखत जवजनयम बनाता ह:ै-
1. (1) इन जवजनयमों को प्रसार भारती (भारतीय प्रसारण जनगम), अनिुासनात्मक काययवाही के जलए प्राजधकारी (संिोधन) जवजनयम, 2021 कहा जाएगा।
(2) ये राजपत्र में इनके प्रकािन की जतजथ से लाग ूहोंगे।
2. प्रसार भारती (भारतीय प्रसारण जनगम), अनुिासनात्मक काययवाही के जलए प्राजधकारी जवजनयम, 2012 में, जवजनयम 3 के जलए, जनम्नजलजखत जवजनयम प्रजतस्ट्थाजपत दकया जाएगा, नामत:- “3, अनिुासनात्मक काययवाही के जलए प्राजधकारी - सारणी के कॉलम (3) में जवजनर्ददष्ट अनुिासनात्मक प्राजधकारी, सारणी के कॉलम
(4) में तत् स्ट् थानी प्रजवजष्ट में जवजनर्ददष्ट अपीलीय प्राजधकारी, सारणी के कॉलम (5) में तत् स्ट् थानी प्रजवजष्ट में जवजनर्ददष्ट संिोधन प्राजधकारी और कॉलम (6) में तत् स्ट् थानी प्रजवजष्ट में जवजनर्ददष्ट समीक्षा प्राजधकारी अनुिासनात्मक काययवाही के जलए अजधकारी होंगे स.ं 340] नई ददल्ली, मगंलवार, अगस्ट् त 17, 2021/श्रावण 26, 1943 No. 340] NEW DELHI, TUESDAY, AUGUST 17, 2021/SHRAVANA 26, 1943 सी.जी.-डी.एल.-अ.-17082021-229089 CG-DL-E-17082021-229089 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] और उक् त सारणी के कॉलम (2) की तत् स्ट् थानी प्रजवजष्टयों के अधीन जवजनर्ददष् ट पदों के वगगीककरण और वेतन मैठरक्स में लेवल के संबंध में, अजनवायय सेवाजनवृजत्त, पदच् यतु अथवा सेवा से बखायस्ट्तगी की बडी िास्ट् ती अजधरोजपत करने की िजियों को छोडकर, छोटी और बडी िाजस्ट्तयों के अजधरोपण के जलए अपनी सबंंजधत िजियों का प्रयोग करेंगे।‘’ सारणी क्र.स.ं पदों का वगगीककरण और वतेन मठैरक्स में लवेल अनिुासनात्मक प्राजधकारी अपीलीय प्राजधकारी सिंोधन प्राजधकारी समीक्षा प्राजधकारी

1. समूह ‘क’ वेतन मैठरक् स मे लेवल 10 और ऊपर प्रसार भारती बोडय का सदस्ट् य काययकारी सजमजत जजसमें प्रसार भारती बोडय के अध्यक्ष, सदस्ट्य (जवत्त) और सदस्ट्य (कार्ममक) िाजमल होंगे। प्रसार भारती बोडय कें द्रीय सरकार
2. समूह ‘ख’ वेतन मैठरक्स में लेवल 6 स े9 तक आकािवाणी, दरूदियन और प्रसार भारती सजचवालय में तैनात अजधकाठरयों और कमयचाठरयों के संबंध में महाजनदिेक (आकािवाणी) या महाजनदिेक (दरूदियन) या प्रसार भारती बोडय के सदस्ट्य (कार्ममक) जैसा भी मामला हो। ठटप् पणी-1: यदद महाजनदिेक (आकािवाणी) का पद ठरि ह,ै तो महाजनदिेक (दरूदियन) अनुिासनात्मक प्राजधकारी होंगे और इसके जवपरीत महाजनदिेक (दरूदियन) का पद ठरक् त ह ै तो महाजनदिेक (आकािवाणी) अनुिासनात्मक प्राजधकारी होंगे। ठटप् पणी-2 यदद महाजनदिेक (आकािवाणी) और महाजनदिेक (दरूदियन) के दोनों पद ठरि हैं, तो आकािवाणी और दरूदियन में क्रमि: प्रधान महाजनदिेक या महाजनदिेक (समाचार), समाचार सेवा प्रभाग, आकािवाणी और प्रधान प्रसार भारती बोडय के काययकारी सदस्ट्य.
एक सजमजत जजसमें प्रसार भारती बोडय के अध्यक्ष, सदस्ट्य (जवत्त) और सदस्ट्य (कार्ममक) िाजमल हैं। कें द्रीय सरकार [भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 महाजनदिेक या महाजनदिेक दरूदियन समाचार अनुिासनात्मक प्राजधकारी होंगे।
3. समूह ‘ग’ वेतन मेठरक् स लेवल 1 से 5 तक
(i) स्ट्टेिनों या कें द्रों पर तैनात कमयचाठरयों के मामले में सीजनयर टाइम स्ट् केल या उससे ऊपर के स्ट्तर का स्ट्टेिन या कें द्र अध्यक्ष।
(ii) प्रसार भारती के अन्य सभी प्रजतष्ठानों के मामले में सीजनयर टाइम स्ट् केल या उससे ऊपर के स्ट्तर का अजधकारी। ठटप्पणी: यदद एक अजधकारी जजसके पास स्ट्टेिन अध्यक्ष या कें द्र अध्यक्ष का प्रभार ह ै और वह सीजनयर टाइम स्ट् केल के नीचे के स्ट्तर का ह,ै तो उसी क्षेत्र जस्ट्थत दकसी अन् य कें द्र का सीजनयर टाइम स्ट् केल का कें द्र अध्यक्ष या उससे ऊपर के स्ट्तर का अजधकारी अनुिासनात्मक प्राजधकारी होगा।
(i) कमयचारी जजस स्ट्टेिन या कें द्र में तैनात होता ह,ै वहां का संबंजधत क्षेत्रीय अपर महाजनदिेक।
(ii) प्रसार भारती के अन्य सभी प्रजतष्ठानों के मामले में अपर महाजनदिेक स्ट्तर के संबंजधत अजधकारी। ठटप्पणी: यदद संबंजधत के्षत्रीय अपर महाजनदिेक के पद पर पदस्ट्थ अजधकारी के पास प्रभार ह ै या वह उस पद पर नहीं ह ै तो उस क्षेत्र का पययवेक्षण कर रह ेआकािवाणी या दरूदियन के अपर महाजनदिेक अपीलीय प्राजधकारी होंगे।
(i) आकािवाणी या दरूदियन में तैनात कमयचाठरयों के संबंध में महाजनदिेक (आकािवाणी) या महाजनदिेक (दरूदियन) जैसा भी मामला हो
(ii) प्रसार भारती सजचवालय में तैनात कमयचाठरयों के संबंध में सदस्ट्य (कार्ममक) या सदस्ट्य (जवत्त)। ठटप्पणी: यदद महाजनदिेक (आकािवाणी) या महाजनदिेक (दरूदियन) का पद ठरि ह,ै तो प्रसार भारती में उपलब्ध कोई भी महाजनदिेक संिोधन प्राजधकारी होगा। कें द्रीय सरकार मुिा गोयल, अपर महाजनदिेक [जवज्ञापन-III/4/असा./204/2021-22] PRASAR BHARATI (Broadcasting Corporation of India) NOTIFICATION New Delhi, the 17th August, 2021 No. A-10/178/2012-PPC/PBRB.—In exercise of the powers conferred by section 33 read with sub-section
(4) of section 11 of the Prasar Bharati (Broadcasting Corporation of India) Act, 1990 (25 of 1990), the Corporation hereby makes the following regulations to amend the Prasar Bharati (Broadcasting Corporation of India), Authorities for Disciplinary Proceedings Regulations, 2012 namely:-
1. (1) These regulations may be called the Prasar Bharati (Broadcasting Corporation of India), Authorities for Disciplinary Proceedings (Amendment) Regulations, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Prasar Bharati (Broadcasting Corporation of India), Authorities for Disciplinary Proceedings Regulations, 2012, for regulation 3, following regulation shall be substituted, namely:- “3. Authorities for Disciplinary Proceedings.- The Disciplinary Authority specified in column (3) of the table, the Appellate Authority specified in the corresponding entry in column (4) of the table, the Revising Authority specified in the corresponding entry in column (5) of the table and the Reviewing Authority specified in the corresponding entry in column (6) thereof shall be the authorities for disciplinary proceedings and shall exercise their respective powers to impose minor and major penalties, except the power to impose major penalty of compulsory retirement, removal or dismissal from service in respect of the classification of posts and level in pay matrix specified against corresponding entries under column (2) of the said table.” TABLE Sl.

2. Group ‘B’ Level 6 to level 9 in the pay matrix Director General (Akashvani) or Director General (Doordarshan) or Member (Personnel) of the Prasar Bharati Board in respect of officers and employees posted in Akashvani, Doordarshan and Prasar Bharati Secretariat, as the case may be.
Note- 1: In case the post of Director General (Akashvani) is vacant, Director General (Doordarshan) shall be Disciplinary Authority and viceversa.
Note-2: In case both the posts of Director General (Akashvani) and Director General (Doordarshan) are vacant, Principal Director General or Director General (News), News Service Division, Akashvani and Principal Director General or Director Executive Member of the Prasar Bharati Board.

Central Government [भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5 General, Doordarshan News respectively shall be Disciplinary Authority in Akashvani and Doordarshan as the case may be.
3. Group ‘C’ Level 1 to Level 5 in the pay matrix
(i) Station or Kendra Head of the level of Senior Time Scale or above in case of employees posted at Stations or Kendras.
(ii) Officer of the level of Senior Time Scale or above in the case of all other establishments of Prasar Bharati.
Note: In case the Station head or Kendra head is an officer holding current duty charge or is a level below the Senior Time Scale, Station head or Kendra head of the Senior Time Scale or above level at another Station or Kendra in the same zone shall be Disciplinary Authority.
(i) Zonal Additional Director General concerned in case where the employee is posted at a Station or Kendra.
(ii) Concerned officer of the level of Additional Director General in case of all other establishments of Prasar Bharati.
Note: In case incumbent of the post of Regional Additional Director General concerned is on current duty charge or is not in position, the Additional Director General Akashvani or Doordarshan, as the case may be, who is supervising the work of that region shall be Appellate Authority.
(i) Director General (Akashvani) or Director General (Doordarshan) in respect of employees posted in Akashvani or Doordarshan, as the case may be.
(ii) Member (Personnel) or Member (Finance) in respect of employees posted in the Prasar Bharati Secretariat.
Note: In case the post of Director General (Akashvani) or Director General (Doordarshan) is vacant, any Director General available in the Prasar Bharati shall be Revising Authority.
