PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सचूना और प्रसारण मतं्रालय अजधसचूना नई दिल्ली, 12 फरवरी, 2020 सा.का.जन.107(अ).—कें द्रीय सरकार, प्रसार भारती (भारतीय प्रसारण जनगम) अजधजनयम, 1990 (1990 का 25) की धारा 32 की उप-धारा (2) के खंड (घ) और खंड (ड़) के साथ पठित धारा 10 की उप-धारा (1) द्वारा प्रित्त िजियों का प्रयोग करत ेहुए, जनम्नजलजखत जनयम बनाती ह,ै नामत:
1. संजिप्त नाम और प्रारंभ: (1) इन जनयमों का संजिप्त नाम प्रसार भारती (भारतीय प्रसारण जनगम) स्ट्थापन भती बोडड जनयम, 2020 ह।ै
(2) ये रािपत्र में इनके प्रकािन की तारीख को प्रवृत्त होंगे।
2. पठरभाषा: इन जनयमों में, िब तक दक संिभड में अन्यथा अपेजित न हो,:- (क) ‘‘अजधजनयम’’ से प्रसार भारती (भारतीय प्रसारण जनगम) अजधजनयम, 1990 (1990 का 25) अजभप्रेत ह;ै (ख) ‘‘बोडड’’ से प्रसार भारती बोडड अजभप्रेत ह;ै (ग) ‘‘अध्यि’’ से जनगम के भती बोडड का अध्यि अजभप्रेत ह;ै (घ) ‘’सिस्ट्य’’ से भती बोडड का सिस्ट्य अजभप्रेत ह,ै जिसके अतगंडत ऐसे बोडड का अध्यि भी ह;ै स.ं 89] नई दिल्ली, बुधवार, फरवरी 12, 2020/माघ 23, 1941 No. 89] NEW DELHI, WEDNESDAY, FEBRUARY 12, 2020/MAGHA 23, 1941 सी.जी.-डी.एल.-अ.-13022020-216126 CG-DL-E-13022020-216126 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ड़) ‘‘भती’’ से सीधी भती या प्रजतजनयुजि द्वारा (जिसके अंतगडत अल्पकाजलक संजविा भी ह)ै या सीजमत जवभागीय प्रजतयोगी परीिाओं के माध्यम से जनयुजि या जनयोिन अजभप्रेत ह;ै (च) ‘’भती बोडड’’ से जनयम 3 के अधीन स्ट्थाजपत बोडड अजभप्रेत ह;ै (छ) उन िब्िों और पिों के, िो इसमें प्रयिु हैं और पठरभाजषत नहीं हैं, ककंतु अजधजनयम में पठरभाजषत हैं, वही अथड होंग,े िो उस अजधजनयम में हैं।
3. भती बोडड – (1) जनगम, भारत सरकार के संयिु सजचव के वेतनमान से कम वेतनमान वाले पिों पर व्यजियों की जनयुजि के जलए एक भती बोडड की स्ट्थापना करेगा, िो एक अध्यि और सात से अनजधक सिस्ट्यों की ऐसी संख्या िो वह िीक समझे, से जमलकर बनगेा;
परंत ुजनगम का कोई सिस्ट्य या अजधकारी या कमडचारी भती बोडड का सिस्ट्य नहीं होगा।
(2) भती बोडड का मुख्यालय नई दिल्ली में होगा।
4. भती बोडड के अध्यि और सिस्ट्य :-
(1) भती बोडड के अध्यि और सिस्ट्य अिंकाजलक सिस्ट्य होंगे जिनका बोडड द्वारा अजधमानत:
जनम्नजलजखत में से नामजनर्िडष्ट दकया िाएगा:-
(i) कें द्रीय सरकार के ऐसे व्यजि िो पिेन आधार पर, प्रसारण, प्रिासन, लोक प्रिासन या प्रबंधन के िते्र में ज्ञान या अनुभव रखत ेहों;
(ii) प्रसारण के िेत्र में प्रख्यात व्यजि;
(iii) जििण या ज्ञान के ऐसे अन्य जविेषज्ञीय िेत्रों में प्रख्यात व्यजि, िो बोडड िीक समझे:
परंत ुपिेन सिस्ट्यों के अजतठरि, अन्य सिस्ट्यों को अजधकतम तीन वषों के जलए नाजमत दकया िाएगा;
परंतु ऐसे व्यजियों का, पिेन सिस्ट्यों से जभन्न, अजधकतम तीन वषड की अवजध के जलए नामजनर्िडष्ट दकया िाएगा:
परंत ुयह और दक ऐसा कम से कम एक व्यजि अनुसूजचत िाजतयों या अनुसूजचत िनिाजतयों में से और एक व्यजि मजहलाओं में से सिस्ट्य के रूप में नामजनर्िडष्ट दकया िाएगा।
(2) अध्यि और सिस्ट्य, पिेन सिस्ट्यों से जभन्न, ऐसी बैिक फीस, यात्रा भते्त और िहरन े या खान-पान भते्त जनगम द्वारा यथा जवजनजित के हकिार होंग ेककंतु दकसी वेतन या पाठरश्रजमक के हकिार नहीं होंगे।
(3) बोडड, भती बोडड के दकसी सिस्ट्य को हटा सकता ह,ै यदि ऐसा व्यजि- (क) िोषी जसद्ध हुआ हो और उसे ऐसे अपराध, िो कें द्रीय सरकार की राय में नैजतक किाचार हो, के जलए सिा िी गई हो; या (ख) ऐसा अनुन्मोजचत दिवाजलया हो; या (ग) अस्ट्वस्ट्थ जचत्त का ह ैऔर उसे सिम न्यायालय द्वारा ऐसा घोजषत दकया गया हो; या (घ) सरकार या सरकार के स्ट्वाजमत्व या जनयंत्रण वाले जनगजमत जनकाय की सेवा से हटाया या बखाडस्ट्त दकया गया हो; या [भाग III-खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ड़) बोडड की राय में जिसका जनगम में ऐसा जवत्तीय या अन्य जहत हो जिससे उसके द्वारा सिस्ट्य के रूप में अपन ेकायों के जनवडहन पर प्रजतकूल प्रभाव पड़न ेकी संभावना हो; या (च) बोडड की राय में उसन ेऐसा व्यवहार दकया हो िो भती बोडड या जनगम के कायों के असंगत हो।
5. भती बोडड के कायड – (1) भती बोडड, संबंजधत पिों पर लाग ूभती जवजनयमों के अनुसार जनयम 3 के उप जनयम (1) में जनर्िडष्ट पिों हते ुअभ्यर्थडयों के चयन के जलए प्रजतयोगी परीिा या जवभागीय परीिा या सािात्कार आयोजित करेगा और बोडड द्वारा जवजनर्िडष्ट रीजत में, उसके जलए जनयुजि हतेु अभ्यर्थडयों की चयन सूची तैयार करके बोडड को उसकी जसफाठरि करेगा।
(2) उप जनयम (1) के प्रयोिनों के जलए, भती बोडड द्वारा जनयम 3 के उप जनयम (1) में जनर्िडष्ट पिों हते ु अभ्यर्थडयों की परीिाए ंआयोजित करन ेऔर चयन करन ेहतेु बोडड के पूवड अनुमोिन से एक स्ट्कीम तैयार की िाएगी।
(3) भती बोडड – (क) प्रसार भारती सजचवालय से उन ठरि पिों की संख्या का पता लगाएगा जिनके जलए भती बोडड द्वारा समय-समय पर भती की िानी ह;ै (ख) ऐसे पिों के जलए जवज्ञापनों या पठरपत्रों द्वारा आवेिन आमंजत्रत करेगा;
(ग) जवज्ञापनों या पठरपत्रों के उत्तर में प्राप्त आवेिनों की िांच-पड़ताल करेगा;
(घ) अभ्यर्थडयों का चयन ऐसे भती जवजनयमों के अनुसार करेगा िो ऐसे पिों पर लाग ूहैं;
(ड़) भती बोडड द्वारा दकए गए चयनों का ठरकॉडड रखेगा; और (च) यह सुजनजित करेगा दक जनयुजियां भारत सरकार द्वारा अजधकजथत आरिण नीजत के अनुसार हैं।
(4) भती बोडड ऐसे अन्य कतडव्यों का जनवडहन करेगा िो उसे दकसी पि पर भती के संबंध में जनगम द्वारा सौंप े िाएं।
(5) बोडड, भती बोडड की जसफाठरिें स्ट्वीकार करेगा। परंतु बोडड, असाधारण पठरजस्ट्थजतयों में और ऐसे कारणों के जलए िो लेखबद्ध दकए िाए,ं ऐसी जसफाठरिों को अस्ट्वीकार कर सकेगा।
6. जनजधयां – भती बोडड के व्ययों की पूर्तड जनगम की जनजधयों से की िाएगी।
7. जिजथलीकरण – कें द्रीय सरकार को इन जनयमों के अधीन अजधकजथत दकसी ितड या जनबंधन को जिजथल करने की िजियां होंगी।
8. भती बोडड को सजचवीय सहायता – जनगम, भती बोडड को इसके कायों के संचालन में सभी सजचवीय सहायता प्रिान करेगा। [फा.सं. 45011/57/2010-बीएपी] जवक्रम सहाय, संयुि सजचव 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF INFORMATION AND BROADCASTING NOTIFICATION New Delhi, the 12th February, 2020 G.S.R. 107(E).—In exercise of the powers conferred by sub-section (1) of section 10 read with clauses
(d) and (e) of sub-section (2) of section 32 of the Prasar Bharati (Broadcasting Corporation of India) Act, 1990 (25 of 1990), the Central Government hereby makes the following rules, namely:-
1. Short title and commencement.- (1) These rules may be called the Prasar Bharati (Broadcasting Corporation of India) Establishment of Recruitment Board Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.- In these rules, unless the context otherwise requires,-
(a) “Act means the Prasar Bharati (Broadcasting Corporation of India) Act, 1990 (25 of 1990);
(b) “Board” means the Prasar Bharati Board;
(c) “Chairperson” means the Chairperson of the Recruitment Board of the Corporation;
(d) “member” means a member of the Recruitment Board and includes the Chairperson of such Board;
(e) “Recruitment” means appointment or engagement through direct recruitment or by deputation (including short term contract) or through limited departmental competitive examination;
(f) “Recruitment Board” means the Board established under rule 3;
(g) Words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned to them in that Act.
3. Recruitment Board.- (1) The Corporation shall, for appointment of persons to posts carrying scale of pay less than that of a Joint Secretary to the Government of India, establish a Recruitment Board consisting of a Chairperson and such number of members not exceeding seven, as it may deem fit:
Provided that no member or officer or employee of the Corporation shall be a member of the Recruitment Board.
(2) The headquarter of the Recruitment Board shall be at New Delhi.
4. Chairperson and Members of Recruitment Board.- (1) The Chairperson and Members of the Recruitment Board shall be part-time members, nominated by the Board preferably from amongst the following, namely:-
(i) persons from the Central Government having knowledge or experience in the field of Broadcasting, administration, public administration or management, on ex-officio basis;
(ii) persons of eminence in the field of Broadcasting;
(iii) persons of eminence in such other specialised fields of learning or knowledge, as the Board may deem fit:
Provided that persons, other than ex-officio members, shall be nominated for a maximum period of three years:
Provided further that at least one such person shall be from amongst the Scheduled Castes or the Scheduled Tribes and one from amongst women shall be nominated as a member:
(2) The Chairperson and members, other than ex-officio members, shall be entitled to such sitting fees, travelling allowance and boarding or lodging allowance, as may be decided by the Corporation, but shall not be entitled to any salary or remuneration.

(3) The Board may remove a member of the Recruitment Board, if such person-
(a) has been convicted and sentenced to imprisonment for an offence, which in the opinion of the Central Government, involves moral turpitude; or
(b) is an undischarged insolvent; or
(c) is of unsound mind and stands so declared by a competent court; or
(d) has been removed or dismissed from the service of the Government or a body corporate owned or controlled by the Government; or
(e) has in the opinion of the Board such financial or other interest in the Corporation as is likely to affect prejudicially the discharge by him of his functions as a member; or
(f) in the opinion of the Board, has conducted himself in such manner which is inconsistent with the functions of the Recruitment Board or of the Corporation.
5. Functions of Recruitment Board.- (1) The Recruitment Board shall hold the competitive examination or departmental examination or conduct interviews for selection of candidates for the posts referred to in sub-rule
(1) of rule 3 in accordance with the recruitment regulations applicable to respective posts and shall shortlist and recommend to the Board candidates for appointment thereto, in the manner specified by the Board.
(2) For the purposes of sub-rule (1), a scheme shall be prepared by the Recruitment Board with prior approval of the Board, for conducting examinations and selection of candidates for the posts referred to in subrule (1) of rule 3.
(3) The Recruitment Board shall –
(a) ascertain from the Prasar Bharati Secretariat, the number of vacant posts for which recruitment is to be made by the Recruitment Board from time to time;
(b) invite applications by advertisements or circulars to such posts;
(c) scrutinise the applications received in response to the advertisement or circulars;
(d) select the candidates in accordance with such recruitment regulations as are applicable to such posts;
(e) maintain records of selections made by the Recruitment Board; and
(f) ensure that appointments are in accordance with the reservation policy laid down by the Government of India.
(4) The Recruitment Board shall perform such other duty as may be entrusted to it by the Corporation regarding recruitment to any post.
(5) The Board shall accept the recommendations of the Recruitment Board:
Provided that the Board may, in exceptional circumstances and for reasons to be recorded in writing, may not accept such recommendations.
6 Funds.- Expenses of the Recruitment Board shall be met from the funds of the Corporation.
7 Relaxation.- The Central Government shall have the powers to relax any condition or restriction laid down under these rules.
8. Secretarial assistance to Recruitment Board.- The Corporation shall provide all secretarial assistance to the Recruitment Board in the conduct of its function.
