(4) के साथ परित धारा 25 की उपधारा (1) और उपधारा (2) द्वारा प्रित् त िजत तयक का प्रय ग करते एए, जनम् नजलजखत जनयम बनाती ह,ै अथाात:्-
1. संजिप्त नाम और प्रारंभ (1) इन जनयमक का संजिप् त नाम प्रेस पररषि ् (्यकजतिययक के संगमक की अजधसूचना संबंधी प्रदिया) जनयम, 2021 ह ै।
(2) य ेरािपत्र में उनके प्रकािन की तारीख क प्रवृत् त हकगे ।
2. पररभाषए.ं- इन जनयमक में.-- (क) ''अजधजनयम'' से प्रेस पररषि ्अजधजनयम, 1978 (1978 का 37) अजभप्रते ह;ै (ख) ''्यकजतिययक के संगम'' से धारा 5 की उपधारा (3) के खंड (क), खंड (ख) और खंड (ग) में जनर्िाष्ट प्रवागक के ्यकजतिययक के संगम अजभप्रेत ह;ै (ग) ''सजमजत'' से अध्यि द्वारा धारा 8 के अधीन िजतिययक का प्रय ग करते एए जनयम 5 के अधीन गरित संवीिा सजमजत अजभप्रेत ह;ै (घ) ''धारा'' से अधजनयम की धारा अजभप्रेत ह;ै स.ं 64] नई दिल्ली, िुिवार, फरवरी 5, 2021/माघ 16, 1942 No. 64] NEW DELHI, FRIDAY, FEBRUARY 5, 2021/MAGHA 16, 1942 सी.जी.-डी.एल.-अ.-05022021-224974 CG-DL-E-05022021-224974 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ड़) उन िब्िक और पिक ि इसमें प्रयुतिय दकए गए हैं दकन्तु पररभाजषत नहीं हैं, का वही अथा ह गा ि अजधजनयम में उनका ह।ै
3. अजधसूजचत दकए िाने वाले ्यकजतिययक के संगम.—प्रथम पररषि ्के मामले में केन्द्रीय सरकार और दकसी पश्चातवती पररषि ् के मामले में पूवावती पररषि ्का सेवाजनवृत ह न ेवाला अध्यि, धारा 5 की उपधारा (4) के अधीन ्यकजतिययक के संगमक क अजधसूजचत करन े के प्रय िन के जलए, ्यकजतिययक के पात्र संगमक से कम से कम ि ्यकापक रूप से पररचाजलत राष्ट्रीय िैजनक समाचार पत्रक में ्यकापक प्रकािन द्वारा िावक क फाइल दकया िाना आमंजत्रत करेगी।
4. ्यकजतिययक के संगम की पात्रता.—जनयम 3 के अधीन िावे फाइल करने के जलए पात्र ह ने के संबंध में, ्यकजतिययक के दकसी संगम क िावक के फाइल दकए िाने की अंजतम तारीख से पूवा कम से कम छह वषा के जलए तत्समय प्रवृत्त सुसंगत जवजधयक के अधीन रजिस्ट्रीकृत एआ ह ना चाजहए और तत्पश्चात् जनरंतर अपना कारबार करते रहना चाजहए, और ऐसी सुसंगत जवजधयक के अधीन सिम प्राजधकारी द्वारा सम्यतिय: प्रमाजणत उसके सबूत में िस्ट्तावेज़ प्रस्ट्तुत करेगा:
परंत ु्यकजतिययक के ऐसे संगम के संगम का ज्ञापन इसकी सिस्ट्यता क दकसी जवजिष्ट धमा, मूलवंि, िाजत या भाषा तक जनबंजधत नहीं करेगा।
(5) िावक की संवीिा.– (1) जनयम 3 के अधीन ्यकजतिययक के संगमक द्वारा फाइल दकए गए िावक की ऐसी संवीिा सजमजत द्वारा संवीिा की िाएगी ि पररषि ्के सिस्ट्य में से अध्यि द्वारा नाम जनर्िाष्ट दकए िाने वाले ऐसे तीन ्यकजतिययक से जमलकर बनगेी ि दकसी भी रीजत में ऐसे िावेिार संगमक में से दकसी संगम से सहयुतिय नहीं हैं और पररषि ्क अपनी ररप र्ा प्रस्ट्तुत करेंगे।
(2) पररषि,् संवीिा सजमजत द्वारा प्रस्ट्तुत ररप र्ा जवचार करने के पश्चात्, समुजचत जवजनश्चय करेगी और धारा 5 की उपधारा (4) की अपेिानुसार ्यकजतिययक के संगमक क अजधसूजचत करेगी:
परंतु िहां पररषि ्के जवजनश्चय और संवीिा सजमजत की जसफाररिक में अंतर है, वहां ऐसा जवजनश्चय, उपजस्ट्थत और मत िेन ेवाल,े संवीिा सजमजत के सिस्ट्यक से जभन्न, कम से कम तीन चौथाई सिस्ट्यक के बएमत द्वारा दकया िाएगा और मतक के बराबर ह न ेकी ििा में, अध्यि का जनणाायक मत ह गा। [फा. सं.एम-22013/1/2018-प्रेस] जविम सहाय, संयुतिय सजचव MINISTRY OF INFORMATION AND BROADCASTING NOTIFICATION New Delhi, the 5th February, 2021 G.S.R. 102(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 25 read with subsection (4) of section 5 of the Press Council Act, 1978 (37 of 1978), the Central Government hereby makes the following rules, namely:-
1. Short title and commencement.- (1) These rules may be called the Press Council (Procedure for Notification of Associations of Persons) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.- In these rules.-
(a) “Act” means the Press Council Act, 1978 (37 of 1978);
(b) “ associations of persons” means associations of persons of the categories referred to in clause (a), clause
(b) and clause (c) of sub-section (3) of section 5;
(c) “Committee” means the Scrutiny Committee constituted by the Chairman under rule 5 in exercise of powers under section 8;
(d) “ section” means a section of the Act;

(e) words and expressions used but not defined herein shall have the meanings assigned to them in the Act.
3. Associations of persons to be notified.- The Central Government in the case of first Council and the retiring Chairman of the previous Council in the case of any subsequent Council shall, for the purpose of notifying associations of persons under sub-section (4) of section 5, invite filing of claims from eligible associations of persons by giving wide publicity in atleast two widely circulated national daily newspapers.
4. Eligibility of association of persons.- For being eligible to file claims under rule 3, an association of persons must have been registered under the relevant laws for the time being in force for atleast six years prior to last date of filing of the claims and must be conducting its business continuously thereafter, and shall submit documents in proof thereof, duly certified by the competent authority under such relevant laws:
Provided that the memorandum of association of such association of persons shall not restrict its membership to any particular religion, race, caste or language.
5. Scrutiny of Claims.- (1) The claims filed by associations of persons under rule 3 shall be scrutinized by a Scrutiny Committee consisting of three persons to be nominated by the Chairman from amongst members of the Council who are not associated in any manner with any of such claimant associations and shall submit its report to the Council.
(2) The Council shall, after considering the report submitted by the Scrutiny Committee, take appropriate decision and notify the associations of persons as required under sub-section (4) of section 5:
Provided that where the decision of the Council is at variance with the recommendations of the Scrutiny Committee, such decision shall be taken by not less than three-fourth majority of members, other than members of the Scrutiny Committee, present and voting, and in case of equality of votes, the Chairman shall have the casting vote.
