Section 5: Period of retention of a copy of the order of arrest and the material by the Adjudicating Authority

The Adjudicating Authority shall retain the copy of order of the arrest and the material for a period of ten years, or, if before the expiry of the aid period of ten years,-
(i) any proceedings under section 8 of the Act have been commenced.
until the disposal of such proceedings; or
(ii) where an appeal has been preferred to the Appellate Tribunal under section 26 of the Act, until the disposal of such appeal by the Appellate Tribunal: or
(iii) where an appeal has been filed in the High Court under section 42 of the Act, until the disposal of such appeal by the High Court;
