No. AYS-109UC.R. 160/AYU-1.- In exercise of powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf and in force in the State, the Governor of Maharashtra is hereby pleased to make the following rules regulating the recruitment to the post of the Professor and Associate Professor in Maharashtra Ayurvedic Service Group'A' and Assistant Professor in Maharashtra Ayurvedic Service Group 'B', in the Government Ayurvedic Colleges un<ier the Directorate of Ayurved under the Medical Education and Drugs Department of the Government of Maharashtra namely:-

1. These rules may be called the ftofessor and Associate Professor in Maharashtra Ayurvedic Service Group'A' and Assistant Professor in Maharashtra Ayurvedic Service Group 'B', in the Government Ayurvedic Colleges under the Directorate of A1'urwed (Recruitment) Rules, 2013.

2. In these rules, unless the context requires otherwise,- @) 'Arectorahe" meals the Directorate of Ayurveda under the Medical Education a-nd Drugs Department of the Government;

[6) "Government" means the Government of Ma]rarashtra;

(c) "Recogrrised Institution" mearu' an Ayurvedic Institution or College recogrrized under section 27 of the Maharashtra Medical Practitioners Act, 1961 (MahJO(Yil of 1961) and recognized by Central Council of lndian Medicine, New Delhi, from tine to time, under the India-n Medical Central Council Act, 1970 (4t] of 1970).

3. Appointment to the post of Professor in the Maharashtra Ayu:wedic Service, Group 'A', in the Covernment A,'uredic Collcgc in the Directorete shgll be made either:,-

(o) by promotion of a suitable person on the basis of strict selection with due regards to seniority from amongst the person holding the post of Associate Professor hgying not less tha.rr five years regular service in that post:

Provided that, Associate Professor in Sanskrit or Sanskrit Samhita Siddhanta who do not possess qualification prescribed for appointment by nomination under clause (b) (ii) of this rule, will not be eligible for promotion on the post of Professor in Ayurveda Subject, OR .O) by nomiuation from amongst the candidates, who,-

(i) are rllol more than fifty years of age :

Provided that, the age limit may be relaxed by frve years in case of candidates who are already in the service of Government ; and

(ii) Possess qualification mentioned in Parts A, A-1, B orC in the Schedule appended to the Maharashtra Medical Practitioner's Act, 1961 (MahJO(VIII of 1961) or an equivalent qualiEcation specified by the Central Council of Indian Medicine, New Delhi, from time to time, under the Central Council of Indian Medicine Act, 1970 (48 of 1970) and possess postgraduate degree in concerned subject of Ayurveda, obtained from Recogrrised Institution ;

(ilz) possess total teaching experience of ten years in the concerned Al,uwedic subject or.rt of which there shouid be five years teaching exDerience as Associate Professor ir the concerned Ayurwedic subject from Recogrrised Institution ;

(ii,') possess adcqua*,c kncv,'lcdge of English, Msrathi, Senekrit- snd Hi.'di !ang,.:age:

4. Appointment to the post of Associate Professor in the Maharashtra Ayurvedic Service, Group 'A', in the Government Ayurvedic College in the Directorate sha.ll be made either,- ! (r) by promotion of a suitable person on the basis of strict selection with due regards to seniority from amongst the person holding the post of Assistant Professor having not less than five years regular service in that post:

Provided that, Associate Professor in Sanqkrit or Spnskrit Samhita Siddhanta who do not possess qualification prescribed for appointment by nomination under clause (b) (ii) of this rule, will not be eligible for promotion on the post of Professor in Ayurveda Subject, or O) by nomination from aynongst the candidates. who.- ' O are not more than fifty years of age :

(iii) possess total teaching experience of 5 years in the concerrred Ayurvedic subjeet out of which there should be 3 years teaching experience as Assistant Professor in the concerned Ayurved subject from Recognised Tnetitution ;

(du) possess adequate knowledge of English, Marathi, gpnskrit and Hindi langrage:

- fovided that, preference may be given to those candidates whose original research paper has.been published in indexed jouruals on Nahonal level or books in Ayurvedic recognized-by Ceotral Council of Indisn Medicine.

5. Appointment to tho post of Assistart Professor in the Maharashtra Ayuwedic Service,r- GrouP 'B', in the Government Ayurvedic College in the Directorate shall be made by nomination Jfroamongst candidates who,- \* (i) arc not more than forty years of age ;

(iiJ Possess qualification mentioned in Parts A, A-1, B or C in the Schedute appended to the Maharashtra Medical Practitioner's Act, 1g61 (Mah.XXUII of 1961) or ao equivalent' quqlification specified by the Cential Couocil of Indian Medicine, New Delhi, from time to time, under the Central Council of Indian Medicine Act, 1970 (48 of 1970) and possess post-' graduate degree in concerned subject of Ayurved, obtained from Recogrriscd Institution ;

(iii) possess adequate knowledge of English, Marathi, Sanskrit and Hindi language.

6. Appoiutment to the post of Assistant hofessor in Sanskrit in Malarashtra Ayurvedic Service, Group 'B', in the Government Ayurvedic College in the Directorate shall be made by nomination from amongst candidates who,-

(i) are not more than forty years of age ;

(ii) Possess post graduate qualification in Sanskrit such as M.A. Sanskrit or Vyakara[acharya ot Sahityacharya or its recognized by a Statutory Urriversity or.irrstitution recognized by University Grants Commission;

(dll) possess adequate knowledge of English, Marathi, Sanskrit and Hindi la.nguage.

7. Appoiatment to the posts mentioncd in rule 3 and 4 by promotion and nomination shsll be made io the ratio of 50:50.

g. A pcrsor appointed to the poBt mentioned in rules 3,4,5 and 6 by- nomination shall be on probation for a perioa of two years. Probation period may be extended naxiluum. up to one year ;Jr. il;" appointed to the post shall be required_ to complete his probation period successfullv witi'rn orescribea period. If he could not complete the probation suecessfully or found unsuitable foi tt "'po.t within prescribed probation period, he shall be liable to be terminated from the eervice without Prior notice.

9. A person appointed to the post mentioned in rules 3,4,5 and 6 whether by promotion or nomination, shall be-required to pass examinations in Hindi and Marathi according to the rules made in that behalf, unless he hai already passed or has been exempted from passing those examinations.

10. A person appointed to the post mentioned in rules 3,4,5 and 6 should possess a certificate in Computei op"rufio. prescribed by Directorate of Information Technology, Government of Maharashtra, from time to time.

11. A person appointed to the post mentioned in rules 3,4,5 and 6 are, if so required, liable .r,, to serve in any defence services of lndia or a Post connected with defence of India, anywhere in /* India or outside hdia, for a period of not less than four years, but shall not exceed ten years from the date of his appointment and upto the age of 59 years, whichever is earlier.

12. A person selected appointed to the post oentioned in rules 3,4 and 5 required to get himsglf rcgistr.rcd under the Maharashtra Medical Practitioner's Act, 1961 (MahJOTIII of 1961) or Indian-Medicioe Central Council Act, 1970 (48 of 1970) before joining the appointment unless he has already registered himself.

13. Notwithstanding anything contained in these rules, if in the opinion of the Government that the exigencies of ,urvi"es so -reguire, the Government may for reasons to be recorded in writing a,1d fter ascertaining that no qualifred person isavailable for being appointed by promotion wh"""ie. necessary, make ippointment to tlie posts by nominatioa in relaxation of the ratio prescribed in rule i in "onsrriution with the Mahaiashtra Public Service Commission.

14.
