The Puducherry Compulsory Elementary Education Act, 2000Union territory Act of Puducherry · Act 8 of 2001

(1) The Government may make rules to carry out all or any of the purposes of this Act.

(2) Every rule made under this Act shall be laid, as soon as may be after it is made, before the Legislative Assembly of Puducherry while it is in session for a total period of fifteen days which may be comprised in one session or in two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive session aforesaid the Legislative Assembly agrees in making any modification in the rule or agrees that the rules should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be;

so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.

Power to remove difficulties

13. If any difficulty arises in giving effect to the provisions of this Act, the Government may, as occasion requires, by order published in the official gazette, make such provisions, not inconsistent with the provisions of this Act, as appear to them to be necessary or expedient for removing the difficulty:

Provided that no such orders shall be made after the expiry of a period of two years from the date of commencement of this Act.

______ 354 STATEMENT OF OBJECTS AND REASONS FOR ACT NO.8 OF 2001 As per the provisions of Article 45 of the Constitution of India, the state shall endeavour to provide within a period of 10 years from the commencement of the Constitution, for free and compulsory education for all children until they complete the age of 14 years. A policy decision has been taken by the Government of Puducherry to provide compulsory elementary education for all children of school age in this Union territory. In order to give effect to that policy decision, it is necessary to make elementary education compulsory for all such children. It is also necessary to make it obligatory on the part of every parent or guardian of a child to cause the child to attend elementary school. To achieve these objects, it is proposed to enact a law to make elementary education in this Union territory compulsory.

This Bill seeks to achieve the above objects.
