Section 15: Power of entry, search, seizure etc

The Punjab Control of Bricks Supplies, Price and Distribution Control Order, 1998 with AmendmentsState Rules of Punjab · 1949

(1) the Director or the District Magistrate may with a view to securing compliance with the provision of this Order-

(i) enter and inspect any premise on which he has reason to believe that bricks or tiles have been or being or are likely to be manufactured, kept, stored, distributed, sold or disposed of or to and from which bricks or tiles have been or are being or are likely to be removed or transported;

(ii) stop and inspected any vehicle or animal which on which bricks or tiles are being carried for sale, supply, storage, or any other purpose;

(iii) seize bricks or tiles found in possession of any person on any premises or in any vehicle or on any animal in respect of which he has reason to believe that contravention of this Order has been or is being or is about or likely to be committed;

and

(iv) seize any record pertaining to bricks or tiles in respect of which he has reason to believe that contravention of this Order has been or is being or is about or likely to be committed.

(2) Every person (including his agent and servant) incharge of the vehicle or animal or premises which is searched or is sought to be searched under the provision of sub-clause (I) shall allow the authority making the demand an access to such vehicle, animal or premises and shall also answer truthfully and to the best of his knowledge or belief all questions put to him.

(3) The provision of section 100 of the Code of Criminal Procedure, 1973 (Act 2 of 1947) relating to search and seizure shall, so far as may be, apply to searches and seizures under this clause.

16. Cancellation of licence or forfeiture of security - If a manufacturer or dealer contravenes any of the provision of this Order, the District Magistrate may without prejudice to any other action that may be taken, by an order, in writing, cancel or suspended his licence issued under this order or under the Punjab Control or Bricks supplies order, 1972 or forfeit from his security deposit an amount which shall not exceed rupees two thousand five hundred in any case.
